{"id":26683,"date":"2015-10-09T20:15:55","date_gmt":"2015-10-10T00:15:55","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=26683"},"modified":"2015-10-09T20:15:55","modified_gmt":"2015-10-10T00:15:55","slug":"you-cant-have-it-both-ways","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=26683","title":{"rendered":"You Can&#8217;t Have It Both Ways"},"content":{"rendered":"<p><a href=\"http:\/\/www.foxnews.com\/politics\/2015\/10\/09\/exclusive-us-officials-conclude-iran-deal-violates-federal-law\/\" target=\"_blank\">Fox News<\/a> is reporting today that there is an aspect of the <a class=\"zem_slink\" title=\"Iran\" href=\"http:\/\/maps.google.com\/maps?ll=35.6833333333,51.4166666667&amp;spn=10.0,10.0&amp;q=35.6833333333,51.4166666667 (Iran)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Iranian<\/a> nuclear deal that conflicts with existing law.<\/p>\n<p>The article explains:<\/p>\n<p style=\"padding-left: 30px;\"><strong>At issue is a passage tucked away in ancillary paperwork attached to <a href=\"http:\/\/www.state.gov\/e\/eb\/tfs\/spi\/iran\/jcpoa\/\" target=\"_blank\">the Joint Comprehensive Plan of Action<\/a>, or JCPOA, as the Iran nuclear deal is formally known. Specifically, Section\u00a05.1.2 of <a href=\"http:\/\/www.state.gov\/documents\/organization\/245320.pdf\" target=\"_blank\">Annex II<\/a> provides that in exchange for Iranian compliance with the terms of the deal, the U.S. \u201cshall\u2026license non-U.S. entities that are owned or controlled by a <a class=\"zem_slink\" title=\"United States person\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_person\" target=\"_blank\" rel=\"wikipedia\">U.S. person<\/a> to engage in activities with Iran that are consistent with this JCPOA.\u201d<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>In short, this means that foreign <a class=\"zem_slink\" title=\"Subsidiary\" href=\"http:\/\/en.wikipedia.org\/wiki\/Subsidiary\" target=\"_blank\" rel=\"wikipedia\">subsidiaries<\/a> of U.S. <a class=\"zem_slink\" title=\"Parent company\" href=\"http:\/\/en.wikipedia.org\/wiki\/Parent_company\" target=\"_blank\" rel=\"wikipedia\">parent companies<\/a> will, under certain conditions, be allowed to do business with Iran. The problem is that the<a href=\"https:\/\/www.govtrack.us\/congress\/bills\/112\/hr1905\/text\" target=\"_blank\">Iran Threat Reduction and Syria Human Rights Act (ITRA)<\/a>, signed into law by <a class=\"zem_slink\" title=\"Barack Obama\" href=\"http:\/\/www.barackobama.com\" target=\"_blank\" rel=\"homepage\">President Obama<\/a> in August 2012, was explicit in closing the so-called \u201cforeign sub\u201d loophole.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Indeed, ITRA also stipulated, in Section 218, that when it comes to doing business with Iran, foreign subsidiaries of U.S. parent firms shall in all cases be treated exactly the same as U.S. firms: namely, what is prohibited for U.S. parent firms has to be prohibited for foreign subsidiaries, and what is allowed for foreign subsidiaries has to be allowed for U.S. parent firms.<\/strong><\/p>\n<p>The President does not have the authority to simply ignore the law and tell <a class=\"zem_slink\" title=\"Corporation Dba\" href=\"http:\/\/www.legalzoom.com\/dba-guide\/corporation.html\" target=\"_blank\" rel=\"legalzoom\">corporations<\/a> to ignore the law. However, based on past experience, the law may not matter. One of the major problems with the Obama Administration is the ignoring of <a class=\"zem_slink\" title=\"Law\" href=\"http:\/\/en.wikipedia.org\/wiki\/Law\" target=\"_blank\" rel=\"wikipedia\">laws<\/a>&#8211;the idea that President Obama can create any law he wants with &#8216;a pen and a phone.&#8217; If Congress wants to be anything other than irrelevant, it is time for them to step up and act. Either the Iranian agreement is legal or it is not.
