{"id":41602,"date":"2021-03-17T14:35:11","date_gmt":"2021-03-17T18:35:11","guid":{"rendered":"https:\/\/www.rightwinggranny.com\/?p=41602"},"modified":"2021-03-17T14:35:11","modified_gmt":"2021-03-17T18:35:11","slug":"too-little-too-late-2","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=41602","title":{"rendered":"Too Little Too Late"},"content":{"rendered":"<p><a href=\"https:\/\/www.theepochtimes.com\/michigan-judge-rules-state-secretarys-ballot-signature-matching-guidance-invalid_3736724.html?&amp;utm_source=newsnoe&amp;utm_medium=email&amp;email=rightwinggranny@live.com&amp;utm_campaign=breaking-2021-03-17-1\" target=\"_blank\" rel=\"noopener\">The Epoch Times<\/a> reported the following today:<\/p>\n<p style=\"padding-left: 40px;\"><strong>A Michigan judge ruled last week that Secretary of State Jocelyn Benson\u2019s last October guidance relating to ballot signature verification was not in compliance with the law and thus it\u2019s invalid.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Michigan Republican Party and Allegan County clerk Robert Genetski filed the lawsuit on Nov. 2, 2020, against Benson and Jonathan Brater, director of the Michigan Bureau of Elections.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The plaintiffs claimed that the guidance Benson issued last October violated the Administrative Procedures Act (APA) and should be nullified. They also asked the court to declare that they have the right to request an audit of their choosing, saying the state-wide audit in November did not review whether signatures were properly evaluated.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>On Oct. 6, 2020, Benson issued <a href=\"https:\/\/mielections.csod.com\/clientimg\/mielections\/MaterialSource\/97316e2f-5358-4d07-9e2a-f802b96e38d0_AV_Application_and_Ballot_Signature_Verification_and_Notification_Pre_March_10_Final__1_.pdf\" target=\"_blank\" rel=\"noopener\">guidance<\/a> titled \u201cAbsent Voter Ballot Processing: Signature Verification and Voter Notification Standards.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The guidance stated that clerks \u201cmust perform their signature verification duties with the presumption that the voter\u2019s application or envelope signature is his or her genuine signature.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The guidance also said signatures \u201cshould be considered questionable\u201d only if they differ \u201cin multiple, significant and obvious respects from the signature on file,\u201d according to the court order (<a href=\"https:\/\/townsquare.media\/site\/656\/files\/2021\/03\/Michigan-Court-Of-Claims-Republican-Party-vs-Secretary-of-State-Jocelyn-Benson-Signature-Verification.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>). \u201cWhenever possible,\u201d election officials were to resolve \u201cslight dissimilarities\u201d in favor of finding that the signature was valid.<\/strong><\/p>\n<p>This is too little too late. The Secretary of State did not have the authority to change the law&#8211;that is the job of the legislature. Unfortunately, there were similar events in numerous states leading up to the 2020 election.
