The law will abolish civil asset forfeiture. The bill now goes to the desk of Republican Gov. <a class=\"zem_slink\" title=\"Susana Martinez\" href=\"http:\/\/www.governor.state.nm.us\" target=\"_blank\" rel=\"homepage\">Susana Martinez<\/a>.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong><a class=\"zem_slink\" title=\"Civil law (common law)\" href=\"http:\/\/en.wikipedia.org\/wiki\/Civil_law_%28common_law%29\" target=\"_blank\" rel=\"wikipedia\">Civil<\/a> asset forfeiture is a practice where police can take and keep your property without convicting or even charging you of a crime. Then, you must go through the arduous and often unsuccessful process to get your property\u2013whether it\u2019s a vehicle, cash or your home\u2013back from the police.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong><a class=\"zem_slink\" title=\"New Mexico\" href=\"http:\/\/maps.google.com\/maps?ll=34.0,-106.0&amp;spn=3.0,3.0&amp;q=34.0,-106.0 (New%20Mexico)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">New Mexico<\/a> police must now convict you of a crime and prove your property was used in the crime before you forfeit it to the authorities. Also, the money gained from the property will now go to the state\u2019s general fund instead of police budgets, so that police do not have incentives to take from citizens.<\/strong><\/p>\n<p>Civil asset forfeiture is one of the issues in the confirmation of Loretta Lynch as <a class=\"zem_slink\" title=\"United States Attorney General\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Attorney_General\" target=\"_blank\" rel=\"wikipedia\">U.S. Attorney General<\/a> (<a href=\"https:\/\/www.rightwinggranny.com\/?p=24403\" target=\"_blank\">rightwinggranny.com<\/a>).
