The Truth Continues To Seep Out

Yesterday The American Center for Law and Justice (ACLJ) posted the following on its website:

The ACLJ has just obtained previously unreleased documents related to the Clinton investigation and immunity agreements given to top Clinton aids. These agreements reveal that James Comey’s Federal Bureau of Investigation (FBI) and Loretta Lynch’s Department of Justice (DOJ) granted immunity to Hillary Clinton’s aids and lawyers, Cheryl Mills and Heather Samuelson, from prosecution for anything found on their laptops violating multiple felony criminal statutes governing the mishandling of classified information and/or the removal or destruction of records, including Espionage Act provisions. Further, the DOJ and FBI also agreed to evade the statutory requirements of the Freedom of Information Act (FOIA) by purporting to deem the contents of the laptops as not under DOJ or FBI “custody or control.”

These laptops were critical to any meaningful investigation of Hillary Clinton’s handling of classified emails and records. According to the DOJ Inspector General, who identified these as the “culling laptops,” “[a]ll 62,320 emails pulled from the Clinton servers were stored at one time on these laptops.” Having taken control of these laptops, agreeing to severely limit its searches, agreeing to unlawfully shield the laptops from FOIA, then agreeing to dispose of the laptops, it appears the Comey FBI and Lynch DOJ did everything in their power to protect Clinton’s senior aids and lawyers from both criminal liability and public scrutiny.

While these immunity agreements and related news have been publicly discussed to some extent, the ACLJ has now obtained the actual documents so the public may see and judge them accordingly.

According to the DOJ’s immunity agreement with Mills:

As we have advised you, we consider Cheryl Mills to be a witness based on the information gathered to date in this investigation. We understand that Cheryl Mills is willing to voluntarily provide the Mills Laptop to the Federal Bureau of Investigation, if the United States agrees not to use any information directly obtained from the Mills Laptop in any prosecution of Cheryl Mills for the mishandling of classified information and/or the removal or destruction of records as described below.

And, according to the immunity agreement:

To that end, it is hereby agreed as follows:

    1. That, subject to the terms of consent set forth in a separate letter to the Department of Justice dated June 10, 2016, Cheryl Mills will voluntarily produce the Mills Laptop to the Federal Bureau of Investigation for its review and analysis.
    2. That no information directly obtained from the Mills Laptop will be used against your client in any prosecution under 18 U.S.C. § 793(e) and/or (f); 18 U.S.C. § 1924; and/or 18 U.S.C. § 2071.
    1. That no other promises, agreements, or understandings exist between the parties except as set forth in this agreement, and no modification of this agreement shall have effect unless executed in writing by the parties.

The agreement was then executed by Cheryl Mills. The immunity agreement with Samuelson reads the same.

Mills and Samuelson Were Granted Immunity From Prosecution Under Multiple Felony Statutes for Anything Found on Their Laptops.

Not Sure What Happens Next

A lot of the things we are currently hearing in the news regarding FISA Warrants, Russian collusion, etc., would never have been revealed had Hillary Clinton been elected. That in itself is a little disconcerting. One group that has worked very hard to get to the bottom of the numerous scandals surrounding the Clintons has been Judicial Watch. They are non-partisan–they have gone after previous administrations just as hard as they are going after the Obama administration. It seems as if they may be getting to a point where Americans may actually know what went on in the Obama administration Justice Department.

The Gateway Pundit reported the following today:

Conservative watchdog group Judicial Watch announced Wednesday a schedule of depositions of senior Obama-era officials, lawyers and former Hillary Clinton aides.

Thanks to the heavy lifting by Judicial Watch, Judge Royce C. Lamberth ordered these corrupt Obama and Hillary officials to provide answers, under oath, to the watchdog group about the Benghazi and Hillary Clinton email scandals.

Recall, Judge Lamberth previously slammed Hillary’s corruption and said the State Department provided ‘clearly false’ statements to derail requests for Hillary Clinton documents.

Judge Lamberth, a Reagan appointee, said he was “dumbfounded” when he found out that Hillary’s aide-turned-lawyer Cheryl Mills was given immunity.

“I had myself found that Cheryl Mills had committed perjury and lied under oath in a published opinion I had issued in a Judicial Watch case where I found her unworthy of belief, and I was quite shocked to find out she had been given immunity in — by the Justice Department in the Hillary Clinton email case,” Lamberth said during a hearing last October.

Will We Ever See Justice?

Townhall is reporting the following today:

U.S. District Court Judge Emmet G. Sullivan ruled on Thursday that former Secretary of State Hillary Clinton has 30 days to answer additional questions about her email scandal. The decision comes after Judicial Watch filed a lawsuit to obtain additional information from Clinton and Director of Information Resource Management of the Executive Secretariat John Bentel. The watchdog group also wanted top Clinton aides and State Department officials, including Huma Abedin and Cheryl Mills’, deposition videos made public.

These are the two questions Mrs. Clinton will be required to answer:

1. Describe the creation of the clintonemail.com system, including who decided to create the system, the date it was decided to create the system, why it was created, who set it up, and when it became operational.

2. During your October 22, 2015 appearance before the U.S. House of Representatives Select Committee on Benghazi, you testified that 90 to 95 percent of your emails “were in the State’s system” and “if they wanted to see them, they would certainly have been able to do so.” Identify the basis for this statement, including all facts on which you relied in support of the statement, how and when you became aware of these facts, and, if you were made aware of these facts by or through another person, identify the person who made you aware of these facts.

The treatment of Mrs. Clinton flies in the face of equal justice under the law. As anyone who has ever held a security clearance knows, you have to sign a paper saying that you understand the rules for handling classified material and that you will follow them. I don’t know if Mrs. Clinton signed that paper. I do know that she chose not to follow the rules about handling classified material. There should be some penalty for that behavior.

The Truth Is Still Leaking Out

Yesterday Fox News posted an article about the cover-up by the State Department of both information surrounding Hillary Clinton’s private server and information regarding the attack at Benghazi.

The article reports:

In a combative exchange at a hearing Friday in Washington, D.C., a federal judge unabashedly accused career State Department officials of lying and signing “clearly false” affidavits to derail a series of lawsuits seeking information about former Secretary of State Hillary Clinton’s private email server and her handling of the 2012 terrorist attack on the U.S. Consulate in Benghazi, Libya.

U.S. District Court Judge Royce Lamberth also said he was “shocked” and “dumbfounded” when he learned that FBI had granted immunity to former Clinton chief of staff Cheryl Mills during its investigation into the use of Clinton’s server, according to a court transcript of his remarks.

“I had myself found that Cheryl Mills had committed perjury and lied under oath in a published opinion I had issued in a Judicial Watch case where I found her unworthy of belief, and I was quite shocked to find out she had been given immunity in — by the Justice Department in the Hillary Clinton email case,” Lamberth said during the hearing.

The Department of Justice’s Inspector General (IG), Michael Horowitz, noted in a bombshell report in June that it was “inconsistent with typical investigative strategy” for the FBI to allow Mills to sit in during the agency’s interview of Clinton during the email probe, given that classified information traveled through Mills’ personal email account. “[T]here are serious potential ramifications when one witness attends another witness’ interview,” the IG wrote.

The article notes that the Judge did not know that Cheryl Mills had been granted immunity.

The article continues:

The transparency group Judicial Watch initially sued the State Department in 2014, seeking information about the response to the Benghazi attack after the government didn’t respond to a Freedom of Information Act (FOIA) request. Other parallel lawsuits by Judicial Watch are probing issues like Clinton’s server, whose existence was revealed during the course of the litigation.

The State Department had immediately moved to dismiss Judicial Watch’s first lawsuit on a motion for summary judgment, saying in an affidavit that it had conducted a search of all potentially relevant emails in its possession and provided them. The affidavit noted that some more documents and emails could be forthcoming.

But Lamberth denied the request to dismiss the lawsuit at the time — and on Friday, he said he was happy he did, charging that State Department officials had intentionally misled him because other key documents, including those on Clinton’s email server, had not in fact been produced.

“It was clear to me that at the time that I ruled initially, that false statements were made to me by career State Department officials, and it became more clear through discovery that the information that I was provided was clearly false regarding the adequacy of the search and this – what we now know turned out to be the Secretary’s email system,” Lamberth said Friday.

The Questions I Haven’t Heard The Media Ask

Scott Johnson at Power Line posted an article today that included a portion of a Wall Street Journal article by Kimberley Strassel. The article at The Wall Street Journal is behind the subscriber wall, so I am not linking to it.

Kimberley Strassel listed a number of questions she would like to hear James Comey answer.

Power Line listed six of these questions:

  • You admit the Christopher Steele dossier was still “unverified” when the FBI used it as the basis of a surveillance warrant against Carter Page. Please explain. Also explain the decision to withhold from the Foreign Intelligence Surveillance Court that the dossier was financed by the Hillary Clinton campaign.
  • You say you knew the dossier was funded by a “Democrat-aligned” group but that you “never knew” which one. Why not? Didn’t the FBI have a duty to find out?
  • Please explain the extraordinary accommodations the FBI provided Team Clinton during the email investigation. Why was Cheryl Mills —whose emails suggest she had early knowledge of the irregular server as Mrs. Clinton’s chief of staff—allowed to claim attorney-client privilege and represent Mrs. Clinton at her interview? Why did that interview happen only at the end? Especially since you say any case hung entirely on her “intent”?
  • You’ve surely now read the texts between the FBI’s Peter Strzok and Lisa Page. That happened on your watch. Is this appropriate FBI behavior? Should we believe such behavior is limited to them? In addition to overt political bias, the texts prove the FBI took politics into account—worrying, for instance, about how much manpower to put into investigating the woman who could be our “next president.” Why should the public have any faith in the integrity of the Clinton or Trump investigation?
  • The texts ridicule former Attorney General Loretta Lynch’s decision to step aside from the Clinton probe, “since she knows no charges will be brought.” This was before the FBI even interviewed Mrs. Clinton. And it contradicts your claim at the start of your July 2016 press conference that no one at the Justice Department knew what you were about to say. Please explain.
  • You dismiss Deputy Attorney General Rod Rosenstein’s memo as nothing but a “pretext” to fire you. Yet you don’t address its claims. Please point to the internal policies or regulations that gave you the authority to announce that Mrs. Clinton was being cleared and why. Please provide any examples of similar announcements by FBI directors. Please address the criticisms of the prior attorneys general and deputy attorneys general from both parties cited in the Rosenstein memo.

Works for me.

 

If This Is Not Illegal, It Should Be

Anyone who follows the news closely (assuming they don’t depend on the mainstream media as their news source) is aware that the Clinton Foundation is a personal cash cow for the Clinton family. A number of sources that have investigated the Foundation have observed that between 8 and 10 cents of every dollar goes to help whatever cause is being helped. The other 90 to 92 cents goes to ‘overhead.’ It would be very interesting to see a dollar by dollar breakdown of that ‘overhead.’ Meanwhile, the concept of ‘pay for play’ keeps rearing its ugly head.

The Washington Examiner posted a story today about communication between the Clinton Foundation and the U.S. State Department during the time that Hillary Clinton was Secretary of State.

The article reports:

Call logs from the office of Cheryl Mills, Hillary Clinton’s chief of staff at the State Department, show Mills had frequent contact with top executives at the Clinton Foundation.

The logs, which were obtained by Citizens United through the Freedom of Information Act, indicate the foundation’s chief operating officer, Laura Graham, called Mills often to discuss State Department business.

For example, Graham called Mills in February of 2012 to deliver a message relevant to the chief of staff’s upcoming meeting with an unidentified prime minister. The previous month, she had contacted Mills regarding “sensitive” issues that included Haiti relief.

Mills was also in contact with Stephanie Streett, executive director of the Clinton Foundation, the records show.

That’s just a little too cozy for me. It makes me wonder exactly who was influencing American foreign policy.

 

 

 

Anatomy Of A Scandal

Bloomberg.com posted a story yesterday about more private Clinton emails that we won’t get to see until after the election. However, some of the emails of Mrs. Clinton’s staff have made their way into the public eye, and they are very revealing.

Bloomberg reports:

Newly released e-mails from a top aide to Hillary Clinton show evidence of contacts between Clinton’s State Department and donors to her family foundation and political campaigns.

The e-mails released Tuesday by the conservative group Judicial Watch included a 2009 exchange in which Doug Band, a senior staff member at the Clinton Foundation, told a top Clinton aide at the State Department that it was “important to take care of” an individual, whose name was redacted.

Huma Abedin, the State Department aide, replied that “personnel has been sending him options.”

…In another 2009 exchange released Tuesday, Band asked Abedin and Cheryl Mills, Clinton’s chief of staff, to put Lebanese-Nigerian billionaire Gilbert Chagoury in touch with a State Department “substance person” on Lebanon. The Chagoury Group co-founder has given between $1 million and $5 million to the Clinton Foundation, according to a list of donors posted online.

…Judicial Watch said it has now found 171 messages that weren’t included in the 30,000 e-mails Clinton turned over to the State Department. FBI Director James Comey has said that his agency found “several thousand” work-related e-mails that weren’t turned over by Clinton’s lawyers. Clinton has told the State Department she believes she submitted all work-related e-mails she had in her possession, the department’s Trudeau said in a statement.

Under President Obama (and under President Clinton, if she is elected) there is one set of rules for the politically connected and another set of rules for the rest of us. This story should disturb all of us, regardless of our political inclinations. It is no wonder that the rest of Mrs. Clinton’s emails will not be released until after the election. At that point, “What difference does it make?”

 

Closer To The Truth

The Daily Caller posted an article today about the ongoing quest for Hillary Clinton’s emails.

The article reports:

A federal judge has ordered Hillary Clinton and two of her top aides at the State Department, Huma Abedin and Cheryl Mills, to attest, under penalty of perjury, that they have turned over all official government records in their possession.

…In his ruling, Sullivan (U.S. District Court judge Emmett Sullivan) ordered the Staet Department to “identify any and all servers, accounts, hard drives, or other devices currently in the possession or control of the State Department or otherwise that may contain responsive information.”

The State Department must also request that Clinton, Abedin and Mills “confirm, under penalty of perjury, that they have produced all responsive information that was or is in their possession as a result of their employment at the State Department.”

“If all such information has not yet been produced, the Government shall request the above named individuals produce the information forthwith,” Sullivan ruled.

The State Department must also require the trio “describe, under penalty of perjury, the extent to which Ms. Abedin and Ms. Mills used Mrs. Clinton’s email server to conduct official government business.”

The use of a private email server was illegal. It also posed a security risk because the private server did not have the anti-hacking software that would have been on the government server. It would probably be easier to ask the Chinese to give us everything that was on Mrs. Clinton’s server. Chances are that they have it.
