{"id":41693,"date":"2021-03-28T13:24:01","date_gmt":"2021-03-28T17:24:01","guid":{"rendered":"https:\/\/www.rightwinggranny.com\/?p=41693"},"modified":"2021-03-28T13:24:01","modified_gmt":"2021-03-28T17:24:01","slug":"regaining-our-right-to-the-free-exercise-of-religion","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=41693","title":{"rendered":"Regaining Our Right To The Free Exercise Of Religion"},"content":{"rendered":"<p>Yesterday <a href=\"https:\/\/justthenews.com\/government\/courts-law\/appeals-court-strips-legal-immunity-college-officials-discriminating-against\" target=\"_blank\" rel=\"noopener\">Just the News<\/a> reported that the 8th U.S. Circuit Court of Appeals has <a href=\"https:\/\/ecf.ca8.uscourts.gov\/opndir\/21\/03\/191696P.pdf\">determined <\/a>that three University of Iowa officials can be held personally liable for derecognizing a Christian student club over its leadership requirements.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 40px;\"><strong>The law is &#8220;clearly established&#8221; that government officials cannot practice viewpoint discrimination, as administrators did by enforcing a &#8220;human rights&#8221; policy against Business Leaders in Christ but not other student groups, the 8th U.S. Circuit Court of Appeals <a href=\"https:\/\/ecf.ca8.uscourts.gov\/opndir\/21\/03\/191696P.pdf\">determined<\/a>.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>It&#8217;s exceedingly rare for courts to deny &#8220;qualified immunity&#8221; to public actors for violating constitutional rights. Litigants must point to court precedents that officials should have known were binding on their specific behavior, making it unlawful.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Yet the University of Iowa is likely to suffer a second loss on qualified immunity in a closely related case involving a different Christian club, InterVarsity Christian Fellowship. Oral arguments for each case were <a href=\"https:\/\/www.thecollegefix.com\/judges-grill-university-of-iowa-on-why-officials-shouldnt-be-liable-for-unconstitutional-actions\/\">four<\/a> <a href=\"https:\/\/www.thecollegefix.com\/university-of-iowa-struggles-to-convince-court-its-officials-arent-liable-for-unconstitutional-actions\/\">months<\/a> apart, and both went badly for the university.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The three-judge panel upheld two constitutional claims by Business Leaders in Christ but divided on the third claim, on whether administrators should have known they were violating the club&#8217;s free exercise rights.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>In a concurrence and dissent, Judge Jonathan Kobes said all three claims should have been upheld.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>&#8220;The law is clear: state organizations may not target religious groups for differential treatment or withhold an otherwise available benefit solely because they are religious,&#8221; he wrote. &#8220;The individual defendants may pick their poison: they are either plainly incompetent or they knowingly violated the Constitution.&#8221;<\/strong><\/p>\n<p>I suspect this may not be the end of these lawsuits.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yesterday Just the News reported that the 8th U.S. Circuit Court of Appeals has determined that three University of Iowa officials can be held personally liable for derecognizing a Christian student club over its leadership requirements.
