{"id":31980,"date":"2017-11-17T09:35:37","date_gmt":"2017-11-17T14:35:37","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=31980"},"modified":"2017-11-17T09:35:37","modified_gmt":"2017-11-17T14:35:37","slug":"ending-some-of-washingtons-political-gamesmanship","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=31980","title":{"rendered":"Ending Some Of Washington&#8217;s Political Gamesmanship"},"content":{"rendered":"<p><a class=\"zem_slink\" title=\"Scott Johnson\" href=\"http:\/\/www.attask.com\" target=\"_blank\" rel=\"homepage noopener\">Scott Johnson<\/a> at<a href=\"http:\/\/www.powerlineblog.com\/archives\/2017\/11\/on-blue-slips-grassley-pulls-the-trigger.php\" target=\"_blank\" rel=\"noopener\"> Power Line<\/a> posted an article today about the practice of &#8216;the blue slip courtesy&#8217; used to block judicial nominees in <a class=\"zem_slink\" title=\"United States Congress\" href=\"http:\/\/maps.google.com\/maps?ll=38.8897222222,-77.0088888889&amp;spn=0.01,0.01&amp;q=38.8897222222,-77.0088888889 (United%20States%20Congress)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">Congress<\/a>.<\/p>\n<p>The website<a href=\"http:\/\/www.judicialnominations.org\/wp-content\/uploads\/2010\/06\/Blue-Slips.pdf\" target=\"_blank\" rel=\"noopener\"> judicialnominations.org<\/a> explains the process:<\/p>\n<p style=\"padding-left: 30px;\"><strong>One way in which <a class=\"zem_slink\" title=\"Senatorial courtesy\" href=\"http:\/\/en.wikipedia.org\/wiki\/Senatorial_courtesy\" target=\"_blank\" rel=\"wikipedia noopener\">senatorial courtesy<\/a> has manifested itself is something called the \u201cblue slip.\u201d This is a device used by the Senate Judiciary Committee to communicate with the home-state Senators about a nomination to the U.S. courts of appeal or district courts, or to be a U.S. marshal or U.S. attorney. When a nominee is referred to the committee, the committee sends a letter (typically on light blue paper) asking the two home-state Senators to take a position on the nomination. The Senators check off the appropriate box on the sheet\u2014either approve or disapprove\u2014and return the paper to the Judiciary Committee. <\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The blue slip process is used only by the Senate Judiciary Committee \u2014no other <a class=\"zem_slink\" title=\"List of current United States Senate committees\" href=\"http:\/\/en.wikipedia.org\/wiki\/List_of_current_United_States_Senate_committees\" target=\"_blank\" rel=\"wikipedia noopener\">Senate committee<\/a> uses it for other kinds of nominations. The practice of using blue slips dates back to at least 1917. Since mid-2001, the status of blue slips for each judge nominated have been publicly available on the Web.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>It is a matter of some debate how important blue slips are in the confirmation process. The blue slip practice is not a formal part of the Judiciary Committee\u2019s rules, and the determination of just how much weight to give to a Senator\u2019s opposition to a nomination is left largely up to the chair of the committee. Among other issues, the chair will decide whether to honor the objections, voiced through blue-slips, from all home-state senators or just those who belong to the same party as the president.<\/strong><\/p>\n<p>Unfortunately, the process has been occasionally abused. The Judicial Nominations website explains:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Much also has been written that is critical of the blue-slip system. George \u00a0Washington University law professor <a class=\"zem_slink\" title=\"Jonathan Turley\" href=\"http:\/\/en.wikipedia.org\/wiki\/Jonathan_Turley\" target=\"_blank\" rel=\"wikipedia noopener\">Jonathan Turley<\/a> described the system this way:\u00a0 <a class=\"zem_slink\" title=\"Blue slip\" href=\"http:\/\/en.wikipedia.org\/wiki\/Blue_slip\" target=\"_blank\" rel=\"wikipedia noopener\">Blue-slipping<\/a> is a little known process by which senators can block federal judge nominees from their state. This means that judges who may rule in your case often are selected to meet senatorial, not professional, demands. By simply not returning blue slips sent by the Senate Judiciary Committee, a senator can block a nominee for the most nefarious or arbitrary reasons, including a personal grudge, a bargaining tool with the White House or failure of the nominee to be sufficiently fawning in the senator\u2019s presence.<\/strong><\/p>\n<p>This courtesy has been misused by both sides&#8211;it was not meant as a negotiating tool&#8211;it was meant to be a courtesy.<\/p>\n<p>The article at Power Line details some changes that <a class=\"zem_slink\" title=\"Chuck Grassley\" href=\"http:\/\/en.wikipedia.org\/wiki\/Chuck_Grassley\" target=\"_blank\" rel=\"wikipedia noopener\">Senator Grassley<\/a> is making in order to expedite the confirmation of President Trump&#8217;s judicial nominees.<\/p>\n<p>Power Line reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8230;<a class=\"zem_slink\" title=\"United States Senate Committee on the Judiciary\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Senate_Committee_on_the_Judiciary\" target=\"_blank\" rel=\"wikipedia noopener\">Senate Judiciary Committee Chairman<\/a> Chuck Grassley announced that he would not let Franken\u2019s withheld blue slip block the nomination of <a class=\"zem_slink\" title=\"Minnesota Supreme Court\" href=\"http:\/\/maps.google.com\/maps?ll=44.9544444444,-93.1002777778&amp;spn=0.01,0.01&amp;q=44.9544444444,-93.1002777778 (Minnesota%20Supreme%20Court)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">Minnesota Supreme Court<\/a> Justice David Stras to the Eighth Circuit (or Senator Kennedy\u2019s block Kyle Duncan to the Fifth Circuit).<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Senator Grassley took to the floor of the Senate to explain his disposition of \u201cthe blue slip courtesy\u201d and his decision to schedule a committee hearing on the nominations of Stras and Duncan (text of statement <a href=\"https:\/\/www.grassley.senate.gov\/news\/news-releases\/grassley-maintain-historical-blue-slip-courtesy\">here<\/a>, video below). The Hill reported on Senator Grassley\u2019s statement <a href=\"http:\/\/thehill.com\/homenews\/senate\/360791-grassley-says-hes-nixing-blue-slips-for-pair-of-nominees\">here<\/a>.<\/strong><\/p>\n<p>Washington needs to stop playing games and get its work done. All Congressmen (and Congresswomen) should be paid according to what they actually accomplish.
