{"id":31880,"date":"2017-11-02T16:31:48","date_gmt":"2017-11-02T20:31:48","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=31880"},"modified":"2017-11-02T16:31:48","modified_gmt":"2017-11-02T20:31:48","slug":"government-by-the-people-which-people","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=31880","title":{"rendered":"Government By The People&#8230;Which People???"},"content":{"rendered":"<p>On Monday, <a href=\"https:\/\/www.conservativereview.com\/articles\/fourth-circuit-takes-control-of-north-carolina\" target=\"_blank\" rel=\"noopener\">The Conservative Review<\/a> posted an article about some recent decisions by the <a class=\"zem_slink\" title=\"United States Court of Appeals for the Fourth Circuit\" href=\"http:\/\/maps.google.com\/maps?ll=37.53769,-77.43481&amp;spn=1.0,1.0&amp;q=37.53769,-77.43481 (United%20States%20Court%20of%20Appeals%20for%20the%20Fourth%20Circuit)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">Fourth Circuit Court of Appeals<\/a> regarding <a class=\"zem_slink\" title=\"North Carolina\" href=\"http:\/\/maps.google.com\/maps?ll=35.5,-80.0&amp;spn=3.0,3.0&amp;q=35.5,-80.0 (North%20Carolina)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">North Carolina<\/a>. It seems that the wishes of the voters and the legislature have taken a back seat to the wishes of the Court.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>As we\u2019ve noted in a series of articles, the unelected federal courts have destroyed North Carolina\u2019s right to self-determination. They have <a href=\"https:\/\/www.conservativereview.com\/articles\/4th-circuit-sides-with-obamas-unlawful-war-on-gender\">mandated transgenderism<\/a>, <a href=\"https:\/\/www.conservativereview.com\/articles\/insane-court-nixes-nc-voter-id-law\">blocked every voter integrity law<\/a>, required very specific times and amounts of early voting, <a href=\"https:\/\/www.conservativereview.com\/articles\/the-judicial-war-on-god-and-the-declaration-of-independence\">criminalized voluntary public prayer<\/a>, and erased every single districting map \u2014 from <a href=\"https:\/\/www.conservativereview.com\/articles\/scotus-steals-north-carolina-sovereignty-rules-against-districts\">federal<\/a> and <a href=\"https:\/\/www.conservativereview.com\/articles\/court-nullifies-north-carolina-elections\">state districts<\/a> to even <a href=\"https:\/\/www.conservativereview.com\/articles\/federal-judiciary-declares-war-on-nc-elections-yet-again\">county school board maps<\/a> in middle of an election season and after candidates already spent enormous sums campaigning. Again, this was all done by federal, not state courts. They are rendering elections moot and are now ensuring that conservatives can never win elections by <a href=\"https:\/\/www.conservativereview.com\/articles\/republicans-won-in-2016-but-liberal-judges-have-an-ace-up-their-sleeve-for-the-next-cycle\">ruling Democrat racial gerrymander advantages<\/a> into law and into the Constitution.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Now, the Fourth Circuit has unilaterally hired a liberal proctor to oversee and supervise the state legislature in the new redistricting it previously mandated.<\/strong><\/p>\n<p>It is not the duty of the Court to legislate&#8211;they are not elected officials and do not have that power.<\/p>\n<p>The article continues:<\/p>\n<p style=\"padding-left: 30px;\"><strong>It is first important to recognize that North Carolina received pre-clearance from <em>Obama\u2019s <\/em>Justice Department, and the maps were upheld twice in state court. That should have ended the matter. <a href=\"https:\/\/www.conservativereview.com\/articles\/georgia-gop-judge-shreds-election-law-gives-dems-advantage\">Federal courts should have absolutely no jurisdiction<\/a> over state legislative maps. Yet the federal courts nullified 28 legislative districts and remanded back to the three-judge panel, which includes two Obama-appointed judges.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The <a class=\"zem_slink\" title=\"North Carolina General Assembly\" href=\"http:\/\/www.ncleg.net\" target=\"_blank\" rel=\"homepage noopener\">North Carolina legislature<\/a> went back and drew <a href=\"http:\/\/www.ncleg.net\/sessions\/2017\/house\/proposed%202017%20House%20Redistricting%20plan.pdf\">a new, clean map<\/a> that is better than anything Democrats put out when they had control for 100 years. That should have ended the matter. Yet the Obama judges, who have been accorded God-like power over subject matter the Constitution did not entrust to them, want to make sure the maps maximize the Democrat Party advantage. They gave standing to another lawsuit challenging three Senate and nine House districts. Last Thursday, <a href=\"https:\/\/drive.google.com\/file\/d\/0B8mzo_D7IoZxREp3eG5UMDZCdE0\/view\">in a written order<\/a>, Judge Catherine Eagles wrote on behalf of the three-judge panel that she feels the new map doesn\u2019t redress the \u201cconstitutional\u201d violation and is \u201cotherwise legally unacceptable\u201d \u2014 in other words, it doesn\u2019t contain enough Democrat advantages. So, in the ultimate act of legislating from the bench, the judge said that due to \u201cthe technical nature of determining an appropriate remedy\u201d and \u201cexceptional circumstances,\u201d the court is appointing a \u201cspecial master\u201d to oversee the maps.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Thus, an unelected federal court with no constitutional jurisdiction over maps cleared by the <a class=\"zem_slink\" title=\"United States Department of Justice\" href=\"http:\/\/maps.google.com\/maps?ll=38.8933333333,-77.025&amp;spn=0.01,0.01&amp;q=38.8933333333,-77.025 (United%20States%20Department%20of%20Justice)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">DOJ<\/a> and state courts is now requiring that de facto veto power over the new maps be given to an unelected \u201cexpert.\u201d While this is not the first time officious federal courts have created a \u201cspecial master,\u201d the circumstances are particularly indefensible, given that the state has done everything properly until now.<\/strong><\/p>\n<p>This is not acceptable. The solution is nullification.<\/p>\n<p><a href=\"http:\/\/tenthamendmentcenter.com\/2009\/03\/06\/jeffersons-arguments-for-nullification-and-limited-government\/\" target=\"_blank\" rel=\"noopener\">The Tenth Amendment Center<\/a> explains the concept of nullification:<\/p>\n<p style=\"padding-left: 30px;\"><strong><a class=\"zem_slink\" title=\"Thomas Jefferson\" href=\"http:\/\/en.wikipedia.org\/wiki\/Thomas_Jefferson\" target=\"_blank\" rel=\"wikipedia noopener\">Thomas Jefferson<\/a>\u2019s <a href=\"http:\/\/www.tenthamendmentcenter.com\/kentucky-resolutions-of-1798\/\">Kentucky Resolutions<\/a> claim that the <a class=\"zem_slink\" title=\"United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Constitution\" target=\"_blank\" rel=\"wikipedia noopener\">U. S. Constitution<\/a> was a compact among the several states-whereby the states delegated certain limited powers to the U.S. government; any undelegated power exercised by the U. S. government is thus void. <span id=\"more-403\"><\/span><\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Furthermore, the general government is not the final and authoritative judge of its own powers, since that would make the government\u2019s discretion, and not the Constitution, the measure of those powers-but rather the <a class=\"link\" title=\"parties\" href=\"http:\/\/www.associatedcontent.com\/theme\/1642\/parties.html\">parties<\/a> to the contract, the states, have each an equal right to judge for themselves whether the Constitution has been violated as well as \u201cthe mode and measure of redress\u201d-since there is no common judge of such matters among them.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Thus, every state can of its own authority nullify within its territory \u201call assumptions of power by others\u201d-i.e., all perceived violations of the Constitution by the federal government.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The <a class=\"zem_slink\" title=\"Kentucky and Virginia Resolutions\" href=\"http:\/\/en.wikipedia.org\/wiki\/Kentucky_and_Virginia_Resolutions\" target=\"_blank\" rel=\"wikipedia noopener\">Kentucky Resolution<\/a> uses the Tenth Amendment to justify a strict construction of the general government\u2019s powers; any powers not expressly delegated to the U. S. government remain the province of the states or the people, and any exercise of those powers by the general government is void and can be struck down by the states on that basis.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Furthermore, Jefferson warns against construing the \u201cnecessary and proper\u201d clause so broadly as to justify the assumption of undelegated powers by the general government; the intent of the clause was to only enable the execution of limited powers, not to indefinitely extend the general government\u2019s scope. Otherwise, this part of the Constitution would be used \u201cto destroy the whole residue of that instrument.\u201d<\/strong><\/p>\n<p>We have wandered far afield from the republic our Founding Fathers envisioned. It is time to change direction and get back to where we belong.
