Election fraud is not a new thing. There were some real questions in 1960 as to whether or not John Kennedy won Illinois–Chicago just kept those votes coming. However, we are somewhat more sophisticated now, so we do better most of the time.<\/p>\n
On Friday, PJ Media<\/a> posted an article about a recent decision by the Fifth Circuit Court<\/a>.<\/p>\n The article reports:<\/p>\n On Oct. 25, the Fifth Circuit Court ruling<\/a> in Republican National Committee v. Wetzel<\/em> reversed a former judgment and affirmed that Mississippi\u2019s statute allowing the state to receive ballots up to five days after federal Election Day is not consistent with the Constitution or federal law. It is not even consistent with Mississippi\u2019s own law, the ruling states! Indeed, the ruling is a hopeful sign coming just after the discouraging news that a Biden-appointed judge ordered<\/a> Virginia to reinstate non-citizens on voter rolls. The fight for election integrity is challenging but most certainly not doomed.<\/strong><\/p>\n \u201cCongress statutorily designated a singular \u2018day for the election\u2019 of members of Congress and the appointment of presidential electors. Text, precedent, and historical practice confirm this \u2018day for the election\u2019 is the day by which ballots must be both cast by voters and received by state officials,\u201d the ruling announces. \u201cBecause Mississippi\u2019s statute allows ballot receipt up to five days after the federal election day, it is preempted by federal law. We reverse the district court\u2019s contrary judgment and remand for further proceedings.\u201d<\/strong><\/p>\n A ballot is \u201ccast,\u201d the ruling explains, \u201cwhen the State takes custody of it.\u201d While ballots might be counted after Election Day, \u201cthe result is fixed when all of the ballots are received and the proverbial ballot box is closed,\u201d namely Election Day. Thus \u201cthe election concludes when the final ballots are received and the electorate<\/em>, not the individual selector<\/em>, has chosen.\u201d<\/strong><\/p>\n The article concludes:<\/p>\n As noted above, the ruling also explains why the state must in fact receive ballots by Election Day for them to be considered validly cast. If only more courts and judges based their decisions on what the Constitution says, not on whatever political pressures leftist radicals are currently bringing to bear.<\/strong><\/p>\n Hopefully, this ruling will secure elections not just in Mississippi, but provide a legal basis for securing elections in other states too.<\/strong><\/p>\n We all need to be working toward honest elections!<\/p>\n","protected":false},"excerpt":{"rendered":" Election fraud is not a new thing.
