Will The Courts Uphold The Law?

There was a time in America when you were arrested when you did something illegal. That was then; this is now. Just for the record, crossing into America illegally is a crime. Technically, illegal aliens should be sent back to their home countries. It has been a while since we have seen that happen.

On Wednesday, The Daily Caller reported:

Republican Iowa Gov. Kim Reynolds signed a bill Wednesday that will allow both state and local enforcement officials to arrest illegal immigrants who reentered the U.S., as well as authorizing state courts to deport them.

Bill SF 2340, which is expected to go into effect July 1, allows the state to enforce immigration laws and prevent illegal reentry into the state, according to a press release. If caught by officials within the state, illegal immigrants could potentially face up to two years in prison.  

“The Biden Administration has failed to enforce our nation’s immigration laws, putting the protection and safety of Iowans at risk. Those who come into our country illegally have broken the law, yet Biden refuses to deport them. This bill gives Iowa law enforcement the power to do what he is unwilling to do: enforce immigration laws already on the books,” Reynolds stated.

While the Iowa Legislature passed the bill last month, there appear to be questions and concerns over how officials should go about the new addition.

Des Moines Police Chief Dana Wingert told the Associated Press in March that immigration status is not a part of the department’s efforts to protect the community. Wingert told the outlet they were “not equipped, funded or staffed” to aid in the new responsibilities.

“Simply stated, not only do we not have the resources to assume this additional task, we don’t even have the ability to perform this function,” Wingert said.

President of the Iowa State Sheriffs and Deputies Association and Linn County Deputy Sheriff Shawn Ireland told AP News in March that many officials would have to seek guidance from their county attorneys on how to properly implement and enforce the new legislation.

This will undoubtedly wind up in the courts. It will be interesting to see how they rule.

Ignoring The Law Or Skirting The Law When It Is Convenient

On April 5th, Channel 15 News in Wisconsin reported that migrants (illegal immigrants) in the state are being given Covid funds.

The article reports:

Wisconsin state Senator Duey Stroebel, R-Cederberg, sounded the alarm Thursday after learning of a decision in the state’s capital to aid migrants with pandemic relief funds.

The City of Madison, State Sen. Stroebel wrote in a press release, is diverting State and Local Fiscal Recovery Funds (SLFRF) to aid asylum seekers arriving in the city. These funds were issued through the American Rescue Plan to help state and local governments through the COVID-19 pandemic.

Madison is aware asylum seekers arriving in the city can’t receive direct government assistance funds and is therefore using SLRF “as a way around the system,” the senator wrote. Taking to X, he explained these funds can be used to pay utility bills and buy gas and food for migrants.

Notice the use of the word ‘migrants.’ I have no doubt that these are not migrants–they are illegal aliens who have invaded our country and are using up resources that should be spend on Americans in need.

State Sen. Stroebel concluded by asking Rey to provide copies of the grant applications for undocumented migrants, as well as a breakdown of how the $700K is being used.

Earlier this week, Rep. Lisa McClain, R-Mich., demanded answers from President Joe Biden over a program providing asylum seekers with $500 in monthly housing assistance.

Is Anyone Surprised?

On Thursday, The Post Millennial posted an article about a recent group of people who were squatting in the Bronx. These squatters were arrested on drug and gun charges.

The article reports:

Four of the illegal immigrant squatters who were arrested in a Bronx home on charges related to firearms, drugs, and child endangerment reportedly skipped their processing appointments with Immigration and Customs Enforcement (ICE).

According to the New York Post, Yoessy Pino Castillo, Yojairo Martinez, Javier Alborno, and Yerbin Lozado-Munoz, aged 25, were detained by the US Border Patrol in Texas over a year ago. However, they were subsequently released into the country due to overcrowding at processing centers. They failed to appear for their processing appointments.

Johan Cardenas Silva, another individual involved in the squatting incident, was taken into custody in 2022 and had previously been ordered for removal by an immigration judge. However, he was released from his detention center under an order of supervision to report to New York City. Silva failed to attend his Enforcement and Removal Operations appointment upon arriving in New York City.

“At the check-ins, migrants are supposed to file a claim, that could be for asylum, and let officials know where they are staying. Immigration officials can then determine what level of supervision is required,” the Post explained.

The four men were among eight squatters recently apprehended for occupying a house where firearms, drugs, and a seven-year-old child were discovered in the basement.

This is what happens when you fail to secure the borders of the country.

Who Is Protecting American Cities?

On Sunday, Townhall posted an article about an Amendment to H.R. 2882 proposed by Senator Bill Hagerty (R-TN) that would have stopped the Biden Administration from chartering more than 32,000 illegal immigrants from their countries to various American communities.

The article reports:

Sen. Bill Hagerty (R-TN) called out Democrats on Friday night after they opposed legislation that would protect American tax dollars from being spent on flights for hundreds of thousands of illegal aliens to be flown to cities across the country. 

“Make no mistake here. President Biden has secretly been flying hundreds of thousands of illegal aliens in foreign countries into blue-city airports,” Hagerty said from the Senate floor. “Just last year alone, in 2023, it was reported that some 320,000 illegal aliens have been flown in using this method.” 

…Hagerty also warned about the implications of illegal aliens living in American communities would have on Congressional seats and electoral college votes.

“Illegal aliens are counted when determining Americans’ representation in government, and the worth of their votes. The more illegal aliens and non-citizens in your state or district, the greater your voting power in Congress and presidential elections,” Hagerty said in a statement. “This means that in a state like California—or a city like New York—millions of illegal aliens result in several more Congressional seats and Electoral College votes for that jurisdiction.”

He claimed that this explains why every single Democrat who voted on his amendment opposed it, adding that the left is “weaponizing the census.” 

Hagerty accused Democrats of being desperate to preserve their political power and making it easier for blue states to “backfill their declining populations” by delivering illegal immigrants to their towns. 

There is no guarantee how the illegal aliens will vote (without a doubt, they will be voting within five years); however, they will currently impact the census and the Electoral College. Somehow I don’t think this is what the Founding Fathers had in mind.

Asking A Really Good Question

On Thursday, The Federalist posted an article about a really good question Wyoming Senator John Barrasso asked Department of Health and Human Services Secretary Xavier Becerra.

The article reports:

Department of Health and Human Services Secretary Xavier Becerra refused to explain Thursday why “hardworking Americans should pay” for foreign lawbreakers’ healthcare when grilled by Wyoming Sen. John Barrasso.

Barrasso detailed how cities are being overwhelmed by illegal immigrants draining their resources and putting a massive strain on health funds and infrastructure, noting Denver Health saw more than 20,000 illegally present foreigners seeking medical care in 2023. Denver Health is “at a critical, critical point” as costs pile up, CEO Donna Lynne said, according to Becker’s Hospital Review.

“Can you please explain why it is the responsibility of hard-working American taxpayers to foot the bill for all of this care for people, nine million now, from all across the world who have flooded their way into the United States?”

“What I could tell you is that we have extended the resources and authorities that we have at HHS to try to be there to help any healthcare facility when there is a way that we can go in to be supportive. I don’t know of a particular case that you might want to mention, but I know that we are prepared to be supportive of any facility where the authorities that you have given us allow us to go in and support,” Becerra responded.

“The federal government doesn’t pay for the health care of every legal U.S. citizen,” Barrasso shot back. “It seems like it’s in the position now of having to do it all for these illegal immigrants. Why should the American citizen be forced to pay for illegal migrants to receive this same care for free? Because that’s what’s happening.”

At some point our government needs to realize that money does not grow on trees. Our first responsibility should be to Americans. Unless we can afford to give all Americans free health care, we should not be giving it to people who broke the law to get here.

With Apologies To Abbott And Costello

On Monday, John Droz posted an article in substack about the latest unemployment numbers.

The article notes:

Believe it or not (as this superb article explains), there are now SIX different US unemployment rates! Here are the latest (2023) government data for all six. The popularly referred to rates are 3.6% (U-3: unemployed) and 6.9% (U-6: out of work).

However, there is another large fly in the ointment: the unemployment rates (by-and-large) do not count illegal immigrants. When that number was low, it was ignored, as it was considered to be just statistical noise. Since 2020, that is no longer the case, as the current data says some six (6) million new illegal immigrants are in the US, just from the Southern border!

The article includes a spoof of Abbott and Costello’s Who’s On First routine. Here is a portion of that spoof:

No, Biden said you can’t count those “Out of Work” as the unemployed. You have to be looking for work to be unemployed.

Someone who isn’t actively looking for work can’t be counted with those who look for work. It wouldn’t be fair.

Changing The Number At The Border Crossings Without Changing The Number Of Illegal Immigrants

The number of illegal immigrants coming across America’s southern border keeps growing. That number is a problem for the Biden administration. Rather than solve the problem of a porous border, they have found a way to allow the same number of illegal immigrants to enter the country without the numbers at the border continuing to grow.

On March 5th, Townhall reported the following:

According to a Freedom of Information Act lawsuit filed by the Center for Immigration Studies, U.S. Customs and Border Protection approved “secretive flights” for 320,000 inadmissible aliens last year. The individuals were pre-approved on the CBP One app and flew into 43 U.S. airports, though the government refuses to identify which ones.

…Through the CBP One app, the individuals apply for travel authorization, and once here, the parole program gives them two-year periods of legal status allowing them to work. This more direct entry, facilitated by the Biden administration, lowers the total number of illegal border crossings at ports of entry. 

…While the government won’t say which foreign airports the “inadmissible aliens” are coming from, according to Bensman (CIS’s Todd Bensman), only citizens of Cuba, Haiti, Venezuela, Nicaragua, El Salvador, Guatemala, Honduras, Colombia, and Ecuador are eligible for the program. 

Is anyone willing to guess how many of these illegal aliens will illegally vote in November?

When Facts Contradict The Narrative

On Thursday, The Federalist posted an article about the crisis at our southern border. For more than three years, President Biden has been complaining that he can’t do anything about the border unless Congress passes bills that fund Ukraine. He chooses to overlook the fact that on his first day in office he overturned the Executive Orders passed by President Trump that sealed the border. He also chooses to overlook the fact that he not only refused to build the wall–he sold the parts to build it for pennies on the dollar. (article here)

President Joe Biden has vehemently denied any blame for the years-long U.S. southern border invasion with claims that Congress, not the president, must act to defend the nation.

“I’ve done all I can do,” Biden said last month on the White House lawn. “Just give me the power.”

White House Press Secretary Karine Jean-Pierre said the same thing two weeks ago. “There is no executive action that the president can take,” she said, to reinforce the border.

But now Politico is reporting that the president does, in fact, recognize the authority at his disposal to address the border crisis. On Wednesday, the paper reported the administration is “considering a string of new executive actions and federal regulations in an effort to curb migration at the U.S. southern border.”

“Among the ideas under discussion include using a section of the Immigration and Nationality Act to bar migrants from seeking asylum in between U.S. ports of entry,” the report read. “The administration is also discussing tying that directive to a trigger — meaning that it would only come into effect after a certain number of illegal crossings took place.”

The article concludes:

Lies about presidential powerlessness, however, have become the standard response from Democrats on the border. The number of illegal crossings has approximately doubled under President Biden, with 1.7 million “gotaways” evading capture over the three years he’s been in office. Last week, House Republicans formally impeached Homeland Security Secretary Alejandro Mayorkas for failing to keep U.S. borders secure.

“It certainly is a crisis,” Mayorkas said on NBC’s “Meet the Press” earlier this month, “But fundamentally, Congress is the only one who can fix it.”

Biden’s allies on Capitol Hill have made the same arguments. New York Rep. Dan Goldman called the House impeachment of Secretary Mayorkas an example of “taking the scalp” for “the MAGA base” to scapegoat blame for a crisis which can “only be addressed by legislation.”

While Democrats continue to say this on TV, Politico reports more executive orders for border action are in the pipeline, indicating the White House believes it can indeed address the border without the need for action from Congress.

The border remains open because country-club Republicans want cheap labor and Democrats want future voters. Meanwhile, Americans are being denied benefits and being forced out of jobs by illegal immigrants who are working outside the system. We need to close the border, and we need to enforce e-verify.

Where Can We Sign Up?

On Monday, The New York Post reported that New York City Mayor Eric Adams is giving out pre-paid cash cards to illegal immigrants. Maybe I am missing something, but it seems to me that if you want to discourage people from coming to your city, you don’t hand them $10,000 without any kind of an identification check. The possibilities for fraud are endless. Also, what impact does putting $50 million into the New York City economy have on inflation. Didn’t we learn a lesson about that from the Covid stimulus payments?

Earlier this month, The Post broke the story that Mayor Eric Adams is giving out pre-paid cash cards to migrants.

Unusually for the mayor, Adams didn’t publicize this story himself, and his administration for nearly a month has failed to correct several public misperceptions about it.

One misperception is that the program allows the city to give out just $50 million to migrants.

No wonder the mayor has been reticent.

This debit card program — if you read the actual contract — has the potential to become an open-ended, multibillion-dollar Bermuda Triangle of disappearing, untraceable cash, used for any purpose.

It will give migrants up to $10,000 each in taxpayer money with no ID check, no restrictions and no fraud control.

The article also points out that the company overseeing this program is Newark-based Mobility Capital Finance, which also has an office in Harlem. The article explains some of the background of the company and some interesting aspects of the program.

The article notes”

Yes, the city can ask MoCaFi to activate or deactivate certain merchant or spending codes.

But these restrictions are not built into the contract; they are at the city’s changing discretion.

The city can even enable cardholder “consumers” to withdraw cash from the cards at domestic and international ATMs. “ATM withdrawal amounts per day can be restricted as required by the city,” the contract reads. “Should ATM access be included as part of the program, card fees will be subject to the schedule provided.”

The article concludes:

As the mayor told radio host Gary Byrd earlier this month, “it’s important for us to speak directly to you to separate the facts from fiction … Fact from fiction is the migrant cards that we gave out to migrants to purchase food. Just some quick bullets that you need to know about these cards. They are not American Express gold cards, folks. This is a pilot project we’re doing with 500 migrants.”

The fiction is in what the mayor says.

The fact is in the contract documents.

The city has given itself the full contractual and technical authority, under a supposed “emergency,” to disburse billions of dollars in cash to unidentifiable people who otherwise are not eligible to access the American financial system, in untraceable global cash.

An Executive Order That Will Impact The 2024 Election

Under American law, non-citizens are not allowed to vote in federal elections. In some areas, non-citizens are allowed to vote in local elections, but that is somewhat limited. Unfortunately, due to an Executive Order signed by President Biden in January 2021, non-citizens and illegal immigrants will have an influence on our presidential and Congressional elections.

On Thursday, Fox News reported the following:

Immigration experts are raising the alarm about how the increasing flow of migrants illegally crossing into the U.S. may significantly impact states’ representation in the House of Representatives and Electoral College.

Shortly after taking office in January 2021, President Biden signed an executive order requiring that the U.S. Census Bureau factor in all residents, including noncitizens, as part of its decennial calculation of the U.S. population. As a result, the apportionment of House seats and, therefore, electoral votes for presidential elections, could be swayed as migrants continue to pour over the southern border.

“Illegal immigration has all kinds of effects and among them is that it distorts the mechanics of democratic government,” Mark Krikorian, the executive director of the Center for Immigration Studies, told Fox News Digital in an interview. “Illegal immigrants aren’t even supposed to be here, so their inclusion in the census count for purposes of apportionment really is outrageous.”

“There are a lot of close votes in Congress, more than there used to be. So, it can, in fact, make a difference,” Krikorian said. “It shouldn’t be a question of: Does this give you personally more influence in Washington? The question should be: Is it right? Is it healthy for our democratic process to be distorted this way? The answer is no.”

The next President can overturn this order if he chooses to. Vote carefully.

This Is Not Legal

The open border and the flood of illegal immigrants has hit many of our major cities hard. Those cities are trying to feed, house, and provide medical care for thousands of new residents–sometimes at the expense of the American citizens who already live there. Recent events in Chicago illustrate the problem.

On Tuesday, Breitbart reported:

Chicago’s Democrat Mayor Brandon Johnson recently touted his efforts to bestow $18 million exclusively to “black and brown” businesses to feed the thousands of illegal border crossers the city is housing.

Johnson’s administration partnered with the Greater Chicago Food Depository, BJ’s Market, and other nonprofits by diverting the huge sum to minority-owned businesses, according to WFLD-TV.

During a press conference on the partnership, the “sanctuary city” mayor celebrated the program, applauding “black and brown businesses” as the “soul” of Chicago.

“The $17 million investment for these 18 black and brown small businesses, is really the, um… it really captures what I call the soul of Chicago. It’s who we are,” Johnson told the media.

It may be who you are, but I believe it is illegal under the Civil Rights Law to discriminate on the basis of color. Are we now going to have to pass laws prohibiting discrimination against white people?

Johnson has faced backlash from his own constituency over the billions of dollars he has diverted to give illegals free housing, free food, free clothing, free education, free healthcare, free legal advice, and any manner of freebies that have been denied the Windy City’s black population.

 

Paying The Price For The Bad Policies Of Washington, D.C.

On Saturday, Howie Carr posted an opinion piece at the Boston Herald about the impact of the open borders policy of the Biden administration. He shares the information provided to him from a friend and also from someone who is dealing directly with the results of the open southern border.

The other day, a former radio coworker of mine sent me this photo from the Holiday Inn in Marlboro with its vaguely ominous sign:

“Hotel Closed to Public.”

I tweeted out the photo with a brief explanation of what had happened. I was surprised when the photo got far more clicks than anything I’ve ever posted.

The next day, the “hotel” removed the sign and replaced it with something smaller and slightly less obvious.

“Hotel Is Currently Closed.”

The article then goes on to share the firsthand experiences of someone working in a hotel impacted by illegal immigration:

What follows is an account from someone who works in a different one of these “converted” hotels which are decimating the entire communities around them.

There are 200-plus families, he begins, and more than 500 people currently living at the (facility).

It’s not only a roof over their heads and three squares a day, but “free” diapers, wipes, toiletries, free tablets and phones, free English lessons, state case workers making sure all entitlements are taken, free Uber and Lyft rides, free bus passes from (redacted).

All with no end in sight.

All are going to the (redacted) immigration office in Ubers… round trip is more than $130 per trip.

All get DTA (Department of Transitional Assistance, i.e., welfare) benefits, EBT cards. They have more expendable cash than I do.

If DCF (Department of Children & Families) says they need a crib, stroller, toys, etc., management is required order them. Everything is new and arrives the next day from Amazon.

They all have MassHealth, free legal services, free tax-filing services.

Most now have Social Security cards and many are getting work permits, as many have been in the “shelter” for months.

They are learning they can make more on DTA than from working.

The biggest cost that you can’t put a price tag on is the burden on the schools and public-safety budgets.

We daily have local police or fire at the hotel. Police have had to help with fights, guns, drugs, overdoses….

The Push For Amnesty For Illegal Immigrants

Speaker of the House Mike Johnson posted the following on Twitter:

This is the first step toward granting voting rights to all of those who have entered our country illegally. They will not be required to go through the process of becoming a citizen, they will have no understanding of America and its Constitution. They will be a group of totally uneducated voters easily swayed by the lies of the mainstream media. They are here to replace the votes of the Americans who have become aware of the lies of the mainstream media. If amnesty happens, we will not recognize our country within three years.

These Are NOT Families

On Wednesday, The Gateway Pundit posted an article about the continuing flow of illegal immigrants coming into America via our southern border. They are NOT families.

The article reports:

Thousands of military-age men from India, Africa, Latin America and the Middle East invaded Eagle Pass and Lukeville on Wednesday.

December is on track to be a record month for illegal border crossings. According to Customs and Border Protection, more than 300,000 illegals will likely pour into the US in December on Joe Biden’s open border invitation.

Video posted to X by NewsNation correspondent Jorge Ventura showed thousands of illegals – mainly military-age males – at the Eagle Pass, Texas port of entry waiting to be processed.

Border Patrol agents are overwhelmed and thousands more are on the way.

These are not families seeking asylum–they are military-age men. What is going to happen when these military-age men cannot find jobs or cannot find jobs that pay enough to support them? Do you suppose they might follow in the path of the groups that are looting and committing crimes in cities that are not holding criminals accountable? This is a Trojan Horse that is entering our country with the knowledge of the Congress and President who swore an oath to defend us.

Veterans Take Note!

If you are a veteran, the Biden administration is not your friend. At least the Trump administration made some attempt to clean up the problems in the Veterans’ Administration (VA) health system. The Biden administration is working hard to make it worse.

On Friday, Fox News reported:

A long-standing arrangement between the Department of Veterans Affairs and Immigration and Customs Enforcement (ICE) to process claims for migrant medical care is drawing scrutiny from veterans’ advocates — who are concerned that it could affect the agency’s mission of caring for veterans — amid an ongoing border crisis and existing complaints about the care delivered to veterans.

“I’d like to understand why the VA is involved,” Russ Duerstine, executive director of Concerned Veterans for America and a veteran of the United States Air Force, told Fox News Digital.

When an illegal immigrant under ICE detention requires healthcare, they are typically treated on-site by medical professionals. However, if specialist or emergency care is required, they may be transported to an independent private provider.

In such cases, ICE contracts with the VA’s Financial Service Center (VA-FSC) to process reimbursements to those providers. According to a report from July, ICE has hundreds of letters of understanding in which ICE’s Health Service Corps (IHSC) will reimburse providers at Medicare rates. That uses the VA-FSC’s Healthcare Claims Processing System — a portal that allows providers to submit and view claims and access other resources.

The article notes that although the VA plays a role, it does not provide or fund any health care services to individuals detained in [ICE] custody. At no time are any VA health care professionals or VA funds used for this purpose. So why then is the VA even involved?

The article also notes:

Darin Selnick, who served as veterans’ affairs adviser on the Domestic Policy Council during the Trump administration and also as a senior adviser to the VA secretary, said the arrangement was also a surprise to him and others he knew who served during the administration. He believes it would have been stopped if it was more widely known among officials.

“In my position, we would have stopped this, because if the VA had the extra ability to do this, then they should have been doing it for the veterans and not for another agency,” he said.

Duerstine, of Concerned Veterans for America, said he would like to see Veterans’ Affairs committees in Congress take a deeper look into the VA’s role.

 

 

 

The Real Cost Of An Open Border

On Thursday, Fox News reported that the kidnapper charged with the murder of two children in Alabama was someone who had been deported from the United States before.

The article reports:

José Paulino Pascual-Reyes – charged with first-degree kidnapping, three counts of capital murder and two counts of abuse of a corpse in connection to the gruesome discovery — is considered a “re-entry nonimmigrant unlawful presence foreign national,” Tallapoosa County Sheriff Jimmy Abbett confirmed to Fox News Digital by phone on Thursday. 

That means, according to Abbett, that 37-year-old Pascual-Reyes was deported by Homeland Security to Mexico before, but the sheriff could not confirm that time frame or when he is believed to have reentered the United States and to have come to Alabama.

The Tallapoosa County Sheriff’s Office first responded to the area of 3547 County Road 34 in Dadeville, Alabama, at approximately 8:30 a.m. on Monday to a 911 call from a driver who reported stopping to help a 12-year-old girl spotted wandering on the road. Pascual-Reyes, listed as living at that address, was arrested by U.S. Marshals in Auburn, Alabama.

Overnight investigation at the mobile home led to the discovery of two decomposing corpses. 

Abbett confirmed to Fox News Digital that those bodies were that of a woman – Sandra Vazquez Ceja – and her son, a boy under the age of 14. Ceja was on parole pending an asylum claim. Investigators believe the deceased woman was Pascual-Reyes’ girlfriend. 

Abbett praised the surviving 12-year-old girl as a “hero,” saying she endured almost a week of torture. 

The complaint says the girl is believed to have been tied to bed posts for at least a week, was assaulted and kept in a drug-like state by being plied with alcohol. She escaped by chewing through her restraints, according to court documents. 

That child will be traumatized for the rest of her life because the Biden administration couldn’t be bothered to secure our southern border. She represents the true cost of an open border.
