{"id":24386,"date":"2014-11-20T13:31:33","date_gmt":"2014-11-20T18:31:33","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=24386"},"modified":"2014-11-20T13:31:33","modified_gmt":"2014-11-20T18:31:33","slug":"the-questionable-roots-of-common-core","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=24386","title":{"rendered":"The Questionable Roots of Common Core"},"content":{"rendered":"<p>On November 14th, the <a href=\"http:\/\/www.cato.org\/blog\/illegal-no-child-waivers-should-raise-much-louder-alarms\" target=\"_blank\">Cato Institution<\/a> posted an article about the waivers given in the &#8220;No Child Left Behind&#8221; program. The waivers were issued very selectively and were used as a means to get states to approve <a class=\"zem_slink\" title=\"Common Core\" href=\"http:\/\/en.wikipedia.org\/wiki\/Common_Core\" target=\"_blank\" rel=\"wikipedia\">Common Core<\/a> educational standards.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>If the\u00a0outcry over\u00a0unilateral executive moves we\u2019ve seen over the last few years remains consistent, Obamacare and immigration are likely to keep sucking up most of Republicans\u2019 attention and the media\u2019s coverage. But just as sweeping have been executive waivers issued from the hated <a class=\"zem_slink\" title=\"No Child Left Behind Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/No_Child_Left_Behind_Act\" target=\"_blank\" rel=\"wikipedia\">No Child Left Behind Act<\/a> \u2013 really the most recent reauthorization of the <a class=\"zem_slink\" title=\"Elementary and Secondary Education Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Elementary_and_Secondary_Education_Act\" target=\"_blank\" rel=\"wikipedia\">Elementary and Secondary Education Act<\/a> \u2013 that have been instrumental in connecting numerous states to, among other things, the Common Core national curriculum standards. And yesterday, the Education Department <a href=\"http:\/\/www2.ed.gov\/policy\/elsec\/guid\/esea-flexibility\/flex-renewal\/index.html\" target=\"_blank\">issued guidance<\/a> offering states the chance to obtain waivers \u2013 if they do the administration\u2019s bidding, of course \u2013 lasting well into the term of the next president: the 2018-19 school year.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>These waivers are almost certainly illegal \u2013 even a <a href=\"http:\/\/www.law.umaryland.edu\/marshall\/crsreports\/crsdocuments\/R42328_06012012.pdf\">Congressional Research Service report<\/a> often cited to suggest the opposite says they are unprecedented in scope and, hence, an untested case \u2013 and even if they are not deemed technically illegal, the reality is they still amount to the <a class=\"zem_slink\" title=\"Executive (government)\" href=\"http:\/\/en.wikipedia.org\/wiki\/Executive_%28government%29\" target=\"_blank\" rel=\"wikipedia\">executive department<\/a> unilaterally making law. NCLB does grant the <a class=\"zem_slink\" title=\"United States Secretary of Education\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Secretary_of_Education\" target=\"_blank\" rel=\"wikipedia\">Secretary of Education<\/a> the authority to issue waivers from many parts of the Act, but it grants no authority to condition those waivers on states adopting <em>administration-preferred policies<\/em>. Indeed, as <a class=\"zem_slink\" title=\"University of South Carolina\" href=\"http:\/\/maps.google.com\/maps?ll=33.9975,-81.0252777778&amp;spn=0.01,0.01&amp;q=33.9975,-81.0252777778 (University%20of%20South%20Carolina)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">University of South Carolina<\/a> law professor Derek W. Black writes in a <a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2485407\" target=\"_blank\">recent analysis of waivers<\/a>, not only does NCLB not authorize conditional waivers, even if a court were to read any waiver authorization as implicitly authorizing conditions, the actual conditions attached \u2013 \u201ccollege- and career-ready standards,\u201d new teacher evaluations, etc. \u2013 <em>fundamentally change the law<\/em>. In fact the changes, Black notes, are essentially what the administration proposed in its 2010 <a href=\"http:\/\/www2.ed.gov\/policy\/elsec\/leg\/blueprint\/blueprint.pdf\">\u201cblueprint\u201d to reauthorize NCLB<\/a>. And quite simply, the executive fundamentally changing a law is not constitutional.<\/strong><\/p>\n<p>The federal government is now taking direct power over what our children learn.
