DOJ Docs Show Rosenstein Advising Mueller \u2018the Boss\u2019 Doesn\u2019t Know About Their Communications \u2014 Judicial Watch<\/h1>\n

Rosenstein docs also show \u2018off the record\u2019 leaks to <\/em>60 Minutes, The New York Times and <\/em>The Washington Post around and on the date of Mueller\u2019s appointment.<\/em><\/strong><\/p>\n

(Washington, DC) Judicial Watch released 145 pages<\/a> of Rod Rosenstein\u2019s communications that include a one-line email<\/a> from Rod Rosenstein to Robert Mueller stating, \u201cThe boss and his staff do not know about our discussions\u201d and \u201coff the record\u201d emails with major media outlets around the date of Mueller\u2019s appointment.<\/strong><\/p>\n

Judicial Watch filed the lawsuit<\/a> after the DOJ failed to respond to a September 21, 2018, Freedom of Information Act (FOIA) request (Judicial Watch v. U.S. Department of Justice<\/em><\/a>\u00a0(No. 1:19-cv-00481)). Judicial Watch seeks:<\/strong><\/p>\n

Any and all e-mails, text messages, or other records of communication addressed to or received by Deputy Attorney General Rod Rosenstein between May 8, 2017, and May 22, 2017.<\/strong><\/p><\/blockquote>\n

The time period referred to in this suit is critical. On May 8, 2017, Rosenstein wrote a\u00a0memo<\/a>\u00a0to President Trump recommending that FBI Director James Comey be fired. The next day, President Trump fired Comey. Just three days later, on May 12, Rosenstein sent an email<\/a> assuring Robert Mueller that \u201cThe boss and his staff do not know about our discussions.\u201d<\/strong><\/p>\n

In a May 16, 2017 email<\/a>, sent the day before Mueller\u2019s appointment, Rosenstein emailed former Bush administration Deputy Attorney General and current Kirkland & Ellis Partner, Mark Filip stating, \u201cI am with Mueller. He shares my views. Duty Calls.\u00a0 Sometimes the moment chooses us.\u201d<\/strong><\/p>\n

And on May 17 Rosenstein\u00a0appointed<\/a>\u00a0former FBI Director Robert Mueller to investigate Russian meddling in the 2016 presidential election.<\/strong><\/p>\n

Also, during the same time period, between May 8 and May 17, Rosenstein\u00a0met with<\/a>\u00a0then-acting FBI Director Andrew McCabe and other senior Justice Department FBI officials to discuss wearing a wire<\/a> and invoking the 25th<\/sup>\u00a0Amendment to remove President Trump.<\/strong><\/p>\n

The documents also show that, again during the same time period, Rod Rosenstein was in direct communication with reporters from 60 Minutes<\/em>, The New York Times<\/em> and The Washington Post<\/em>. In an email<\/a> exchange dated May 2017, Rosenstein communicated with New York Times<\/em> reporter Rebecca Ruiz to provide background for this article<\/a> about himself. Ruiz emailed Rosenstein a draft of the article, and he responded with off-the-record comments and clarifications.<\/strong><\/p>\n
