{"id":26688,"date":"2015-10-09T20:32:50","date_gmt":"2015-10-10T00:32:50","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=26688"},"modified":"2015-10-09T20:32:50","modified_gmt":"2015-10-10T00:32:50","slug":"the-puddle-at-the-end-of-your-driveway-is-no-longer-under-government-control","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=26688","title":{"rendered":"The Puddle At The End Of Your Driveway Is No Longer Under Government Control"},"content":{"rendered":"<p><a class=\"zem_slink\" title=\"Ed Morrissey\" href=\"http:\/\/en.wikipedia.org\/wiki\/Ed_Morrissey\" target=\"_blank\" rel=\"wikipedia\">Ed Morrissey<\/a> at <a href=\"http:\/\/hotair.com\/archives\/2015\/10\/09\/sixth-circuit-blocks-epa-water-rule-nationwide\/\" target=\"_blank\">Hot Air<\/a> is reporting today that the new Environmental Protection Agency rule that theoretically would protect small waterways cannot be enforced nationwide.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>In a 2-1 ruling, the <a class=\"zem_slink\" title=\"Cincinnati\" href=\"http:\/\/maps.google.com\/maps?ll=39.1,-84.5166666667&amp;spn=0.1,0.1&amp;q=39.1,-84.5166666667 (Cincinnati)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Cincinnati<\/a>-based <a class=\"zem_slink\" title=\"United States Court of Appeals for the Sixth Circuit\" href=\"http:\/\/www.ca6.uscourts.gov\/internet\/default.html\" target=\"_blank\" rel=\"homepage\">Court of Appeals for the Sixth Circuit<\/a> delivered a stinging defeat to Obama\u2019s most ambitious effort to keep streams and wetlands clean, saying it looks likely that the rule, dubbed \u201cwaters of the <a class=\"zem_slink\" title=\"United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">United States<\/a>,\u201d is illegal.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cWe conclude that petitioners have demonstrated a substantial possibility of success on the merits of their claims,\u201d the judges wrote in their\u00a0<a href=\"http:\/\/www.ca6.uscourts.gov\/opinions.pdf\/15a0246p-06.pdf\">decision<\/a>, explaining that the Environmental Protection Agency\u2019s new guidelines for determining whether water is subject to federal control \u2014 based mostly on the water\u2019s distance and connection to larger <a class=\"zem_slink\" title=\"Body of water\" href=\"http:\/\/en.wikipedia.org\/wiki\/Body_of_water\" target=\"_blank\" rel=\"wikipedia\">water bodies<\/a> \u2014 is \u201cat odds\u201d with a key Supreme Court ruling.<\/strong><\/p>\n<p><strong>\u00a0<\/strong>The new law had the potential of putting even seasonal mud puddles on people&#8217;s front yards under <a class=\"zem_slink\" title=\"Federal jurisdiction (United States)\" href=\"http:\/\/en.wikipedia.org\/wiki\/Federal_jurisdiction_%28United_States%29\" target=\"_blank\" rel=\"wikipedia\">federal jurisdiction<\/a>.<\/p>\n<p>The article further reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong><a class=\"zem_slink\" title=\"The Hill (newspaper)\" href=\"http:\/\/thehill.com\" target=\"_blank\" rel=\"homepage\">The Hill<\/a> calls this \u201ca stinging defeat,\u201d but it may be more of a \u201cstinging delay\u201d at this point. At the very least, the EPA\u2019s power grab has been put on hold, and that\u2019s a welcome breather at this stage of the Obama administration.<\/strong><\/p>\n<p>Americans need to be aware of attempts to drastically increase the federal government under <a class=\"zem_slink\" title=\"Barack Obama\" href=\"http:\/\/www.barackobama.com\" target=\"_blank\" rel=\"homepage\">President Obama<\/a>.
