{"id":31753,"date":"2017-10-14T20:07:50","date_gmt":"2017-10-15T00:07:50","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=31753"},"modified":"2017-10-14T20:07:50","modified_gmt":"2017-10-15T00:07:50","slug":"restoring-the-rule-of-law","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=31753","title":{"rendered":"Restoring The Rule Of Law"},"content":{"rendered":"<p>A website called <a href=\"https:\/\/usconstitution.net\/constfaq_q125.html\" target=\"_blank\" rel=\"noopener\">usconstitution.net <\/a>explains the procedure involved in <a class=\"zem_slink\" title=\"Government spending\" href=\"http:\/\/en.wikipedia.org\/wiki\/Government_spending\" target=\"_blank\" rel=\"wikipedia noopener\">government spending<\/a>:<\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8230;&#8221;All bills for raising <a class=\"zem_slink\" title=\"Government revenue\" href=\"http:\/\/en.wikipedia.org\/wiki\/Government_revenue\" target=\"_blank\" rel=\"wikipedia noopener\">Revenue<\/a> shall originate in the House of Representatives&#8221; (<a href=\"https:\/\/usconstitution.net\/const_A1Sec7.html\">Article 1, Section 7<\/a>). Thus, I&#8217;ve listed the House&#8217;s &#8220;original jurisdiction&#8221; over <a class=\"zem_slink\" title=\"Revenue\" href=\"http:\/\/www.wikinvest.com\/metric\/Revenue\" target=\"_blank\" rel=\"wikinvest noopener\">revenue<\/a> bills (laws that affect taxes) as a check. The House, however, views this clause a little differently, taking it to mean not only <a class=\"zem_slink\" title=\"Tax\" href=\"http:\/\/en.wikipedia.org\/wiki\/Tax\" target=\"_blank\" rel=\"wikipedia noopener\">taxation<\/a> bills but also spending bills.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The plain language of the clause would seem to contradict the House&#8217;s opinion, but the House relies on historical precedent and contemporaneous writings to support its position. In <u><a class=\"zem_slink\" title=\"The Federalist (John Harvard Library)\" href=\"http:\/\/www.amazon.com\/Federalist-John-Harvard-Library\/dp\/0674298004%3FSubscriptionId%3D0G81C5DAZ03ZR9WH9X82%26tag%3Dzem-20%26linkCode%3Dxm2%26camp%3D2025%26creative%3D165953%26creativeASIN%3D0674298004\" target=\"_blank\" rel=\"amazon noopener\">Federalist<\/a> 66<\/u>, for example, <a class=\"zem_slink\" title=\"Alexander Hamilton\" href=\"http:\/\/en.wikipedia.org\/wiki\/Alexander_Hamilton\" target=\"_blank\" rel=\"wikipedia noopener\">Alexander Hamilton<\/a> writes, &#8220;The exclusive privilege of originating <a class=\"zem_slink\" title=\"Money bill\" href=\"http:\/\/en.wikipedia.org\/wiki\/Money_bill\" target=\"_blank\" rel=\"wikipedia noopener\">money bills<\/a> will belong to the House of Representatives.&#8221; <em>This<\/em> phrase could easily be construed to include taxing and spending. The <a class=\"zem_slink\" title=\"Supreme Court of the United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8905555556,-77.0044444444&amp;spn=0.01,0.01&amp;q=38.8905555556,-77.0044444444 (Supreme%20Court%20of%20the%20United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">Supreme Court<\/a> has ruled, however, that the Senate can initiate bills that create revenue, if the revenue is incidental and not directly a tax. Most recently, in <i><a class=\"zem_slink\" title=\"United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8833333333,-77.0166666667&amp;spn=0.1,0.1&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">US<\/a> v Munoz-Flores<\/i> (495 <a class=\"zem_slink\" title=\"U.S. Route 385\" href=\"http:\/\/en.wikipedia.org\/wiki\/U.S._Route_385\" target=\"_blank\" rel=\"wikipedia noopener\">US 385<\/a> [1990]), the Court said, &#8220;Because the bill at issue here was not one for raising revenue, it could not have been passed in violation of the <a class=\"zem_slink\" title=\"Origination Clause\" href=\"http:\/\/en.wikipedia.org\/wiki\/Origination_Clause\" target=\"_blank\" rel=\"wikipedia noopener\">Origination Clause<\/a>.&#8221; The case cites <i>Twin City v Nebeker<\/i> (176 US 196 [1897]), where the court said that &#8220;revenue bills are those that levy taxes, in the strict sense of the word.&#8221;<\/strong><\/p>\n<p>Yesterday, <a class=\"zem_slink\" title=\"Power Line\" href=\"http:\/\/www.powerlineblog.com\" target=\"_blank\" rel=\"homepage noopener\">John Hinderaker<\/a> at <a href=\"http:\/\/www.powerlineblog.com\/archives\/2017\/10\/on-obamacare-trump-restores-the-rule-of-law.php\" target=\"_blank\" rel=\"noopener\">Power Line Blog<\/a> posted an article explaining how recent actions by President Trump are restoring that constitutional principle. On Thursday, President Trump announced that he was ending payments to insurance companies that were implemented by <a class=\"zem_slink\" title=\"Executive order\" href=\"http:\/\/en.wikipedia.org\/wiki\/Executive_order\" target=\"_blank\" rel=\"wikipedia noopener\">Executive Order<\/a> under <a class=\"zem_slink\" title=\"Patient Protection and Affordable Care Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Patient_Protection_and_Affordable_Care_Act\" target=\"_blank\" rel=\"wikipedia noopener\">ObamaCare<\/a>. Since the payments were never approved by the House of Representatives, the payments were illegal and should never have begun in the first place. The Obama Administration had made those payments.<\/p>\n<p>The article at Power Line states:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Liberal news outlets are offering a parade of horribles that will ensue if the federal government doesn\u2019t continue to pay off insurance companies. In most cases, they pay little or no attention to the constitutional issue at stake. Whether such consequences will result is not so clear. <a href=\"http:\/\/www.chrisjacobshc.com\/2017\/10\/13\/the-constitution-finally-takes-precedence-over-obamacare\/\">Chris Jacobs<\/a> points out:<\/strong><\/p>\n<p style=\"padding-left: 60px;\"><em><strong>For the time being, individuals likely will not see any direct effects from the payments ceasing. Carriers cannot exit Exchanges mid-year, and contracts for the 2018 plan year are already signed. (A provision in carriers\u2019 2017 and 2018 contracts lets them exit Exchanges if enrollees do not receive cost-sharing reductions\u2014not if the insurers themselves do not receive reimbursement for those cost-sharing reductions. This clause, awkwardly drafted by insurers\u2019 counsel, may provide them with little legal recourse\u2014and further highlights their questionable assumptions and behavior surrounding the subsidies.) So maybe\u2014just maybe\u2014Washington can spend some time focusing on the real issue behind the Administration\u2019s action: Upholding the Constitution.<\/strong><\/em><\/p>\n<p style=\"padding-left: 30px;\"><strong>If <a class=\"zem_slink\" title=\"United States Congress\" href=\"http:\/\/maps.google.com\/maps?ll=38.8897222222,-77.0088888889&amp;spn=0.01,0.01&amp;q=38.8897222222,-77.0088888889 (United%20States%20Congress)&amp;t=h\" target=\"_blank\" rel=\"geolocation noopener\">Congress<\/a> wants to continue the subsidies, it can do so. Its appropriation, obviously, will make them constitutional. But regardless of what happens from now on, the Trump administration has acted admirably by refusing to go along with the unconstitutional regime that <a class=\"zem_slink\" title=\"WhiteHouse.gov\" href=\"http:\/\/www.whitehouse.gov\" target=\"_blank\" rel=\"homepage noopener\">Barack Obama<\/a> instituted.<\/strong><\/p>\n<p>This is not about politics&#8211;it is about following the U.S. Constitution as the law of the land.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A website called usconstitution.net explains the procedure involved in government spending: &#8230;&#8221;All bills for raising Revenue shall originate in the House of Representatives&#8221; (Article 1, Section 7).
