Does The Constitution Apply On College Campuses?

Brandeis University was founded in 1948 as a nonsectarian Jewish community-sponsored co-ed university. It is named for Louis Brandeis, the first Jewish Justice of the United States Supreme Court. Justice Brandeis was a champion of free speech and an ardent Zionist. I am sure he would not be pleased with some recent developments at the university that bears his name.

Today’s Wall Street Journal posted a story about Daniel Mael, a senior majoring in business at Brandeis. Mr. Mael is very active on campus–he is a part of Brandeis’s Orthodox Jewish community, and as a student journalist has published articles in national outlets. On October 14, 2013, two pro-Israel campus groups hosted Barak Raz, a former spokesman for the Israeli Defense Forces (IDF). Eli Philip, another student, who was the leader of the campus affiliate of J Street, attended the event. A rather unfriendly Facebook exchange followed between Mr. Mael and Mr. Philip. The discussion then moved to articles and petitions.

The story continued:

Mr. Philip interpreted this as harassment, and in a Dec. 9, 2013, complaint to Brandeis administrators, he presented charges under the university code of conduct. Mr. Philip said in his written complaint that at a lunch meeting two days after the IDF event, Mr. Mael “accused me of behavior unfitting a Jewish soul” and of harboring “deep-seated ‘evil inclinations.’ ” Mr. Mael, Mr. Philip went on, “informed me that I damaged the Jewish community, that I should resign from my position as student leader, and that he must take action to restore the Jewish community.”

Mr. Mael says his words were misquoted and taken out of context, but that’s beside the point. Religious-oriented conversations, however passionate, don’t amount to harassment, a principle that the U.S. Equal Opportunity Commission has set forth regarding workplaces and one even more relevant on college campuses, where philosophical disputation is supposed to be part of the air students breathe. Nor did the encounter amount to conduct with “the purpose or effect of unreasonably interfering” with Mr. Philip’s “education or work performance,” as the Brandeis student code defines harassment. The students, after all, were having lunch.

Mr.Mael was called into the Dean of Students office on December 5, 2013, and instructed to familiarize himself with the Rights and Responsibilities handbook as Mr. Philip was considering certain actions. Mr. Mael was also advised to avoid using social media. Then on October 8, 2014, Mr. Mael was again called to the dean’s office. At that time he was told that there were charges against him of bullying, harassment and religious discrimination. He was given a week to plead guilty or not guilty to the charges. Mr. Mael was not allowed to keep a copy of the complaint.

The story continues:

In a panic after the meeting with Dean Adams, Mr. Mael consulted his friend Noah Pollak, of the Washington-based Emergency Committee for Israel, which retained the Covington & Burling law firm to act on his behalf. Yet when Mr. Mael’s lawyer initially corresponded with university counsel, he was informed that “parties involved in the conduct process are not permitted to engage legal counsel to act or speak on their behalf.”

Covington & Burling paid no heed. With the deadline approaching and still without a copy of the complaint, Mr. Mael opted to plead not guilty and request a full hearing before a jury of his fellow students.

Mr. Mael was provided with a copy of the charges by the end of October.

The article explains:

And Covington & Burling submitted to Brandies two lengthy legal memoranda blasting violations of Mr. Mael’s rights. One letter concluded: “We reserve all rights on behalf of Mr. Mael, including the right to assert claims for the reputational and other harms caused by the baseless allegations at the heart of this proceeding.” In other words: See you in court.

On Oct. 27 Dean Adams informed Mr. Mael via email that the “allegations against you will not be adjudicated through our Student Conduct Board. The accuser has withdrawn from the option to do so and therefore this case should be considered closed and without determination of fault or sanction. . . . Thank you for your cooperation.”

First of all, if Mr. Philip was all that upset about what Mr. Mael was saying on social media, he could easily have blocked him. Second of all, Mr. Philip needs to learn that other people are also entitled to their opinions. Thirdly, I think Justice Brandeis would be turning over in his grave if he know what was going on in the college named after him.

Adding To The Confusion Of ObamaCare

CNN posted an article today about how the subsidies paid to ObamaCare subscribers are going to impact their taxes. No one told them this was going to be taxable!

The article reports:

Obamacare enrollees who received subsidies to help pay for coverage will soon have to reconcile how much they actually earned in 2014 with how much they estimated when they applied many, many months ago.

This will likely lead to some very unhappy Americans. Those who underestimated their income either will receive smaller tax refunds or will owe the IRS money.

That’s because subsidies are actually tax credits and are based on annual income, but folks got their 2014 subsidy before knowing exactly what they’d make in 2014. So you’ll have to reconcile the two with the IRS during the upcoming tax filing season.

Filing taxes has never been any fun–ObamaCare just made it worse.

Subsidies were what kept the cost of ObamaCare down for subscribers:

We’re not talking chump change. Those who applied through the federal exchange received an average monthly subsidy of $264, according to the most recent figures reported by the Obama administration. They only had to pay $82 a month, on average, for coverage, Roughly 85% of total enrollees received help with insurance premiums. The administration last month said 2014 enrollment was 6.7 million.

Those who underestimated their earnings could owe thousands of dollars, though there is a $2,500 cap for those who remain eligible for subsidies. The threshold for eligibility is based on income – $45,900 for an individual and $94,200 for a family in 2014.

In June, the Supreme Court is expected to rule on whether or not subsidies can be given in states that did not create healthcare exchanges. If the ruling says no, we can expect total chaos in the healthcare sector of the economy while everyone regroups. Meanwhile, the taxman cometh!

Did The Election Of 2014 Mean Anything?

We are about to find out if the election of 2014 meant anything at all in Washington, D.C. The election was a resounding victory for Republicans at all levels of government. It was also an expression of voter dissatisfaction with the current status quo.

Brietbart.com posted an article today pointing out that it would only take 29 conservatives to unseat John Boehner as Speaker of the House. Recent polls have shown that as many as 60 percent of Republicans would like to see John Boehner replaced as Speaker of the House.

The article reports:

At this critical juncture, the few dozen conservatives in the House have two options.

They can allow themselves and the 2014 electorate to remain disenfranchised, helplessly standing by while Boehner passes crucial legislation on amnesty, budget bills, Obamacare, and debt ceiling increases with Democrat support. Or they can seize control of their own destiny by using the first vote of this Congress – the only vote for which Boehner cannot rely on Democrat support – to veto the Speaker himself and preempt a disastrous two years of lawmaking.

Despite misinformation some Republican members and incoming freshmen have given constituents, the selection of John Boehner for Speaker, unlike the election of the other party leaders, has not been cemented. And in fact, on Tuesday, if every Republican who claims to be frustrated and even appalled by Boehner’s behavior would vote for any other name, they can deny him reelection as Speaker.

The article concludes:

By joining together and organizing a move to deny Boehner the majority, these 29 conservatives can create such an opportunity. This would force a second or third ballot and Republicans would have to reconvene a conference. They would finally be compelled to negotiate with conservatives who would only agree to give their votes for someone who commits to certain fundamental principles and ironclad concessions.

Although this is arguably not a perfect plan, as these members stand before their constituents and gratuitously utter the words “John Boehner,” they will have sealed their own fate for the next two years because they have offered no alternative plan to reestablish a modicum of conservative control over the conservative party. Those self-described conservatives who are reluctant to join this effort have an obligation to put forth other ideas for reestablishing a voice within the party.

On Tuesday, choose wisely and fear no man.

If the Democrats and the Republicans are ignoring the will of the American people, it is time to replace them both.

Proof The Laffer Curve Works

On Wednesday, CBN News reported that France was ending its super tax on millionaires.

The article reports:

Socialist President Francois Hollande proposed a tax of up to 75 percent on people earning above 1 million euros a year, equal to about $1.2 million a year in the United States.

One critic of the super-tax said it makes France “Cuba without the sun.”

Many wealthy French citizens fled the country to avoid paying the super tax, including actor Gerard Depardieu, who became a Russian citizen.

Because millionaires left the country or found tax shelters, the excessive tax did not generate nearly the amount of money that politicians predicted it would.

What is at play here is the Laffer Curve.

On April 15, 2012, Forbes Magazine posted a graph of the Laffer Curve:

Contrary to what you may have heard, people are not stupid. If it becomes obvious that the harder they work the more will be taken from them, they will not work as hard. There is a point where excessive taxation does not reap positive rewards. Congress  needs to remember this. It didn’t work in France, and it won’t work in America.

Dr. Roy Spencer’s Top 10 Climate Discoveries of 2014

This comes from drroyspencer.com, the website of Dr. Roy Spencer:

Top 10 lists are popular this time of year, so I gave in to the peer pressure. Here’s my Top 10 list of totally true climate stories of 2014. Kind of like that movie “Fargo”, which was not “based on a true story”, but was a totally “true story”.

10. Weather did not even occur before Henry Ford automated the production of the automobile. No, really, look it up.

9. Climate modelers discovered that the Earth is not warming nearly as fast as their models predicted. A multi-billion dollar effort is now underway to make the climate system warm even faster.

8. The Koch Brothers were discovered to be extraterrestrials out to destroy the Earth. If you haven’t heard that yet…you are one of the stupid people who were deemed to be not trustworthy enough with the information.

7. Global sea ice reached a near record maximum, due to a bust-gut effort by Exxon-Mobil which has been making ice cubes in China and shipping them to the poles.

6. Global warming causes cooling. This had always been expected, but it was finally proved by two French literature graduates who Googled it.

5. It’s Bush’s fault.

4. A viable replacement for fossil fuels was finally discovered: Solar Freakin’ Roadways. (If solar panels tilted toward the sun and kept clean are a good idea, then putting them on the ground and running over them with 10-ton trucks is even better!)

3. Ninety-seven percent of climate scientists surveyed agreed that if the global warming issue (and their government funding) went away, their careers would end.

2. The 420th U.N. climate meeting in Lima, Peru, was finally made carbon-neutral with jet travel fueled by methane gathered from unicorn herds, and carbon offsets purchased from Al Gore which will go toward planting of 5.3 billion trees which never die.

1. Carbon dioxide (necessary for life on Earth) was discovered to be different from carbon monoxide (a poisonous gas). The full implications of this finding are still being investigated, but are not expected to interfere with continuing plans to increase energy prices and keep Third World people from becoming First World.

Happy New Year!

Whoops!

Yesterday, Newsbusters posted an article about the recent scandal involving House majority whip Steve Scalise.

The article reports:

Drat! Foiled again!

That is going to be the feeling of much of the mainstream media which has been incessantly pushing the narrative about House majority whip Steve Scalise supposedly speaking at a David Duke sponsored white supremacist event in 2002. It turns out that it never happened. Instead he spoke at a local neighborhood association. And who discovered this vital information? A very unexpected source, the liberal Slate.

The mix-up had something to do with Representative Scalise speaking at a different event in a small conference room in the same hotel as the event in question was held.

Kenny Knight, a longtime associate of David Duke, the former Grand Wizard of the Ku Klux Klan explains the confusion:

Knight invited then–state Rep. Scalise as well as a representative from the Jefferson Parish Sheriff’s Office and a person from the American Red Cross to speak to the civic association at the hotel. Knight said he thinks the Red Cross speaker was from a local chapter but didn’t remember specifically. He also said he didn’t remember the names of either of the other speakers. The representative from the sheriff’s department spoke to attendees about a neighborhood watch program, and the person from the Red Cross discussed CPR techniques. Scalise also spoke.

 Whoops!

An Attempt At Lopsided Justice

MyWay News reported yesterday that Palestinian President Mahmoud Abbas is seeking Palestinian admission to the International Criminal Court. The intention is for Palestine to charge Israel with war crimes.

The article reports:

Abbas made the announcement in the West Bank on Wednesday, a day after the U.N. Security Council failed to pass a resolution that had aimed to set a deadline for Israel to end its occupation of territories sought by the Palestinians.

Abbas had warned that if the resolution failed, he would resume a Palestinian campaign to join international organizations to put pressure on Israel.

Abbas’ decision is expected to trigger a harsh response from Israel.

Israel says all disputes should be resolved through peace talks, and such actions are aimed at bypassing negotiations.

This is a very interesting move.

This is a chart showing rocket attacks on Israel from the Gaza Strip since 2001. It is from the Israeli Defense Forces blog:

graph

The fact that the originators of these rocket attacks on civilian targets want to charge Israel with war crimes would be laughable except that the International Criminal Court is so anti-Semitic the charges would probably be taken seriously.

As the Palestinians seek to charge Israel with war crimes, we might also remember the tunnels discovered in their recent war with Israel. In July 2014, I reported (rightwinggranny.com) that the Palestinians plan to use the tunnels to hide until schools and kindergartens were occupied. The terrorists would then attempt to kill the children first, and then kill and kidnap as many Israelis as possible.  This plot was set to take place during Jewish New Year, on September 24.

Israel is not the one who should be charged with war crimes.
