{"id":30481,"date":"2017-03-22T12:00:33","date_gmt":"2017-03-22T16:00:33","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=30481"},"modified":"2017-03-22T12:00:33","modified_gmt":"2017-03-22T16:00:33","slug":"better-late-than-never-2","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=30481","title":{"rendered":"Better Late Than Never"},"content":{"rendered":"<p>Yesterday <a href=\"http:\/\/freebeacon.com\/issues\/kagan-breyer-help-strike-down-obama-appointment\/\" target=\"_blank\">The Washington Free Beacon<\/a> reported on a Supreme Court ruling that happened on Tuesday.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>The court ruled Tuesday that Obama appointee Lafe Solomon illegally served as acting general counsel to the <a class=\"zem_slink\" title=\"National Labor Relations Board\" href=\"http:\/\/www.nlrb.gov\" target=\"_blank\" rel=\"homepage\">National Labor Relations Board<\/a> from 2010 to 2013. Solomon, who once violated the <a href=\"http:\/\/freebeacon.com\/politics\/nlrb-lawyer-caught-in-ethics-violation\/\" target=\"_blank\">agency&#8217;s ethics rules<\/a>, should have vacated the position in accordance with the Federal Vacancies Reform Act of 1998 (FVRA) after the <a class=\"zem_slink\" title=\"United States Senate\" href=\"http:\/\/maps.google.com\/maps?ll=38.8905555556,-77.0088888889&amp;spn=0.01,0.01&amp;q=38.8905555556,-77.0088888889 (United%20States%20Senate)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Senate<\/a> refused to take up his nomination to serve as permanent general counsel in 2011, the court found in a 6-2 opinion authored by <a class=\"zem_slink\" title=\"John Roberts\" href=\"http:\/\/en.wikipedia.org\/wiki\/John_Roberts\" target=\"_blank\" rel=\"wikipedia\">Chief Justice John Roberts<\/a>. The appointment was an &#8220;end-run around&#8221; the Constitution.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8220;We cannot cast aside the separation of powers and the <a class=\"zem_slink\" title=\"Appointments Clause\" href=\"http:\/\/en.wikipedia.org\/wiki\/Appointments_Clause\" target=\"_blank\" rel=\"wikipedia\">Appointments Clause<\/a>&#8216;s important check on executive power for the sake of administrative convenience or efficiency,&#8221; the majority <a href=\"https:\/\/www.supremecourt.gov\/opinions\/16pdf\/15-1251_ed9g.pdf\" target=\"_blank\">ruled<\/a>.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The case came to the court after the NLRB filed unfair labor practice charges against an Arizona-based ambulance service, Southwest General, following union complaints.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>David Phippen, a management-side labor attorney at the firm Constangy, Brooks, Smith &amp; Prophete, said the decision clarifies the meaning of the FVRA.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8220;The case is a reminder that the language of the FVRA statute means what it says and must be followed, not ignored by Presidents, as appeared to be the case here,&#8221; Phippen said in an email. &#8220;The decision \u2026 appe<wbr><\/wbr>ars to make it somewhat more difficult for Presidents to put \u2018her or his people&#8217; into important agency positions unilaterally, i.e., \u00a0without approval of the Senate.&#8221;<\/strong><\/p>\n<p>The article notes that <a class=\"zem_slink\" title=\"Sonia Sotomayor\" href=\"http:\/\/en.wikipedia.org\/wiki\/Sonia_Sotomayor\" target=\"_blank\" rel=\"wikipedia\">Justice Sonia Sotomayor<\/a> and <a class=\"zem_slink\" title=\"Ruth Bader Ginsburg\" href=\"http:\/\/en.wikipedia.org\/wiki\/Ruth_Bader_Ginsburg\" target=\"_blank\" rel=\"wikipedia\">Justice Ruth Bader Ginsburg<\/a> were the only Justices who dissented from the majority vote.<\/p>\n<p>On another note, the media spin on this story is very interesting.
