{"id":24149,"date":"2014-10-24T22:02:35","date_gmt":"2014-10-25T02:02:35","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=24149"},"modified":"2014-10-24T22:02:35","modified_gmt":"2014-10-25T02:02:35","slug":"a-city-recognizes-freedom-of-religion","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=24149","title":{"rendered":"A City Recognizes Freedom Of Religion"},"content":{"rendered":"<p>On Sunday I posted an article (<a href=\"https:\/\/www.rightwinggranny.com\/?p=24109\" target=\"_blank\">rightwinggranny.com<\/a>) about Donald and Evelyn Knapp, two ordained ministers who run the Hitching Post Wedding Chapel.<\/p>\n<p>I quoted a Daily Signal article which reported:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Officials from <a class=\"zem_slink\" title=\"Coeur d'Alene, Idaho\" href=\"http:\/\/maps.google.com\/maps?ll=47.6927777778,-116.78&amp;spn=0.1,0.1&amp;q=47.6927777778,-116.78%20%28Coeur%20d%27Alene%2C%20Idaho%29&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Coeur d\u2019Alene, Idaho<\/a>, told the couple that because <a class=\"zem_slink\" title=\"New York City\" href=\"http:\/\/maps.google.com\/maps?ll=40.6641666667,-73.9386111111&amp;spn=0.1,0.1&amp;q=40.6641666667,-73.9386111111 (New%20York%20City)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">the city<\/a> has a <a class=\"zem_slink\" title=\"Discrimination\" href=\"http:\/\/en.wikipedia.org\/wiki\/Discrimination\" target=\"_blank\" rel=\"wikipedia\">non-discrimination<\/a> statute that includes sexual orientation and <a class=\"zem_slink\" title=\"Gender identity\" href=\"http:\/\/en.wikipedia.org\/wiki\/Gender_identity\" target=\"_blank\" rel=\"wikipedia\">gender identity<\/a>, and because the <a class=\"zem_slink\" title=\"United States Court of Appeals for the Ninth Circuit\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Court_of_Appeals_for_the_Ninth_Circuit\" target=\"_blank\" rel=\"wikipedia\">9th U.S. Circuit Court of Appeals<\/a> struck down <a class=\"zem_slink\" title=\"Idaho\" href=\"http:\/\/maps.google.com\/maps?ll=45.0,-114.0&amp;spn=3.0,3.0&amp;q=45.0,-114.0%20%28Idaho%29&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Idaho<\/a>\u2019s constitutional amendment defining marriage as the union of a man and a woman, the couple would have to officiate at same-sex weddings in their own chapel.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The non-discrimination statute applies to all \u201cpublic accommodations,\u201d and the city views the chapel as a public accommodation.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>On Friday, a same-sex couple asked to be married by the Knapps, and the Knapps politely declined. The Knapps now face a 180-day jail term and $1,000 fine <i>for each day <\/i>they decline to celebrate the <a class=\"zem_slink\" title=\"Same-sex marriage\" href=\"http:\/\/en.wikipedia.org\/wiki\/Same-sex_marriage\" target=\"_blank\" rel=\"wikipedia\">same-sex wedding<\/a>.<\/strong><\/p>\n<p>It seemed to me that the ruling did not respect the Knapps right to practice their religious beliefs freely. Evidently the town in Idaho had second thoughts on the decision and has changed its mind.<\/p>\n<p style=\"padding-left: 30px;\"><strong>The <a href=\"http:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2014\/10\/24\/couer-dalene-apparently-changes-stance-agrees-that-for-profit-chapel-need-not-perform-same-sex-weddings\/\" target=\"_blank\">Washington Post<\/a> is reporting today:<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The city of Coeur d\u2019Alene, Idaho, said a for-profit wedding chapel owned by two ministers doesn\u2019t have to perform same-sex marriages\u2026.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>[<a class=\"zem_slink\" title=\"City attorney\" href=\"http:\/\/en.wikipedia.org\/wiki\/City_attorney\" target=\"_blank\" rel=\"wikipedia\">City Attorney<\/a> Michael] Gridley said after further review, he determined the ordinance doesn\u2019t specify non-profit or for-profit.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cAfter we\u2019ve looked at this some more, we have come to the conclusion they would be exempt from our ordinance because they are a religious corporation,\u201d Gridley explained.<\/strong><\/p>\n<p>One has to wonder who the city attorneys talked to before they decided that the ministers were not breaking any laws.<\/p>\n<p>The article concludes:<\/p>\n<p style=\"padding-left: 30px;\"><strong>As I\u2019ve <a href=\"http:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2014\/10\/22\/couer-dalene-city-attorney-confirms-conservative-christian-ministers-wedding-chapel-business-must-provide-same-sex-marriage-ceremonies\/\">argued before<\/a>, I think more than just religious freedom is at stake here \u2014 the <a class=\"zem_slink\" title=\"First Amendment to the United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/First_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">Free Speech Clause<\/a> protects the right not to participate in verbal ceremonies, whether religious or otherwise, and whether they are pledges of allegiance (even ones without \u201cunder God\u201d) or the conducting of wedding vows (even ones that are secular). A secular freelance writer, for instance, has a Free Speech Clause right to refuse to write news releases for religious groups that he disapproves of (even if he generally takes commissions from the public), or articles praising ceremonies that he disapproves of. Likewise, a wedding officiant has a Free Speech Clause right to refuse to lead <a class=\"zem_slink\" title=\"Wedding\" href=\"http:\/\/en.wikipedia.org\/wiki\/Wedding\" target=\"_blank\" rel=\"wikipedia\">wedding ceremonies<\/a> that he disapproves of. But at least I\u2019m glad that, in this instance, the city has agreed that the ordinance doesn\u2019t apply.<\/strong><\/p>\n<p>I believe that the freedom to practice religion is under attack in America. The Bible is very clear on the subject of homosexuality, and those Christians who believe in the Bible should be free to practice their religion. If the state chooses to marry homosexuals, that is a civil matter. If the state orders Christian pastors to perform gay weddings, the state is then infringing on the rights of Christians.That is the problem with the homosexual agenda&#8211;it discriminates against people who have a Christian worldview.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Sunday I posted an article (rightwinggranny.com) about Donald and Evelyn Knapp, two ordained ministers who run the Hitching Post Wedding Chapel.
