The Conservative Treehouse<\/a> posted an article today about Congressional oversight<\/a> into the FISA violations under President Obama<\/a>.<\/p>\n

The title of the article is, “How The FBI and DOJ Intelligence Units Were Weaponized Around Congressional Oversight\u2026”<\/a><\/p>\n

I strongly suggest that you follow the link and read the entire article, but there are a few things I want to mention here.<\/p>\n

The article reports:<\/p>\n

NSA<\/a> Director Admiral Mike Rogers has announced<\/a> to his staff he is resigning. A nominee will be announced to replace him shortly. Rogers departure makes sense.\u00a0 His incredible accomplishments are complete; he will now be free to testify, unencumbered, to congress.<\/strong><\/p>\n

So why is this important?<\/p>\n

Admiral Mike Rogers became NSA director in April 2014.<\/strong><\/p>\n

Sometime in early 2016 Admiral Rogers became aware of \u201congoing\u201d and \u201cintentional\u201d violations of Foreign Intelligence Surveillance Act<\/a> (FISA), Section 702(17) surveillance<\/a>. Specifically item #17 which includes the unauthorized upstream data collection of U.S. individuals within NSA surveillance through the use of \u201cAbout Query<\/a>\u201d.<\/strong><\/p>\n

Section 702 \u2013 Item #17 \u201cAbout Queries\u201d are specifically the collection of electronic messaging, emails and upstream phone call surveillance data of U.S. persons.<\/strong><\/p>\n

The public doesn\u2019t discover this issue, and Director Rogers action, until May 2017<\/a> when we learn that Rogers told the FISA court<\/a> he became aware of unlawful surveillance and collection of U.S. persons.<\/strong><\/p>\n

Put into context, with the full back-story, it appears that 2016 surveillance was the political surveillance now in the headlines; the stuff Chairman<\/a> Nunes is currently questioning. The dates here are important as they tell a story.<\/strong><\/p>\n

As a result of Rogers suspecting FISA 702(17) surveillance activity was being used for reasons he deemed unlawful, in mid 2016 Rogers ordered the NSA compliance officer to run a full audit on 702 NSA compliance.<\/strong><\/p>\n

Again, 702 is basically spying on Americans; the actual \u201cspying\u201d part is 702. Item 17 is \u201cAbout Queries<\/a>\u201c, which allows user queries or searches of content (messaging, email and phone conversations) based on any subject matter put into the search field.<\/strong><\/p>\n

The NSA compliance officer identified several strange 702 \u201cAbout Queries\u201d were being conducted. These were violations of the fourth amendment (search and seizure<\/a>), ie searches, privacy violations, and surveillance without a warrant.\u00a0 Admiral Rogers was briefed by the compliance officer on October 20th, 2016.<\/strong><\/p>\n

Admiral Mike Rogers ordered the \u201cAbout Query\u201d activity to stop, reported the activity to the DOJ, and then went to the FISA court.<\/strong><\/p>\n

On October 26th, 2016, full FISA court assembled, NSA Director Rogers personally informed the court of the 702(17) violations.\u00a0 Additionally, and as an outcome of the NSA systems inability to guarantee integrity, Rogers also stopped \u201cAbout Query<\/a>\u201d permanently.<\/strong><\/p>\n
