Earlier this year, the <a class=\"zem_slink\" title=\"American Civil Liberties Union\" href=\"http:\/\/www.aclu.org\/\" target=\"_blank\" rel=\"homepage\">American Civil Liberties Union (ACLU)<\/a> filed a request with the <a class=\"zem_slink\" title=\"Sarasota, Florida\" href=\"http:\/\/maps.google.com\/maps?ll=27.3372222222,-82.5352777778&amp;spn=0.1,0.1&amp;q=27.3372222222,-82.5352777778 (Sarasota%2C%20Florida)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Sarasota, Florida<\/a>, police department for information detailing its use of a surveillance tool known as stingray. Federal authorities then seized the documents before the police department could release them.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>The ACLU had an appointment last Tuesday to review documents pertaining to a case investigated by a Sarasota <a class=\"zem_slink\" title=\"Detective\" href=\"http:\/\/en.wikipedia.org\/wiki\/Detective\" target=\"_blank\" rel=\"wikipedia\">police detective<\/a>. But marshals swooped in at the last minute to grab the records, claiming they belong to the <a class=\"zem_slink\" title=\"United States Marshals Service\" href=\"http:\/\/www.usmarshals.gov\" target=\"_blank\" rel=\"homepage\">U.S. Marshals Service<\/a> and barring the police from releasing them.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>ACLU staff attorney Nathan Freed Wessler called the move \u201ctruly extraordinary and beyond the worst transparency violations\u201d the group has seen regarding documents detailing police use of the technology.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cThis is consistent with what we\u2019ve seen around the country with federal agencies trying to meddle with public requests for stingray information,\u201d Wessler said, noting that federal authorities have in other cases invoked the <a class=\"zem_slink\" title=\"Homeland Security Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Homeland_Security_Act\" target=\"_blank\" rel=\"wikipedia\">Homeland Security Act<\/a> to prevent the release of such records. \u201cThe feds are working very hard to block any release of this information to the public.\u201d<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Stingrays, also known as <a class=\"zem_slink\" title=\"International mobile subscriber identity\" href=\"http:\/\/en.wikipedia.org\/wiki\/International_mobile_subscriber_identity\" target=\"_blank\" rel=\"wikipedia\">IMSI<\/a> catchers, simulate a cellphone tower and trick nearby mobile devices into connecting with them, thereby revealing their location. A stingray can see and record a device\u2019s unique ID number and traffic data, as well as information that points to its location. By moving a stingray around, authorities can triangulate a device\u2019s location with greater precision than is possible using data obtained from a carrier\u2019s fixed tower location.<\/strong><\/p>\n<p>The issue here is the fact that a police detective obtained permission to use a stingray by filing a &#8216;tap and trace&#8217; request rather than a probable-cause warrant.<\/p>\n<p>The article further reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>The government has long asserted it doesn\u2019t need a probable-cause warrant to use stingrays because the device doesn\u2019t collect the content of phone calls and text messages, but instead operates like pen-registers and trap-and-traces, collecting the equivalent of header information. The ACLU and others argue that the devices are more invasive than a trap-and-trace.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Recently, the <a class=\"zem_slink\" title=\"Tallahassee Police Department\" href=\"http:\/\/en.wikipedia.org\/wiki\/Tallahassee_Police_Department\" target=\"_blank\" rel=\"wikipedia\">Tallahassee police department<\/a> revealed it had <a href=\"http:\/\/www.wired.com\/2014\/03\/stingray\/\">used stingrays at least 200 times since 2010<\/a> without telling any judge because the device\u2019s manufacturer made the police department sign a <a class=\"zem_slink\" title=\"Employee Nondisclosure Agreement\" href=\"http:\/\/www.legalzoom.com\/legalforms\/employee-nondisclosure-agreement\" target=\"_blank\" rel=\"legalzoom\">non-disclosure agreement<\/a> that police claim prevented them from disclosing use of the device to the courts.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The ACLU has filed numerous records requests with police departments around the country in an effort to uncover how often the devices are used and how often courts are told about them.<\/strong><\/p>\n<p>I definitely agree with the ACLU on this. I have no problem with the use of stingrays when probable-cause warrants are obtained, but without those warrants, the use of stingrays is simply another intrusion into the civil rights of Americans by the government.
