Breitbart<\/a> reported Monday that the American Civil Liberties Union (ACLU) is challenging the practice of checking signatures on absentee ballots to make sure they match the signature the voter has on file.<\/p>\n

The article reports:<\/p>\n

Signature matching, a process whereby county election boards verify the authenticity of the ballot by matching the signature to that of the voter, is facing increased legal challenges from various voting rights groups.<\/strong><\/p>\n

In Indiana, for example, the board matches<\/a> the signature \u201con a provided affidavit printed on the outside of a return envelope.\u201d There remain countless instances of boards rejecting ballots due to discrepancies in the signatures. Over 550,000 ballots were rejected<\/a> in the 2020 primaries alone for several reasons, one of which included mismatched signatures.<\/strong><\/p>\n

The practice is now facing legal challenges in states like Indiana, where a federal judge last week\u00a0determined<\/a> signature matching to be unconstitutional, as boards are not required to alert the voter, nor do they provide an option to address the suspected error.<\/strong><\/p>\n

Under U.S. District Court Judge Sarah Evans Barker\u2019s ruling, state election officials in the Hoosier State can no longer reject a ballot that contains a mismatched signature \u201cwithout giving proper notice to the voter and without providing means to contest the decision,\u201d as USA Today<\/em> detailed<\/a>.<\/strong><\/p>\n

Similarly, groups in Ohio, including the\u00a0American Civil Liberties Union (ACLU) and ACLU of Ohio, are lodging a similar challenge, asking the courts to end the signature matching process as it currently operates, referring to it as a \u201cflawed\u201d system. Voters, the groups contend, should have \u201csufficient notice of purportedly mismatched signatures and the opportunity to fix those mismatches when boards of elections mistakenly reject their ballots and ballot applications on the basis of signature mismatches.\u201d<\/strong><\/p>\n

\u201cThe vast preponderance of signatures identified as \u2018non-matching\u2019 are in fact legitimate. According to experts, when a ballot is rejected for \u2018signature mismatch,\u2019 there is a 97 percent probability that it is actually legitimate!\u201d Freda Levenson, legal director of the ACLU of Ohio, said, according to Fox 19.<\/strong><\/p>\n

Levenson also pointed<\/a> to the coronavirus pandemic, contending that it will result in an unprecedented number of Ohioans voting by mail.<\/strong><\/p>\n

\u201cWe are asking the court to require the Secretary of State to provide adequate notice and opportunity to cure supposed \u2018mismatches\u2019 so that large numbers of legitimate Ohio voters are not deprived of their constitutional right to vote,\u201d Levenson added.<\/strong><\/p>\n

Obviously there is another side to this story. Voters should not be deprived of their constitutional right to vote nor should their vote be cancelled by an illegally cast vote<\/span>. The Democrats have already telegraphed their plan to flood districts where the margin of victory for Trump is small with late mail-in ballots. That is similar to the tactic that gave John Kennedy a victory in Illinois in 1960.
