{"id":36681,"date":"2019-07-27T14:30:48","date_gmt":"2019-07-27T18:30:48","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=36681"},"modified":"2019-07-27T14:30:48","modified_gmt":"2019-07-27T18:30:48","slug":"if-you-are-a-parent-this-is-frightening","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=36681","title":{"rendered":"If You Are A Parent, This Is Frightening"},"content":{"rendered":"<p><a href=\"https:\/\/www.lifesitenews.com\/news\/mom-sues-county-for-giving-her-minor-son-sex-change-without-her-consent?utm_content=bufferb3bc6&amp;utm_medium=LSN%2Bbuffer&amp;utm_source=facebook&amp;utm_campaign=LSN&amp;fbclid=IwAR1yNAqh7Uuwn92EmYlSmYy4L1rtsH2Qgefj7-BJLiG5zORC5Sa69vfaEwo\" target=\"_blank\" rel=\"noopener noreferrer\">Life Site News<\/a> posted an article on Wednesday about what I would consider a serious violation of parental rights by the government.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 40px;\"><strong>The Minnesota mother whose son was maneuvered through a \u201csex change\u201d by county officials has asked the U.S. Supreme Court to review her case. She is charging the government with usurping her parental rights when its agents provided her son with transgender services and narcotic drugs against her wishes.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The Thomas More Society petitioned the High Court Wednesday on behalf of Anmarie Calgaro, arguing that Calgaro\u2019s due process rights were \u201ctrampled on\u201d when St. Louis County and its referred health providers \u201cended her parental control over her minor son without a court order of emancipation.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cIt\u2019s a parent\u2019s worst nightmare,\u201d Thomas More Society special counsel Erick Kaardal said. \u201cAnmarie Calgaro\u2019s child, while a minor, was steered through a life-changing, permanent body altering process, becoming a pawn in someone else\u2019s sociopolitical agenda and being influenced by those who have no legal or moral right to usurp the role of a parent.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><a href=\"https:\/\/www.lifesitenews.com\/news\/breaking-minnesota-mom-files-lawsuit-over-parental-rights-in-17-year-old-so\"><strong>Calgaro sued<\/strong><\/a><strong> state agencies and health providers in federal court in 2016 for terminating her parental rights without due process after her minor son was given elective medical services for a so-called \u201csex change\u201d without her consent or a legal order of emancipation.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Her suit said the state\u2019s entities decided on their own that the then-17-year-old boy was emancipated.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The defendants handled Calgaro\u2019s son as an emancipated minor even though there had been no court action to that effect, the Thomas More statement says. Neither the school district, the county, nor any of the medical agencies named in the lawsuit gave Calgaro any notice or hearing before ending her parental rights over her minor child.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>A district judge <a href=\"https:\/\/www.lifesitenews.com\/news\/federal-judge-to-mom-school-not...liable-for-secretly-helping-your-son-beco\">dismissed Calgaro\u2019s lawsuit<\/a> in May 2017, admitting that the boy was not legally emancipated by a court order but ruling that Calgaro\u2019s parental rights \u201cremained intact.\u201d The Thomas More Society says <a href=\"https:\/\/www.thomasmoresociety.org\/thomas-more-society-seeks-vindication-for-de-facto-emancipation-of-minor-son\/\">the judge decreed<\/a> that the de facto emancipation of Calgaro\u2019s minor son by the county, school, and medical care providers did not constitute an infringement of constitutionally protected parental rights.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The case was\u00a0appealed in July 2017 and the district court ruling <a href=\"http:\/\/files.eqcf.org\/wp-content\/uploads\/2019\/03\/13695376-Judgment.pdf\">upheld by the 8th Circuit Court of Appeals<\/a> in March of this year.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>St. Louis County decided without any basis that Calgaro\u2019s son was emancipated and could receive government benefits, even though Calgaro was a \u201cfit parent\u201d who objected to their actions, the legal non-profit\u2019s statement on the Supreme Court filing said.<\/strong><\/p>\n<p>The article concludes:<\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cAnd the St. Louis County School District in Minnesota has a custom and practice of barring a parent from involvement in the child\u2019s education for more than two years after a child is deemed by the school principal, not by a court order, to be emancipated,\u201d he said. \u201cThis is an unacceptable situation for any parent and a serious violation of parental and due process rights.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Minnesota\u2019s language regarding emancipation is vague, and state law presents no procedural due process rights for \u201cfit parents,\u201d according to Kaardal, even though it does so for those deemed unfit.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cWhy wouldn\u2019t we make this same effort for fit parents?\u201d he asked.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Kaardal said he was concerned in particular about the conflict in Minnesota\u2019s legal statutes.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cThe U.S. Court of Appeals ignored the major disconnect in the District Court decision where the mother\u2019s parental rights are admitted but not honored, and the ridiculous claims that the agencies which have violated Calgaro\u2019s rights did nothing wrong,\u201d he stated. \u201cThe United States Supreme Court now has the opportunity to untangle this incompatible and untenable scenario; so, nationwide fit parents can keep parenting without governmental interference.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u201cUnder federal law, the right to parent is considered an unenumerated right, protected from governmental interference by the Due Process Clauses of the Fifth and Fourteenth Amendments,\u201d said Kaardal. \u201cThe \u201cliberty\u201d of the Due Process Clauses safeguards those substantive rights \u201cso rooted in the traditions and conscience as to be ranked as fundamental.\u201d<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>The U.S. Supreme Court reconvenes in October.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<div class=\"ad-block ad-content ad-pos-bot content-loaded\" style=\"padding-left: 40px;\" data-entry-id=\"203860\">\n<div id=\"D_Detail_content_bot\" style=\"padding-left: 40px;\" data-google-query-id=\"CMb0ivrb1eMCFYjEwAod-SMESQ\">\n<div id=\"google_ads_iframe_\/2596116\/D_Detail_content_bot_0__container__\" style=\"padding-left: 40px;\"><\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Life Site News posted an article on Wednesday about what I would consider a serious violation of parental rights by the government.
