So what is this about?<\/p>\n<p>The <a href=\"http:\/\/www.aclu.org\/technology-and-liberty\/fact-sheet-us-constitution-free-zone\">ACLU Website<\/a> posted a fact sheet on these zones which states:<\/p>\n<ul type=\"disc\">\n<li><strong>Normally under the <a class=\"zem_slink\" title=\"Fourth Amendment to the United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/Fourth_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">Fourth Amendment<\/a> of the <a class=\"zem_slink\" title=\"United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">U.S. Constitution<\/a>, the American people are not generally subject to random and arbitrary stops and searches.\u00a0<\/strong><\/li>\n<li><strong>The border, however, has always been an exception.\u00a0 There, the longstanding view is that the normal rules do not apply.\u00a0 For example the authorities do not need a warrant or probable cause to conduct a \u201croutine search.\u201d\u00a0<\/strong><\/li>\n<li><strong>But what is \u201cthe border\u201d?\u00a0 According to the government, it\u00a0 is a 100-mile wide strip that wraps around the \u201cexternal boundary\u201d of the United States.\u00a0<\/strong><\/li>\n<li><strong>As a result of this claimed <a class=\"zem_slink\" title=\"Authority\" href=\"http:\/\/en.wikipedia.org\/wiki\/Authority\" target=\"_blank\" rel=\"wikipedia\">authority<\/a>, individuals who are far away from the border, American citizens traveling from one place in America to another, are being stopped and harassed in ways that our Constitution does not permit.<\/strong><\/li>\n<li><strong>Border Patrol has been setting up checkpoints inland \u2014 on highways in states such as <a class=\"zem_slink\" title=\"California\" href=\"http:\/\/maps.google.com\/maps?ll=37.0,-120.0&amp;spn=10.0,10.0&amp;q=37.0,-120.0 (California)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">California<\/a>, <a class=\"zem_slink\" title=\"Texas\" href=\"http:\/\/maps.google.com\/maps?ll=31.0,-100.0&amp;spn=10.0,10.0&amp;q=31.0,-100.0 (Texas)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Texas<\/a> and Arizona, and at ferry terminals in <a class=\"zem_slink\" title=\"Washington (state)\" href=\"http:\/\/maps.google.com\/maps?ll=47.5,-120.5&amp;spn=3.0,3.0&amp;q=47.5,-120.5 (Washington%20%28state%29)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Washington State<\/a>. Typically, the agents ask drivers and passengers about their citizenship.\u00a0 Unfortunately, our courts so far have permitted these kinds of checkpoints \u2013 legally speaking, they are \u201cadministrative\u201d stops that are permitted only for the specific purpose of protecting the nation\u2019s borders.\u00a0 They cannot become general drug-search or other law enforcement efforts.\u00a0<\/strong><\/li>\n<li><strong>However, these stops by <a class=\"zem_slink\" title=\"United States Border Patrol\" href=\"http:\/\/www.cbp.gov\/xp\/cgov\/border_security\/border_patrol\/\" target=\"_blank\" rel=\"homepage\">Border Patrol agents<\/a> are not remaining confined to that border security purpose.\u00a0 On the roads of California and elsewhere in the nation \u2013 places far removed from the actual border \u2013 agents are stopping, interrogating, and searching Americans on an everyday basis with absolutely no suspicion of wrongdoing.<\/strong><\/li>\n<li><strong>The bottom line is that the extraordinary authorities that the government possesses at the border are spilling into regular American streets.<\/strong><\/li>\n<\/ul>\n<p>This is disturbing.<\/p>\n<p>The article also states:<\/p>\n<p style=\"padding-left: 30px;\"><strong>This trend is also typical of the <a class=\"zem_slink\" title=\"Presidency of George W. Bush\" href=\"http:\/\/en.wikipedia.org\/wiki\/Presidency_of_George_W._Bush\" target=\"_blank\" rel=\"wikipedia\">Bush Administration<\/a>\u2019s dragnet approach to law enforcement and national security.\u00a0 Instead of intelligent, competent, targeted efforts to stop terrorism, illegal immigration, and other crimes, what we have been seeing in area after area is an approach that turns us all into suspects. This approach seeks to sift through the entire U.S. population in the hopes of encountering the rare individual whom the authorities have a legitimate interest in.<\/strong><\/p>\n<p>The article concludes:<\/p>\n<p style=\"padding-left: 30px;\"><strong>If the current generation of Americans does not challenge this creeping (and sometimes galloping) expansion of federal powers over the individual through the rationale of \u201cborder protection,\u201d we are not doing our part to keep alive the rights and freedoms that we inherited, and will soon find that we have lost some or all of their right to go about their business, and travel around inside their own country, without interference from the authorities.<\/strong><\/p>\n<p>Notice that the date on this is 2008. As far as I know, the Obama Administration has continued the policies of the Bush Administration in this area and added other forms of surveillance as well.
