{"id":23972,"date":"2014-10-02T08:46:07","date_gmt":"2014-10-02T12:46:07","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=23972"},"modified":"2014-10-02T08:46:07","modified_gmt":"2014-10-02T12:46:07","slug":"the-legislature-got-it-right-the-court-got-it-wrong","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=23972","title":{"rendered":"The Legislature Got It Right&#8211;The Court Got It Wrong"},"content":{"rendered":"<p>Two of the key provisions in <a class=\"zem_slink\" title=\"North Carolina\" href=\"http:\/\/maps.google.com\/maps?ll=35.5,-80.0&amp;spn=3.0,3.0&amp;q=35.5,-80.0 (North%20Carolina)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">North Carolina&#8217;s<\/a> new <a class=\"zem_slink\" title=\"Voting\" href=\"http:\/\/en.wikipedia.org\/wiki\/Voting\" target=\"_blank\" rel=\"wikipedia\">voting<\/a> <a class=\"zem_slink\" title=\"Law\" href=\"http:\/\/en.wikipedia.org\/wiki\/Law\" target=\"_blank\" rel=\"wikipedia\">law<\/a> have been overturned by a a 2-1 ruling of the <a class=\"zem_slink\" title=\"United States Court of Appeals for the Fourth Circuit\" href=\"http:\/\/maps.google.com\/maps?ll=37.53769,-77.43481&amp;spn=1.0,1.0&amp;q=37.53769,-77.43481 (United%20States%20Court%20of%20Appeals%20for%20the%20Fourth%20Circuit)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">4th U.S. Circuit Court of Appeals<\/a>. <a href=\"http:\/\/news.yahoo.com\/court-blocks-parts-nc-voting-law-180133004--election.html\" target=\"_blank\">Yahoo News<\/a> posted an article yesterday explaining the details.<\/p>\n<p>The two parts of the law that were overturned were <a class=\"zem_slink\" title=\"Election Day voter registration\" href=\"http:\/\/en.wikipedia.org\/wiki\/Election_Day_voter_registration\" target=\"_blank\" rel=\"wikipedia\">same-day registration<\/a> and out-of-<a class=\"zem_slink\" title=\"Precinct\" href=\"http:\/\/en.wikipedia.org\/wiki\/Precinct\" target=\"_blank\" rel=\"wikipedia\">precinct<\/a> voting. The court claimed that to end these practices would\u00a0<a class=\"zem_slink\" title=\"Disfranchisement\" href=\"http:\/\/en.wikipedia.org\/wiki\/Disfranchisement\" target=\"_blank\" rel=\"wikipedia\">disenfranchise<\/a> some voters. I beg to differ. The reason the legislature ended same-day registration was that it did not provide ample time to check the address information given by the voter. A friend of mine, a North Carolina resident, checked the voter registration in her town and found that there were five people registered at her address that did not live there. I don&#8217;t know whether those five people had voted in recent elections or not, but if they did, they cancelled the vote of legal voters&#8211;disenfranchising legal voters. Stopping out-of-precinct voting is a good idea because ballots are different in different precincts&#8211;precinct elections include local candidates that vary by precinct. If a person votes in the wrong precinct, he may not get to vote for the officials in his precinct&#8211;thus he is disenfranchising himself!<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>State House Speaker <a class=\"zem_slink\" title=\"Thom Tillis\" href=\"http:\/\/en.wikipedia.org\/wiki\/Thom_Tillis\" target=\"_blank\" rel=\"wikipedia\">Thom Tillis<\/a>, the Republican challenging incumbent Democratic U.S. <a class=\"zem_slink\" title=\"Kay Hagan\" href=\"http:\/\/www.hagan.senate.gov\/\" target=\"_blank\" rel=\"homepage\">Sen. Kay Hagan<\/a>, said he and state Senate leader <a class=\"zem_slink\" title=\"Philip E. Berger\" href=\"http:\/\/en.wikipedia.org\/wiki\/Philip_E._Berger\" target=\"_blank\" rel=\"wikipedia\">Phil Berger<\/a>, also a Republican, would appeal the ruling to the <a class=\"zem_slink\" title=\"Supreme Court of the United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8907083333,-77.0043444444&amp;spn=0.01,0.01&amp;q=38.8907083333,-77.0043444444 (Supreme%20Court%20of%20the%20United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">U.S. Supreme Court<\/a>.<\/strong><\/p>\n<p>The article at Yahoo attempts to portray the passage of this law as a political issue related to the Republicans wanting to take the Senate. The question we need to ask is, &#8220;Why does ensuring the integrity of our elections give a political advantage to Republicans?&#8221;<\/p>\n<p>The new North Carolina voting law is a step toward more honest elections.
