House Judiciary Chairman\u00a0Jim Jordan<\/a>\u00a0(R-OH) announced on Tuesday that he subpoenaed Attorney General\u00a0Merrick Garland<\/a>\u00a0for information on alleged efforts to surveil members of Congress and congressional staff \u2014 including during the Russiagate controversy that rocked former President Donald Trump\u2019s 2016 campaign and administration.<\/strong><\/p>\n

In a\u00a0cover letter<\/a>\u00a0to Garland, which noted potential legislative reforms could follow, Jordan said his panel \u201cmust resort to compulsory process\u201d because of the \u201cinadequate response to date\u201d by the Department of Justice (DOJ) following his\u00a0request<\/a>\u00a0for details about the apparent use of subpoenas to obtain private communications of Legislative Branch employees.<\/strong><\/p>\n

The DOJ previously informed the committee that the legal process it used related to an investigation into the \u201cunauthorized disclosure of classified information in a national media publication,\u201d the letter said. Jordan cited\u00a0news reporting<\/a>\u00a0that indicated the inquiry pertained to the Foreign Intelligence Surveillance Act (FISA) surveillance of one-time Trump campaign associate Carter Page, reliant on an effort to get FISA warrants that\u00a0the DOJ inspector general\u00a0heavily criticized<\/a>\u00a0and the DOJ itself later conceded had relied on\u00a0\u201cinsufficient predication\u201d<\/a>\u00a0to last as long as it did.<\/strong><\/p>\n

The Executive Branch appears to have used its \u201cimmense law-enforcement authority to gather and search the private communications of multiple Legislative Branch employees who were conducting Constitutional oversight of the Department\u2019s investigative actions \u2014 actions that were later found to be unlawful,\u201d Jordan wrote.<\/strong><\/p>\n

\u201cBecause the Department has not complied in full with our requests, we cannot independently determine whether the Department sought to alleviate the heightened separation-of-powers sensitivities involved or whether the Department first sought the information through other means before resorting to legal process,\u201d Jordan added. \u201cThe Committee also has concerns that aspects of the Department\u2019s investigation may have been a pretext to justify piercing the Legislative Branch\u2019s deliberative process and improperly access data from Members and staff involved in conducting oversight of the Department.\u201d<\/strong><\/p>\n
