Fidell\" href=\"http:\/\/en.wikipedia.org\/wiki\/Eugene_R._Fidell\" target=\"_blank\" rel=\"wikipedia\">Eugene Fidell<\/a> says the <a class=\"zem_slink\" title=\"Convening authority (court-martial)\" href=\"http:\/\/en.wikipedia.org\/wiki\/Convening_authority_%28court-martial%29\" target=\"_blank\" rel=\"wikipedia\">convening authority<\/a> did not follow the advice of the <a class=\"zem_slink\" title=\"Preliminary hearing\" href=\"http:\/\/en.wikipedia.org\/wiki\/Preliminary_hearing\" target=\"_blank\" rel=\"wikipedia\">preliminary hearing<\/a> officer who had recommended that Bergdahl\u2019s case be moved only to a special misdemeanor-level military court. Fidell said in a statement Monday that he had hoped the case would not go in this direction.<\/strong><\/p>\n<p>On June 30, 2009, Sgt. Bergdahl went missing from his post in <a class=\"zem_slink\" title=\"Afghanistan\" href=\"http:\/\/maps.google.com\/maps?ll=34.5333333333,69.1333333333&amp;spn=10.0,10.0&amp;q=34.5333333333,69.1333333333 (Afghanistan)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Afghanistan<\/a>. He was held by the <a class=\"zem_slink\" title=\"Taliban\" href=\"http:\/\/en.wikipedia.org\/wiki\/Taliban\" target=\"_blank\" rel=\"wikipedia\">Taliban<\/a> for five years. The controversy surrounding his disappearance involves the question of whether or not he is a deserter. As you remember, Bergdahl was exchanged for five Taliban leaders who were being held at Guantanamo.
