On Tuesday, The Conservative Treehouse<\/a> posted an article about the decision by the Colorado Supreme Court to keep President Trump off of the Republican primary election ballot.<\/p>\n

These are the three main problems with the decision listed in the article:<\/p>\n

#1)\u00a0 It was a 4-3 decision. Meaning it was the politics of the court, literally the political makeup and perspective therein, that determined the outcome of the decision.\u00a0 This is showcased in point #3, which is the funniest part.<\/strong><\/p>\n

#2)\u00a0 The entire framework of the case against Trump in the Colorado decision is predicated on this: \u201c[the complainants] asserted that he was ineligible under Section Three because he engaged in insurrection on January 6, 2021, after swearing an oath as President to support the U.S. Constitution.<\/em>\u201d\u00a0 [pdf, page 6<\/a>]\u00a0\u00a0REMINDER\u00a0\u2013 President Donald Trump was not charged with \u201cinsurrection,\u201d is not accused of \u201cinsurrection,\u201d does not fit the complaint under the definitions of \u201cinsurrection,\u201d and has never been found guilty of insurrection.\u00a0 The complaint is moot before the court.\u00a0 But hey,\u00a0it\u2019s Lawfare\u2026 and we all know Lawfare is created for public media consumption, so that takes us directly to the biggest point.<\/strong><\/p>\n

As long as President Trump appeals the ruling, he can be on the ballot, so what’s the point?<\/p>\n
