{"id":22064,"date":"2014-02-28T15:43:13","date_gmt":"2014-02-28T20:43:13","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=22064"},"modified":"2014-02-28T15:43:13","modified_gmt":"2014-02-28T20:43:13","slug":"hecklers-veto","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=22064","title":{"rendered":"Heckler&#8217;s Veto"},"content":{"rendered":"<p>Today&#8217;s <a href=\"http:\/\/dailycaller.com\/2014\/02\/28\/america-2014-students-have-no-right-to-wear-american-flag-apparel-because-some-mexicans-might-be-offended\/\" target=\"_blank\">Daily Caller<\/a> posted a story about the <a class=\"zem_slink\" title=\"United States Court of Appeals for the Ninth Circuit\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Court_of_Appeals_for_the_Ninth_Circuit\" target=\"_blank\" rel=\"wikipedia\">U.S. Ninth Circuit Court of Appeals<\/a> decision to uphold a <a class=\"zem_slink\" title=\"California\" href=\"http:\/\/maps.google.com\/maps?ll=37.0,-120.0&amp;spn=10.0,10.0&amp;q=37.0,-120.0 (California)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">California<\/a> high school\u2019s ban on American flag T-shirts on <a class=\"zem_slink\" title=\"Cinco de Mayo\" href=\"http:\/\/en.wikipedia.org\/wiki\/Cinco_de_Mayo\" target=\"_blank\" rel=\"wikipedia\">Cinco de Mayo<\/a>.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Officials at <a class=\"zem_slink\" title=\"Live Oak High School (Morgan Hill, California)\" href=\"http:\/\/maps.google.com\/maps?ll=37.1477,-121.6355&amp;spn=0.01,0.01&amp;q=37.1477,-121.6355 (Live%20Oak%20High%20School%20%28Morgan%20Hill%2C%20California%29)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Live Oak High School<\/a> banned <a class=\"zem_slink\" title=\"Flag of the United States\" href=\"http:\/\/en.wikipedia.org\/wiki\/Flag_of_the_United_States\" target=\"_blank\" rel=\"wikipedia\">American flags<\/a> on May 5, 2010 because the year before there had been altercations between white students and Mexican students. There were American flags and chants of \u201c<a class=\"zem_slink\" title=\"United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">USA<\/a>.\u201d According to reports, there were also Mexican flags and kids running around saying, \u201cFuck them white boys. Let\u2019s f**k them up.\u201d<\/strong><\/p>\n<p>On Cinco de Mayo in 2010, students who showed up with American flags on their shirts were asked to turn the shirts inside out.<\/p>\n<p>The article concludes:<\/p>\n<p style=\"padding-left: 30px;\"><strong>As <a class=\"zem_slink\" title=\"UCLA School of Law\" href=\"http:\/\/www.law.ucla.edu\" target=\"_blank\" rel=\"homepage\">UCLA law<\/a> professor and Washington Post law blogger <a href=\"http:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2014\/02\/27\/not-safe-to-display-american-flag-in-american-high-school\/\" target=\"_blank\" rel=\"nofollow\">Eugene Volokh notes<\/a>, the <a class=\"zem_slink\" title=\"First Amendment to the United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/First_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">First Amendment<\/a> typically does not allow government entities to censor speech this way. However, order and tranquility are paramount in a school setting.\u00a0The Ninth Circuit\u2019s decision arguably accords with previous case law. At the same \u00a0time, it amounts to a \u201checkler\u2019s veto\u201d allowing violent people to co-opt the government into using its own compulsion to enact their desires.<\/strong><\/p>\n<p>I have a few problems with this. Why weren&#8217;t the Mexican students disciplined when they acted up? Why didn&#8217;t the school tell the Mexican students that the celebration would\u00a0 be cancelled unless they behaved? Were the Mexican students allowed to wear Mexican shirts? If a student is violent or threatening violence, why not punish that student instead of limiting the freedom of other students? Why weren&#8217;t violent students suspended? Other than that, the decision makes perfect sense.
