{"id":26314,"date":"2015-08-20T22:32:49","date_gmt":"2015-08-21T02:32:49","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=26314"},"modified":"2015-08-20T22:32:52","modified_gmt":"2015-08-21T02:32:52","slug":"the-constitution-works-we-just-need-to-get-back-to-it","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=26314","title":{"rendered":"The Constitution Works&#8211;We Just Need To Get Back To It"},"content":{"rendered":"<p>Yesterday <a href=\"http:\/\/www.breitbart.com\/video\/2015\/08\/19\/levin-cruz-trump-sessions-are-right-14th-amendment-doesnt-mandate-birthright-citizenship\/\" target=\"_blank\">Breitbart.com<\/a> posted an article that featured <a class=\"zem_slink\" title=\"Mark Levin\" href=\"http:\/\/www.crunchbase.com\/person\/mark-levin\" target=\"_blank\" rel=\"crunchbase\">Mark Levin<\/a> explaining the <a class=\"zem_slink\" title=\"Fourteenth Amendment to the United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/Fourteenth_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">14th Amendment<\/a> of the <a class=\"zem_slink\" title=\"United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">U.S. Constitution<\/a> and what it actually says (or doesn&#8217;t say) about birthright <a class=\"zem_slink\" title=\"Citizenship\" href=\"http:\/\/en.wikipedia.org\/wiki\/Citizenship\" target=\"_blank\" rel=\"wikipedia\">citizenship<\/a>.<\/p>\n<p>Dr. Levin explains:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Levin said that people are getting the clause wrong, \u201cBecause they\u2019re result-oriented. Because they want to insist the Constitution says what it doesn\u2019t say. Moreover, <a class=\"zem_slink\" title=\"Supreme court\" href=\"http:\/\/en.wikipedia.org\/wiki\/Supreme_court\" target=\"_blank\" rel=\"wikipedia\">the Supreme Court<\/a> has never ruled that the children of illegal aliens are American citizens. So the Supreme Court never ruled, even if they did, it would be wrong. The clause speaks for itself, the author of the clause made it abundantly, unequivocally clear, let\u2019s add another thing, let\u2019s read the <a href=\"https:\/\/www.law.cornell.edu\/constitution\/amendmentxiv\" target=\"_blank\">clause<\/a> together, shall we?<em> \u2018All persons born or naturalized in the United States.\u2019 Let\u2019s stop there. If it means what the proponents of birthright citizenship say, it would stop right there. \u2018All persons born or naturalized in the United States\u2019 are citizens. There\u2019s no need for anything else, but that\u2019s what it says. Then it says, and, \u2018subject to the jurisdiction thereof.\u2019<\/em> Now, you have slip and fall lawyers, some phony constitutional lawyers, they have \u2018Esquire\u2019 after their name, they come on TV, they go all over the place, \u2018Jurisdiction means geography.\u2019 Jurisdiction has nothing to do with geography. zero. It had to do with political allegiance to the <a class=\"zem_slink\" title=\"United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">United States of America<\/a>. How do we know it? Because they said it. And they also excluded everybody that the left, and some of the Republicans want to include. Now here\u2019s the good news, there\u2019s another part of the Constitution.<em> It\u2019s <a href=\"https:\/\/www.law.cornell.edu\/constitution\/articlei\" target=\"_blank\">Article I, Section 8, Clause 4<\/a>. Here\u2019s what that says, in plain English. \u2018The Congress shall have power to\u2026establish a uniform rule of naturalization.\u2019 Now, you know what that means, that means Congress, not the courts, not the president, not ICE, it means the <a class=\"zem_slink\" title=\"United States Congress\" href=\"http:\/\/maps.google.com\/maps?ll=38.8897222222,-77.0088888889&amp;spn=0.01,0.01&amp;q=38.8897222222,-77.0088888889 (United%20States%20Congress)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">United States Congress<\/a> has the power to regulate immigration in this regard. And guess what, Sean, in the 1920s, that\u2019s exactly what it did. The 14th Amendment excludes Indians, that is Native Americans, as US citizens, because they felt that they had allegiance to their own national tribes. Okay, great, and I believe it was in 1923, Congress reversed course, and said, \u2018You know what? Under the 14th Amendment and under this Article I, we\u2019ve decided to \u00a0grant citizenship, national citizenship to all Native Americans.\u201d<\/em><\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>He added, \u201cOf course Trump is right, and Cruz is right, and Sessions is right, they\u2019re all right.<\/strong><\/p>\n<p>This is how a Constitutionalist interprets the U.S. Constitution. If you agree with Dr. Levin, you need to vote for a Constitutionalist in the next election. If not, there are a number of people running that you would be happy with. The real problem that Dr. Levin is pointing out is that over the years our government has had a tendency to &#8216;make it up as they go along&#8217; rather than following the Constitution.
