{"id":57617,"date":"2024-12-12T08:57:28","date_gmt":"2024-12-12T13:57:28","guid":{"rendered":"https:\/\/www.rightwinggranny.com\/?p=57617"},"modified":"2024-12-12T08:57:28","modified_gmt":"2024-12-12T13:57:28","slug":"getting-back-to-where-we-started","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=57617","title":{"rendered":"Getting Back To Where We Started"},"content":{"rendered":"<p>On Wednesday, <a href=\"https:\/\/thefederalist.com\/2024\/12\/11\/how-doge-can-tackle-the-national-debt-by-returning-to-constitutional-spending\/\" target=\"_blank\" rel=\"noopener\">The Federalist<\/a> posted an article by John Eastman talking about how we can get government spending under control.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 40px;\"><strong>President Donald Trump is determined to tame the bloated bureaucracy beast. To that end, he has appointed, in spectacular fashion, Elon Musk and Vivek Ramaswamy to head up a new \u201cDepartment of Government Efficiency\u201d (\u201cDOGE\u201d). In their pathbreaking <a href=\"https:\/\/www.wsj.com\/opinion\/musk-and-ramaswamy-the-doge-plan-to-reform-government-supreme-court-guidance-end-executive-power-grab-fa51c020?page=2\" target=\"_blank\" rel=\"noreferrer noopener\">op-ed<\/a> in The Wall Street Journal on Nov. 20, Musk and Ramaswamy laid out their mission: \u201cWe won\u2019t just write reports or cut ribbons, We\u2019ll cut costs.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>With the nation now <a href=\"https:\/\/fiscaldata.treasury.gov\/datasets\/debt-to-the-penny\/debt-to-the-penny\" target=\"_blank\" rel=\"noreferrer noopener\">$36 <em>trillion <\/em>in debt<\/a> \u2014 or about $100,000 for every man, woman, and child in America \u2014 that mission is long overdue. But judging from the hyperbolic reaction even the mention of budget cuts has generated in the deep state and among its sycophants in the corporate media, Musk and Ramaswamy will face enormous headwinds.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>One of those will undoubtedly be the <a href=\"https:\/\/www.congress.gov\/bill\/93rd-congress\/house-bill\/7130\" target=\"_blank\" rel=\"noreferrer noopener\">Congressional Budget and Impoundment Control Act of 1974<\/a>. Enacted in the wake of President Richard Nixon\u2019s attempt to \u201cdrain the swamp\u201d a half century ago, the act requires the president to seek and obtain Congress\u2019s approval before declining to spend appropriated funds \u2014 which kinda defeats the purpose of impounding excessive spending that Congress itself enacted. Section 1012 of the act voids any presidential rescission of funding unless Congress votes on a rescission bill within 45 days of being notified of the president\u2019s intent to rescind funds.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Because several court decisions dating back to the 1970s and 1980s ordered presidents to spend appropriated funds unless Congress approved of the impoundment \u2014 rejecting claims that the act unconstitutionally intruded on the president\u2019s authority \u2014 one might be tempted to think that the act is more like a brick wall than a headwind for DOGE\u2019s mission. But that would be wrong. None of those cases addressed the key constitutional issue, namely, whether the president could refuse to expend funds that exceeded Congress\u2019s authority under the \u201cspending power,\u201d as that power was originally conceived.<\/strong><\/p>\n<p>The article notes that eliminating spending that serves local interests but not national interests would help.<\/p>\n<p>There is a story about Senator Davy Crockett and something he learned about welfare payments from the government during his time in office.
