{"id":29993,"date":"2017-01-09T12:42:54","date_gmt":"2017-01-09T17:42:54","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=29993"},"modified":"2017-01-09T12:42:54","modified_gmt":"2017-01-09T17:42:54","slug":"states-begin-to-examine-civil-asset-forfeiture","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=29993","title":{"rendered":"States Begin To Examine Civil Asset Forfeiture"},"content":{"rendered":"<p>Yesterday<a href=\"http:\/\/hotair.com\/archives\/2017\/01\/08\/texas-looking-to-abolish-civil-asset-forfeiture\/\" target=\"_blank\"> Hot Air<\/a> posted an article about a move in <a class=\"zem_slink\" title=\"Texas\" href=\"http:\/\/maps.google.com\/maps?ll=31.0,-100.0&amp;spn=10.0,10.0&amp;q=31.0,-100.0 (Texas)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Texas<\/a> to abolish Civil Asset Forfeiture. I have written about this procedure in the past (<a href=\"https:\/\/www.rightwinggranny.com\/?p=25604\" target=\"_blank\">here<\/a>, <a href=\"https:\/\/www.rightwinggranny.com\/?p=25604\" target=\"_blank\">here<\/a>, and <a href=\"https:\/\/www.rightwinggranny.com\/?p=24403\" target=\"_blank\">here<\/a>). One of the most common examples of Civil Asset Forfeiture occurs when the government accuses a <a class=\"zem_slink\" title=\"Small business\" href=\"http:\/\/en.wikipedia.org\/wiki\/Small_business\" target=\"_blank\" rel=\"wikipedia\">small business owner<\/a> of making multiple deposits of less than $10,000 in order to avoid federal regulations that track such deposits. The law has been used to take <a class=\"zem_slink\" title=\"Asset\" href=\"http:\/\/en.wikipedia.org\/wiki\/Asset\" target=\"_blank\" rel=\"wikipedia\">assets<\/a> away from small business owners with little regard for their <a class=\"zem_slink\" title=\"Constitutional right\" href=\"http:\/\/en.wikipedia.org\/wiki\/Constitutional_right\" target=\"_blank\" rel=\"wikipedia\">Constitutional rights<\/a>. The assets seized can be sold and the money used to shore up local budgets. Needless to say, there is a lot of temptation there for some <a class=\"zem_slink\" title=\"Local government\" href=\"http:\/\/en.wikipedia.org\/wiki\/Local_government\" target=\"_blank\" rel=\"wikipedia\">local governments<\/a>. A few states have taken action to limit these forfeitures. Texas is now joining them.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Texas is looking to become the third <a href=\"http:\/\/reason.com\/blog\/2016\/04\/20\/nebraska-ends-civil-police-forfeiture-pr\" target=\"_blank\">state<\/a> in the <a href=\"http:\/\/statenews.org\/post\/ohios-civil-asset-forfeiture-bill-signed-law\" target=\"_blank\">last year<\/a> to abolish civil <a class=\"zem_slink\" title=\"Asset forfeiture\" href=\"http:\/\/en.wikipedia.org\/wiki\/Asset_forfeiture\" target=\"_blank\" rel=\"wikipedia\">asset forfeiture<\/a>, and replace it with criminal asset forfeiture. State Senator <a class=\"zem_slink\" title=\"Konni Burton\" href=\"http:\/\/en.wikipedia.org\/wiki\/Konni_Burton\" target=\"_blank\" rel=\"wikipedia\">Konni Burton<\/a> filed <a href=\"http:\/\/www.capitol.state.tx.us\/tlodocs\/85R\/billtext\/pdf\/SB00380I.pdf\" target=\"_blank\">a bill<\/a> last month which requires a felony conviction before law enforcement can gobble up someone\u2019s property. It\u2019s a major step in Texas\u2019 fight for justice reform which has <a href=\"http:\/\/www.freedomworks.org\/content\/savings-prison-reforms-texas-top-3-billion-crimes-rates-hit-lowest-point-1968\" target=\"_blank\">saved<\/a> the state $3B (while crime rates are at record lows).<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8230;There\u2019s just one problem\u2026the asset forfeiture laws are being misapplied in cases where people who are not convicted of crimes, end up losing their property because prosecutors and police believe they \u201cmay have\u201d been involved in\/had knowledge of a crime. A Philadelphia family was <a href=\"http:\/\/www.cnn.com\/2014\/09\/03\/us\/philadelphia-drug-bust-house-seizure\/\" target=\"_blank\">forced out<\/a> of their home because their son was arrested on drug charges, even though it didn\u2019t appear they knew what the 22-year-old was doing. A Texas man had over 53-thousand dollars in cash donations for an orphanage and school <a href=\"http:\/\/kfor.com\/2016\/04\/25\/man-claims-deputies-seized-50000-meant-for-orphanage-church-and-christian-band\/\" target=\"_blank\">seized<\/a> after he was pulled over in <a class=\"zem_slink\" title=\"Oklahoma\" href=\"http:\/\/maps.google.com\/maps?ll=35.5,-98.0&amp;spn=3.0,3.0&amp;q=35.5,-98.0 (Oklahoma)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Oklahoma<\/a>.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The <a href=\"http:\/\/www.phillymag.com\/news\/2014\/12\/19\/d-drops-forfeiture-cases-drew-national-attention\/\" target=\"_blank\">home<\/a> and <a href=\"http:\/\/www.nbcnews.com\/news\/asian-america\/months-after-53-000-seized-charity-donations-returned-christian-band-n565871\" target=\"_blank\">money<\/a> were eventually returned to their rightful owners after the cases got a ton of press. But <a class=\"zem_slink\" title=\"Right on Crime\" href=\"http:\/\/en.wikipedia.org\/wiki\/Right_on_Crime\" target=\"_blank\" rel=\"wikipedia\">Right on Crime<\/a> Deputy Director Derek Cohen <a href=\"http:\/\/rightoncrime.com\/2016\/12\/rebutting-common-myths-by-derek-cohen-of-civil-asset-forfeiture\/\" target=\"_blank\">points out<\/a> media attention doesn\u2019t always happen, because the numbers aren\u2019t really sexy (emphasis mine).<\/strong><\/p>\n<p>Ordinary citizens trying to run a business and live their lives should not have to worry about a government that almost arbitrarily can take their assets. It is good to see Texas moving in the right direction.
