On Friday, The Epoch Times<\/a> posted an article about the killing of Ashli Babbitt on January 6th, 2021.<\/p>\n

The article reports:<\/p>\n

Within a minute after firing the fatal bullet that struck Ashli Babbitt on Jan. 6, 2021, U.S. Capitol Police Lt. Michael Byrd broadcast a radio report claiming shots were being fired at him in the Speaker\u2019s Lobby and he was \u201cprepared to fire back,\u201d a federal lawsuit alleges.<\/strong><\/p>\n

The previously undisclosed radio dispatch is also contained on an audio recording obtained exclusively by The Epoch Times of the \u201cOPS2\u201d dispatch channel used by Capitol Police on Jan. 6.<\/strong><\/p>\n

Information on the recording is contained in a federal lawsuit<\/a> filed on Jan. 5 by Ms. Babbitt\u2019s widower, Aaron Babbitt of San Diego. Mr. Babbitt, backed in his lawsuit by Judicial Watch,<\/a> is seeking $30 million from the U. S. government for wrongful death.<\/strong><\/div>\n

According to the lawsuit, Mr. Byrd fired his Glock 22 .40-caliber pistol, striking Ms. Babbitt in the left shoulder, then announced that he was being fired upon and was ready to return fire.<\/strong><\/p>\n

\u201cIn fact, no shots were fired at Lt. Byrd or his fellow officers,\u201d the lawsuit stated. \u201cThe only shot fired was the single shot Lt. Byrd fired at Ashli. He heard the loud noise of the gunshot. He saw her fall backward from the window frame.\u201d<\/strong><\/p>\n

The article also notes:<\/p>\n

The DOJ report absolving Mr. Byrd from culpability included numerous errors and incorrect statements.<\/strong><\/div>\n

The report says that after the glass in the doors leading to the Speaker\u2019s Lobby was smashed out, rioters \u201cwere then able to reach through the broken glass and push the chairs off the top of the barricaded furniture.\u201d<\/strong><\/p>\n

Video shot from the hallway does not show anyone toppling chairs from the makeshift barricade, either before or after Ms. Babbitt was shot.<\/strong><\/p>\n

The report quotes Jason Gandolph of the House Sergeant at Arms office saying he and several Capitol Police officers \u201cattempted to keep the demonstrators from advancing toward the Speaker\u2019s Lobby after the Capitol was breached.\u201d<\/strong><\/p>\n
