{"id":42568,"date":"2021-07-08T11:47:31","date_gmt":"2021-07-08T15:47:31","guid":{"rendered":"https:\/\/www.rightwinggranny.com\/?p=42568"},"modified":"2021-07-08T11:47:31","modified_gmt":"2021-07-08T15:47:31","slug":"when-our-justice-system-is-unjust","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=42568","title":{"rendered":"When Our Justice System Is Unjust"},"content":{"rendered":"<p><a href=\"https:\/\/www.theepochtimes.com\/appeals-court-upholds-pretrial-detention-of-capitol-breach-suspect-with-possible-implications-for-other-defendants_3892483.html?utm_source=parler\" target=\"_blank\" rel=\"noopener\">The Epoch Times<\/a> posted an article today about the treatment of some of the people who entered the Capitol Building on January 6th.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 40px;\"><strong>A federal appeals court on Wednesday upheld the pretrial detention of a <a href=\"https:\/\/www.theepochtimes.com\/t-capitol-breach\" target=\"_blank\" rel=\"noopener\">Capitol breach<\/a> suspect largely on the basis of his past history of \u201cviolent language\u201d though he did not commit acts of violence, potentially making it harder for other defendants accused in connection with the Jan. 6 incident to secure release ahead of their trials.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The U.S. Court of Appeals for the D.C Circuit on July 7 upheld a lower court ruling ordering the pretrial detention of <a href=\"https:\/\/www.justice.gov\/usao-dc\/defendants\/hale-cusanelli-timothy-louis\" target=\"_blank\" rel=\"noopener\">Timothy Hale-Cusanelli<\/a>, who faces both felony and misdemeanor charges in connection with the Jan. 6 incident, including for allegedly entering a restricted building and disorderly conduct, though he is not accused of committing violent acts.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>In an opinion (<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/09BC4DA852AA035E8525870B004E08BE\/$file\/21-3029-1905268.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>), Judge Robert Wilkins said that the appeals court concluded that the non-violent nature of Hale-Cusanelli\u2019s alleged offenses weighed \u201cjust slightly\u201d in favor of release, as did his lack of criminal history, but that this was outweighed by factors including \u201coverwhelming\u201d evidence against him in the case, as well as a\u00a0\u201cwell-documented history of racist and violent language\u201d and that he \u201chas been generally engaged in hateful conduct, if not necessarily violent conduct.\u201d<\/strong><\/p>\n<p>Note that the Judge considers &#8216;hateful conduct&#8217; a reason to deny the pretrial release request. The man has no criminal history and was not accused of committing violence. He is essentially being held for &#8216;thought crimes.&#8217; Contrast this with the dismissal of the cases against most of the people who were burning down major American cities last summer. Something is very wrong here.<\/p>\n<p>The article concludes:<\/p>\n<p style=\"padding-left: 40px;\"><strong>It is unclear how the district court\u2019s new ruling might affect other Capitol breach defendants, with several dozen remaining in pretrial custody of the more than 535 arrested and charged in connection with the incident.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>It comes as former President Donald Trump on Wednesday <a href=\"https:\/\/www.youtube.com\/watch?v=YZVPJVgtnq4\" target=\"_blank\" rel=\"noopener\">spoke at a press conference<\/a> at his Bedminster golf club in New Jersey, criticizing how Capitol breach defendants were being treated.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cPeople are being treated unbelievably unfairly,\u201d Trump said. \u201cWhen you look at people in prison and nothing happens to Antifa and they burned down cities and killed people,\u201d he said, referring to last summer\u2019s unrest in the wake of the police-custody death of George Floyd.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cThere were no guns at the Capitol,\u201d Trump said, \u201cexcept for the gun that shot Ashli Babbitt,\u201d referring to the military veteran shot and killed by a Capitol police officer during the Jan. 6 incident.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>At the same time, two high-profile conservative legal activists <a href=\"https:\/\/www.theepochtimes.com\/department-of-justice-treats-jan-6-detainees-with-double-standard-conservative-legal-activists_3891357.html\" target=\"_blank\" rel=\"noopener\">are claiming<\/a> the Department of Justice (DOJ) is using a double standard in its treatment of Capitol breach suspects, compared to those who were arrested during last summer\u2019s riots.<\/strong><\/p>\n<p style=\"padding-left: 40px;\">\n","protected":false},"excerpt":{"rendered":"<p>The Epoch Times posted an article today about the treatment of some of the people who entered the Capitol Building on January 6th.
