{"id":32026,"date":"2017-11-25T18:43:00","date_gmt":"2017-11-25T23:43:00","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=32026"},"modified":"2017-11-25T18:43:00","modified_gmt":"2017-11-25T23:43:00","slug":"do-some-democrats-even-read-the-law","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=32026","title":{"rendered":"Do Some Democrats Even Read The Law?"},"content":{"rendered":"<p><a href=\"https:\/\/theconservativetreehouse.com\/2017\/11\/25\/elizabeth-warren-goes-bananas-over-cfpb-director-change\/#more-142525\" target=\"_blank\" rel=\"noopener\">The Conservative Treehouse<\/a> posted an article today about the change in leadership at the <a class=\"zem_slink\" title=\"Consumer Financial Protection Bureau\" href=\"http:\/\/en.wikipedia.org\/wiki\/Consumer_Financial_Protection_Bureau\" target=\"_blank\" rel=\"noopener wikipedia\">Consumer Financial Protection Bureau<\/a> (CFPB). The current director, <a class=\"zem_slink\" title=\"Richard Cordray\" href=\"http:\/\/www.cordrayforohio.com\" target=\"_blank\" rel=\"homepage noopener\">Richard Cordray<\/a>, is <a class=\"zem_slink\" title=\"Resignation\" href=\"http:\/\/en.wikipedia.org\/wiki\/Resignation\" target=\"_blank\" rel=\"noopener wikipedia\">resigning<\/a> from the position. There are some constitutional problems with the CFPB, in that it is accountable to no one&#8211;not even the voters.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>A federal court found the CFPB Director position held too much power<a href=\"https:\/\/www.cbsnews.com\/news\/appeals-court-finds-structure-of-cfpb-unconstitutional\/\" target=\"_blank\" rel=\"noopener\"> and deemed it unconstitutional<\/a>. The court decision noted that <em>giving the <a class=\"zem_slink\" title=\"President of the United States\" href=\"http:\/\/en.wikipedia.org\/wiki\/President_of_the_United_States\" target=\"_blank\" rel=\"noopener wikipedia\">President<\/a> power to fire the Director<\/em> would fix the constitutional problem.<\/strong><\/p>\n<p><a class=\"zem_slink\" title=\"Elizabeth Warren\" href=\"http:\/\/www.law.harvard.edu\/faculty\/directory\/index.html?id=82\" target=\"_blank\" rel=\"homepage noopener\">Senator Elizabeth Warren<\/a> is complaining that with the resignation of Cordray, the directorship should automatically go to the Deputy Director. Instead, President Trump is planning to appoint <a class=\"zem_slink\" title=\"Mick Mulvaney\" href=\"http:\/\/en.wikipedia.org\/wiki\/Mick_Mulvaney\" target=\"_blank\" rel=\"noopener wikipedia\">Mick Mulvaney<\/a> as temporary head of the agency until a permanent person can be appointed. Senator Warren has tweeted that this is unacceptable.<\/p>\n<p>However, the article goes on to explain why President Trump&#8217;s appointment of a temporary director would be legal:<\/p>\n<p style=\"padding-left: 30px;\"><strong>President Trump has power to appoint the interim or <em>\u2018acting<\/em>\u2018 head of the agency in the case of a vacancy just like he would any other vacancy. [<em>Important Reminder: A <a class=\"zem_slink\" title=\"Direct current\" href=\"http:\/\/en.wikipedia.org\/wiki\/Direct_current\" target=\"_blank\" rel=\"noopener wikipedia\">DC<\/a> appellate court already ruled the legal issues with the CFPB Director position necessitate oversight by the <a class=\"zem_slink\" title=\"Executive (government)\" href=\"http:\/\/en.wikipedia.org\/wiki\/Executive_%28government%29\" target=\"_blank\" rel=\"noopener wikipedia\">executive branch<\/a>.<\/em>] The President fills the vacancy using the familiar mechanism of the Federal Vacancies Reform Act (FVRA); until such time as a permanent replacement is nominated and <a class=\"zem_slink\" title=\"Advice and consent\" href=\"http:\/\/en.wikipedia.org\/wiki\/Advice_and_consent\" target=\"_blank\" rel=\"noopener wikipedia\">confirmed by the Senate<\/a>.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The <a class=\"zem_slink\" title=\"Dodd\u2013Frank Wall Street Reform and Consumer Protection Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Dodd%E2%80%93Frank_Wall_Street_Reform_and_Consumer_Protection_Act\" target=\"_blank\" rel=\"noopener wikipedia\">Dodd-Frank<\/a> statute Warren cites doesn\u2019t provide a mechanism in case of vacancy. It has a provision for when the Director is \u201cabsent\u201d or \u201cunavailable\u201d, both considered temporary terms by design, but not when the Director-ship is \u201cvacant\u201d.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The resigning director, Richard Cordray, (who resigned from a confirmed position) cannot appoint his replacement; that responsibility falls to the President.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Nowhere in Dodd-Frank statute does congress say they are repealing Federal Vacancies Reform Act for the Consumer Financial Protection Bureau. Therefore FVRA applies to CFPB regardless of whether Senator Warren likes the designated person assigned, or not.<\/strong><\/p>\n<p>Please follow the link to the original article to read the entire story.
