The <a href=\"http:\/\/www.washingtontimes.com\/news\/2014\/dec\/7\/obama-amnesty-in-jeopardy-with-bush-judicial-appoi\/\" target=\"_blank\">first<\/a> appeared on December 7, and dealt with the fact that the case brought by the states regarding President Obama\u2019s deportation amnesty have will be judged by Judge <a href=\"http:\/\/www.washingtontimes.com\/topics\/andrew-s-hanen\/\">Andrew S. Hanen<\/a>, a Bush appointee who issued a scorching rebuke to the <a href=\"http:\/\/www.washingtontimes.com\/topics\/department-of-homeland-security\/\">Department of Homeland Security<\/a> last year, accusing it of refusing to follow border security laws.<\/p>\n<p>The second <a href=\"http:\/\/www.washingtontimes.com\/news\/2014\/dec\/16\/judge-finds-obama-amnesty-unconstitutional\/\" target=\"_blank\">story<\/a>, posted today, states:<\/p>\n<p style=\"padding-left: 30px;\"><strong>A federal judge has found parts of President Obama\u2019s new deportation amnesty to be unconstitutional, issuing a scathing memo Tuesday accusing him of usurping <a class=\"zem_slink\" title=\"United States Congress\" href=\"http:\/\/maps.google.com\/maps?ll=38.8897222222,-77.0088888889&amp;spn=0.01,0.01&amp;q=38.8897222222,-77.0088888889 (United%20States%20Congress)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Congress\u2019s<\/a> power to make laws, and dismantling most of the White House\u2019s legal reasoning for circumventing Congress.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Judge <a class=\"zem_slink\" title=\"Arthur J. Schwab\" href=\"http:\/\/en.wikipedia.org\/wiki\/Arthur_J._Schwab\" target=\"_blank\" rel=\"wikipedia\">Arthur J. Schwab<\/a>, sitting in the <a class=\"zem_slink\" title=\"United States District Court for the Western District of Pennsylvania\" href=\"http:\/\/www.pawd.uscourts.gov\/\" target=\"_blank\" rel=\"homepage\">western district of Pennsylvania<\/a>, said presidents do have powers to use discretion in deciding how to enforce the law, but said Mr. Obama\u2019s new policy goes well beyond that, setting up a full system for granting legal protections to broad groups of individuals. He said Mr. Obama writing laws \u2014 a power that\u2019s reserved for Congress, not the president.<\/strong><\/p>\n<p>The article explains that the memo does not invalidate the President&#8217;s policy, but it is a warning shot to the amnesty cases making their way through the courts. The President does have the power to use an executive order to clarify a law&#8211;he does not have the power to use an executive order to make law.
