{"id":26433,"date":"2015-09-04T08:29:24","date_gmt":"2015-09-04T12:29:24","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=26433"},"modified":"2015-09-04T08:29:24","modified_gmt":"2015-09-04T12:29:24","slug":"the-legal-double-standard","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=26433","title":{"rendered":"The Legal Double Standard"},"content":{"rendered":"<p>Yesterday <a class=\"zem_slink\" title=\"The Wall Street Journal\" href=\"http:\/\/www.wsj.com\/\" target=\"_blank\" rel=\"homepage\">The Wall Street Journal<\/a> posted an article about\u00a0<a class=\"zem_slink\" title=\"Kim Davis\" href=\"http:\/\/en.wikipedia.org\/wiki\/Kim_Davis\" target=\"_blank\" rel=\"wikipedia\">Kim Davis<\/a>, the county clerk for <a class=\"zem_slink\" title=\"Kentucky\" href=\"http:\/\/maps.google.com\/maps?ll=37.5,-85.0&amp;spn=3.0,3.0&amp;q=37.5,-85.0 (Kentucky)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Kentucky<\/a>\u2019s Rowan Country.Ms. Davis is now in jail because she refused to issue marriage licenses to gay couples because it was against her religious beliefs. There are some people who believe that because she is an elected official, her religious beliefs are not allowed to influence the way she does her job, but there is a bit of inconsistency here.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>We don\u2019t recall <a class=\"zem_slink\" title=\"Barack Obama\" href=\"http:\/\/www.barackobama.com\" target=\"_blank\" rel=\"homepage\">President Obama<\/a> insisting on \u201cthe rule of law\u201d when his then Attorney General, <a href=\"http:\/\/topics.wsj.com\/person\/H\/Eric-Holder\/6924\">Eric Holder<\/a>, announced in 2011 that he wouldn\u2019t defend challenges to what was then the law\u2014the <a class=\"zem_slink\" title=\"Defense of Marriage Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Defense_of_Marriage_Act\" target=\"_blank\" rel=\"wikipedia\">Defense of Marriage Act<\/a> signed by <a class=\"zem_slink\" title=\"Bill Clinton\" href=\"http:\/\/www.clintonlibrary.gov\/\" target=\"_blank\" rel=\"homepage\">President Bill Clinton<\/a>\u2014in the courts. Nor did we hear about upholding the law when mayors such as <a href=\"http:\/\/topics.wsj.com\/person\/N\/Gavin-Newsom\/5500\">Gavin Newsom<\/a> in <a class=\"zem_slink\" title=\"San Francisco\" href=\"http:\/\/maps.google.com\/maps?ll=37.7833333333,-122.416666667&amp;spn=0.1,0.1&amp;q=37.7833333333,-122.416666667 (San%20Francisco)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">San Francisco<\/a> issued marriage licenses to same-sex couples in defiance of state laws.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Officials such as Messrs. Holder and Newsom were as guilty as Ms. Davis of elevating personal preferences over the law. Yet they were lionized by those now holding up an obscure Kentucky clerk as a national villain. Meanwhile, five of Rowan County\u2019s six deputy clerks say they will start processing licenses for same-sex couples Friday, but <a class=\"zem_slink\" title=\"Miss Davis\" href=\"http:\/\/en.wikipedia.org\/wiki\/Miss_Davis\" target=\"_blank\" rel=\"wikipedia\">Miss Davis<\/a> says she will not authorize them.<\/strong><\/p>\n<p>I don&#8217;t have the answer to this dilemma. I do believe religious beliefs should be protected, but I am not sure how that would play out in this situation. I suspect our Founding Fathers would come down on the side of Ms. Davis. However, the past behavior of the Obama Administration seems to indicate that if you disagree with a law, you don&#8217;t have to enforce (or follow) it.
