{"id":51594,"date":"2023-08-16T09:57:46","date_gmt":"2023-08-16T13:57:46","guid":{"rendered":"https:\/\/www.rightwinggranny.com\/?p=51594"},"modified":"2023-08-16T09:57:46","modified_gmt":"2023-08-16T13:57:46","slug":"when-judges-get-it-right","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=51594","title":{"rendered":"When Judges Get It Right"},"content":{"rendered":"<p>On Tuesday, <a href=\"https:\/\/www.bizpacreview.com\/2023\/08\/15\/federal-appeals-court-says-d-c-selectively-enforced-statute-to-arrest-pro-life-activists-but-not-blm-protesters-1386988\/\" target=\"_blank\" rel=\"noopener\">BizPacReview<\/a> posted an article about a recent decision by the U.S. Court of Appeals for the District of Columbia.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 40px;\"><strong>A federal appeals court ruled 3-0 Tuesday that the Washington D.C. \u201cselectively\u201d used a defacement statute to arrest pro-life activists for chalking a message on the sidewalk while permitting Black Lives Matter (BLM) protestors to mark property without consequences.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>During the summer of 2020, at the same time thousands of BLM protestors were taking to the streets of Washington, D.C. and covering public spaces with paint and chalk, two pro-life activists were <a href=\"https:\/\/dailycaller.com\/2020\/08\/01\/dc-police-pro-life-students-arrest-chalk\/\">arrested<\/a> for chalking the words \u201cBlack Pre-Born Lives Matter\u201don a public sidewalk. The Frederick Douglass Foundation and Students for Life of America, who organized the pro-life protest and filed the lawsuit over the arrests, \u201cplausibly alleged\u201d that the statute\u2019s enforcement was viewpoint discrimination, the U.S. Court of Appeals for the District of Columbia <a href=\"https:\/\/s3.documentcloud.org\/documents\/23909901\/selectiveenforcement.pdf\">found<\/a>.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cThe First Amendment prohibits discrimination on the basis of viewpoint irrespective of the government\u2019s motive,\u201d Circuit Judge Neomi Rao, a Trump appointee, wrote in the opinion for the court. \u201cWe hold the Foundation has plausibly alleged the District discriminated on the basis of viewpoint in the selective enforcement of its defacement ordinance.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cThe District all but abandoned enforcement of the defacement ordinance during the Black Lives Matter protests, creating a de facto categorical exemption for individuals who marked \u2018Black Lives Matter\u2019 messages on public and private property,\u201d the ruling states.<\/strong><\/p>\n<p>Seems like some of the January 6th protesters should seek equal treatment with the rioters of the summer of 2020.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Tuesday, BizPacReview posted an article about a recent decision by the U.S. Court of Appeals for the District of Columbia.
