{"id":27367,"date":"2016-01-14T14:04:59","date_gmt":"2016-01-14T19:04:59","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=27367"},"modified":"2017-01-14T07:28:35","modified_gmt":"2017-01-14T12:28:35","slug":"a-president-who-does-not-follow-the-constitution-impacts-other-countries-not-only-america","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=27367","title":{"rendered":"A President Who Does Not Follow The Constitution Impacts Other Countries&#8211;Not Only America"},"content":{"rendered":"<p>Today&#8217;s <a href=\"http:\/\/www.wsj.com\/articles\/why-were-suing-obama-over-keystone-1452729039\" target=\"_blank\">Wall Street Journal <\/a>featured a very good article entitled, &#8220;Why We&#8217;re Suing Obama Over Keystone.&#8221; The article was written by Kristine Kelkus, an executive vice president and general counsel at TransCanada. I strongly suggest you follow the link above and read the entire article, but I am including a few excerpts from the article that illustrate how damaging an out-of-control President has been to our country and our neighbors.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>For 65 years, <a class=\"zem_slink\" title=\"TransCanada Corporation\" href=\"http:\/\/www.transcanada.com\/\" target=\"_blank\" rel=\"homepage\">TransCanada<\/a> has built <a class=\"zem_slink\" title=\"Pipeline transport\" href=\"http:\/\/en.wikipedia.org\/wiki\/Pipeline_transport\" target=\"_blank\" rel=\"wikipedia\">oil and gas pipelines<\/a> in North America. It\u2019s a job the company is good at, and one we much prefer to building lengthy legal filings that could take several years to resolve. Still, when TransCanada in 2008 walked its application for a presidential permit into the <a class=\"zem_slink\" title=\"United States Department of State\" href=\"http:\/\/maps.google.com\/maps?ll=38.8941666667,-77.0483333333&amp;spn=0.01,0.01&amp;q=38.8941666667,-77.0483333333 (United%20States%20Department%20of%20State)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">U.S. State Department<\/a>, the company was prepared for an extensive evidentiary process\u2014albeit one that has traditionally been straightforward. <\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Until the <a class=\"zem_slink\" title=\"Keystone Pipeline\" href=\"http:\/\/en.wikipedia.org\/wiki\/Keystone_Pipeline\" target=\"_blank\" rel=\"wikipedia\">Keystone XL pipeline<\/a>, no U.S. administration had prohibited the cross-border construction of a major oil pipeline. And within the past decade, U.S. regulators approved two very similar, large cross-border pipelines that transport exactly the same type of oil that the Keystone XL pipeline would have carried from the same region in <a class=\"zem_slink\" title=\"Alberta\" href=\"http:\/\/maps.google.com\/maps?ll=54.5,-115.0&amp;spn=10.0,10.0&amp;q=54.5,-115.0 (Alberta)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Alberta, Canada<\/a>, to the U.S.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>TransCanada already operates the initial Keystone pipeline, which was approved in <a class=\"icon none\" href=\"http:\/\/www.transcanada.com\/3036.html\" target=\"_blank\">2008<\/a>. And in <a class=\"icon none\" href=\"http:\/\/www.state.gov\/r\/pa\/prs\/ps\/2009\/aug\/128164.htm\" target=\"_blank\">2009<\/a> the State Department under Secretary <a href=\"http:\/\/topics.wsj.com\/person\/C\/Hillary-Clinton\/6344\">Hillary Clinton<\/a> and Mr. Obama permitted <a class=\"zem_slink\" title=\"Enbridge\" href=\"http:\/\/www.enbridge.com\/\" target=\"_blank\" rel=\"homepage\">Enbridge<\/a>, a direct competitor to TransCanada, to build another. Each of these permit reviews took about two years.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8230;But environmental activists made rejection of the project a litmus test of the president\u2019s climate-change credentials. The State Department\u2019s official <a class=\"zem_slink\" title=\"Record of Decision\" href=\"http:\/\/en.wikipedia.org\/wiki\/Record_of_Decision\" target=\"_blank\" rel=\"wikipedia\">Record of Decision<\/a> reasoned that permitting the pipeline to proceed would \u201cundermine U.S. climate leadership\u201d because \u201cthe understanding of the international community\u201d\u2014contrary to the administration\u2019s own findings\u2014was that the pipeline would increase greenhouse-gas emissions. Permitting construction would \u201cundercut the credibility and influence of the <a class=\"zem_slink\" title=\"United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">United States<\/a>\u201d in negotiating with other countries, including at the coming Paris climate conference.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>In other words, the pipeline and its benefits were sacrificed to increase the president\u2019s negotiating leverage with other countries.<\/strong><\/p>\n<p>My first reaction to this article was to wonder who runs Enbridge, if campaign contributions were involved, and if <a class=\"zem_slink\" title=\"Berkshire Hathaway\" href=\"http:\/\/www.berkshirehathaway.com\/\" target=\"_blank\" rel=\"homepage\">Berkshire Hathaway<\/a> owns the railway that was carrying the oil before the Enbridge pipeline was built (see <a href=\"https:\/\/www.rightwinggranny.com\/?p=21879\" target=\"_blank\">here<\/a>).<\/p>\n<p>The article further concludes:<\/p>\n<p style=\"padding-left: 30px;\"><strong>The administration\u2019s actions harm business and public interests that extend far beyond a particular pipeline. The decision calls into question the entire process for cross-border facility approvals. It strongly suggests that investing in the U.S. is subject to a level of \u201csovereign risk\u201d usually associated with far less developed economies.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Unless they are remedied in court or arbitration, the Keystone decision and the political expediency underlying it will also encourage future administrations to conclude that they, too, can disregard the most basic legal requirements.<\/strong><\/p>\n<p>We need a President who puts the interests of all Americans above the interests of special interest groups and major contributors.<\/p>\n<p style=\"padding-left: 30px;\">\n","protected":false},"excerpt":{"rendered":"<p>Today&#8217;s Wall Street Journal featured a very good article entitled, &#8220;Why We&#8217;re Suing Obama Over Keystone.&#8221; The article was written by Kristine Kelkus, an executive vice president and general counsel at TransCanada.
