The article provides insight into what lengths one political party will go to in order to retain power.<\/p>\n<p>The article states:<\/p>\n<p style=\"padding-left: 40px;\"><strong>Below is my column in The Hill on the continued calls to disqualify Republican members of Congress to prevent them from running for reelection. What is maddening is that Democratic groups and <a href=\"https:\/\/jonathanturley.org\/2021\/01\/08\/washington-post-columnist-calls-for-expulsion-of-members-who-challenged-electoral-votes\/\">commentators<\/a> are seeking to remove as many as 120 Republicans from the ballots in the name of democracy. It is like burning books in the name of literacy. Yet, on this anniversary of the January 6th riot, members of Congress and Democratic groups want to block voters from reelecting their preferred representatives. <a href=\"https:\/\/www.quora.com\/What-was-the-reasoning-behind-the-Vietnam-War-saying-kill-a-village-to-save-a-village\">Like villages in Vietnam<\/a>, it appears that some members and activists believe that you have to destroy democracy to save it from itself.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>&#8230;This week, Democratic lawyer <a class=\"rollover-people-link\" href=\"https:\/\/thehill.com\/person\/marc-elias\">Marc Elias<\/a>\u00a0<a href=\"https:\/\/twitter.com\/marceelias\/status\/1473118873302056961?s=21\" target=\"_blank\" rel=\"noopener noreferrer\">predicted<\/a> that 2022 would bring a renewed interest in disqualifying Republican members from office based on an obscure Civil War-era provision. Elias \u2014 the former Hilary Clinton campaign general counsel \u2014 is a <a href=\"https:\/\/jonathanturley.org\/2021\/08\/23\/clinton-lawyer-featured-in-steele-dossier-scandal-opens-firm-with-focus-on-ethics-and-campaign-disclosures\/\" target=\"_blank\" rel=\"noopener noreferrer\">well-known figure in Washington<\/a> who has been <a href=\"https:\/\/jonathanturley.org\/2021\/11\/09\/durham-exposes-new-links-to-clinton-campaign-in-creation-of-russian-collusion-scandal\/\">prominently featured in the ongoing investigation of Special Counsel John Durham<\/a>. Elias has founded a <a href=\"https:\/\/jonathanturley.org\/2021\/10\/19\/what-should-we-be-doing-differentlycnn-conducts-bizarre-interview-with-former-clinton-lawyer-marc-elias-without-not-asking-about-this\/\" target=\"_blank\" rel=\"noopener noreferrer\">self-described \u201cpro-democracy\u201d group<\/a> that challenges Republican voting laws and pledges to \u201c<a href=\"https:\/\/www.democracydocket.com\/about-us\/\" target=\"_blank\" rel=\"noopener noreferrer\">shape our elections and democratic institutions for years to come<\/a>.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>In the age of rage, nothing says democracy like preventing people from running for office.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Elias and others are suggesting that \u2014 rather than defeat Republicans at the polls \u2014 Democrats in Congress could disqualify the Republicans for supporting or encouraging the Jan. 6 \u201cinsurrection.\u201d Last year, Democratic members called for the disqualification of dozens of Republicans. One,\u00a0Rep.\u00a0<span class=\"rollover-people\" data-behavior=\"rolloverpeople\"><a class=\"rollover-people-link\" href=\"https:\/\/thehill.com\/people\/bill-pascrell\" data-nid=\"187936\">Bill Pascrell<\/a><\/span>\u00a0(D-N.J.)\u00a0<a href=\"https:\/\/jonathanturley.org\/2020\/12\/12\/no-friend-of-congress-prascrell-seeks-to-block-120-house-republicans-from-being-seated-in-retaliation-for-signing-supreme-court-amicus-brief\/\" target=\"_blank\" rel=\"noopener noreferrer\">demanded the disqualification of the\u00a0120 House Republicans<\/a>\u00a0\u2014 including House Minority Leader\u00a0<span class=\"rollover-people\" data-behavior=\"rolloverpeople\"><a class=\"rollover-people-link\" href=\"https:\/\/thehill.com\/people\/kevin-mccarthy\" data-nid=\"186556\">Kevin McCarthy<\/a><\/span>(R-Calif.) \u2014 for simply signing a \u201cFriend of the Court brief\u201d (or\u00a0<a href=\"https:\/\/thehill.com\/homenews\/house\/529862-20-more-republicans-including-mccarthy-endorse-texas-challenge-to-biden\" target=\"_blank\" rel=\"noopener noreferrer\">amicus brief<\/a>) in support of an election challenge from Texas.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>These members and activists have latched upon the long-dormant provision in Section 3 of the 14th\u00a0Amendment \u2014 the \u201cdisqualification clause\u201d \u2014 which was written after the\u00a039th Congress convened in December 1865 and many members were shocked to see Alexander Stephens, the Confederate vice president, waiting to take a seat with an array of other former Confederate senators and military officers.<\/strong><\/p>\n<p>The article explains what would happen next if the Democrats attempt this:<\/p>\n<p style=\"padding-left: 40px;\"><strong>The Constitution fortunately demands more than proof by repetition. In this case, it requires an actual rebellion. The clause Democrats are citing was created in reference to a real Civil War in which\u00a0<a href=\"https:\/\/www.nytimes.com\/2012\/04\/03\/science\/civil-war-toll-up-by-20-percent-in-new-estimate.html#:~:text=For%20110%20years%2C%20the%20numbers,any%20war%20in%20American%20history.\" target=\"_blank\" rel=\"noopener noreferrer\">over 750,000 people died in combat<\/a>. The confederacy formed a government, an army, a currency, and carried out diplomatic missions.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Conversely, Jan. 6\u00a0was a protest that became a riot.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>That is not meant to diminish the legitimate outrage over the day. It was reprehensible \u2014 but only a \u201crebellion\u201d in the most rhetorical sense.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>More importantly, even if you adopt a dangerously broad definition of \u201cinsurrection\u201d or \u201crebellion,\u201d members of Congress who supported challenging the electoral votes (<a href=\"https:\/\/jonathanturley.org\/2021\/01\/01\/treason-is-a-matter-of-dates-boxer-and-democrats-denounce-republicans-for-the-same-challenge-previously-raised-against-republican-presidents\/\" target=\"_blank\" rel=\"noopener noreferrer\">as Democrats have done in prior years<\/a>) were exercising constitutionally protected speech.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Moreover, the Democrats cannot simply use their razor-thin majority to disqualify opponents willy-nilly. Punishments like\u00a0<a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-5\/clause-2\/\" target=\"_blank\" rel=\"noopener noreferrer\">expulsions take two-thirds votes<\/a>, and any disqualifications can be challenged in the court.<\/strong><\/p>\n<p>It is frightening that this would even be attempted.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On January 6th, Jonathan Turley posted an article about the end game of the Democrats total politicization of the events of January 6, 2021.
