{"id":19532,"date":"2013-07-03T08:08:33","date_gmt":"2013-07-03T12:08:33","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=19532"},"modified":"2013-07-03T08:08:33","modified_gmt":"2013-07-03T12:08:33","slug":"delaying-a-major-provision-of-obamacare-for-a-year","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=19532","title":{"rendered":"Delaying A Major Provision Of ObamaCare For A Year"},"content":{"rendered":"<p>This article is based on three articles&#8211;one posted at <a href=\"http:\/\/www.breitbart.com\/Big-Government\/2013\/07\/02\/White-House-Illegally-Delays-Employer-Mandate-to-Avoid-2014-Election-Disaster-and-Grow-Government-Run-Exchanges\">Breitbart.com<\/a> yesterday, one posted at the <a href=\"http:\/\/dailycaller.com\/2013\/07\/02\/obamacare-employer-mandate-implementation-postponed\/\">Daily Caller<\/a> yesterday, and one posted in the <a href=\"http:\/\/www.washingtonpost.com\/blogs\/right-turn\/wp\/2013\/07\/02\/eight-reasons-obamacares-delay-is-a-huge-deal\/\">Washington Post<\/a> yesterday.<\/p>\n<p>The Obama Administration has announced that it will delay the implementation of the <a class=\"zem_slink\" title=\"Health insurance mandate\" href=\"http:\/\/en.wikipedia.org\/wiki\/Health_insurance_mandate\" target=\"_blank\" rel=\"wikipedia\">Employer Mandate<\/a> part of <a class=\"zem_slink\" title=\"Patient Protection and Affordable Care Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Patient_Protection_and_Affordable_Care_Act\" target=\"_blank\" rel=\"wikipedia\">ObamaCare<\/a> for a year&#8211;it was scheduled to go into effect in January 2014. It will now go into effect in January 2015.<\/p>\n<p><a class=\"zem_slink\" title=\"The Daily Caller\" href=\"http:\/\/www.dailycaller.com\" target=\"_blank\" rel=\"homepage\">The Daily Caller<\/a> reports the <a class=\"zem_slink\" title=\"Presidency of Barack Obama\" href=\"http:\/\/www.whitehouse.gov\/\" target=\"_blank\" rel=\"homepage\">Obama Administration&#8217;s<\/a> explanation for the change:<\/p>\n<p style=\"padding-left: 30px;\"><strong>A <a href=\"http:\/\/www.whitehouse.gov\/blog\/2013\/07\/02\/we-re-listening-businesses-about-health-care-law\" target=\"_blank\" rel=\"nofollow\">blog post<\/a> by White House senior adviser <a class=\"zem_slink\" title=\"Valerie Jarrett\" href=\"http:\/\/en.wikipedia.org\/wiki\/Valerie_Jarrett\" target=\"_blank\" rel=\"wikipedia\">Valerie Jarrett<\/a> on the <a class=\"zem_slink\" title=\"blog\" href=\"http:\/\/www.whitehouse.gov\/blog\" target=\"_blank\" rel=\"homepage\">White House blog<\/a> explained that the goal of the postponement is to help \u201c[cut] the red tape\u201d in the \u201creporting process\u201d for employers, and to give employers \u201cmore time to comply.\u201d The changes come as a response to concerns expressed in \u201congoing discussions with businesses\u201d that \u201cyou need the time to get this right,\u201d Jarrett wrote.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cIt will allow us to consider ways to simplify the new reporting requirements consistent with the law,\u201d <a href=\"http:\/\/www.treasury.gov\/connect\/blog\/Pages\/Continuing-to-Implement-the-ACA-in-a-Careful-Thoughtful-Manner-.aspx\" target=\"_blank\" rel=\"nofollow\">wrote Mark Mazur<\/a>, assistant secretary for Tax Policy at the <a class=\"zem_slink\" title=\"United States Department of the Treasury\" href=\"http:\/\/maps.google.com\/maps?ll=38.8983333333,-77.0341666667&amp;spn=0.01,0.01&amp;q=38.8983333333,-77.0341666667 (United%20States%20Department%20of%20the%20Treasury)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">U.S. Department of the Treasury<\/a>, in announcing the decision. \u201cSecond, it will provide time to adapt health coverage and reporting systems while employers are moving toward making health coverage affordable and accessible for their employees.\u201d<\/strong><\/p>\n<p>However, there seems to be another side of the story.<\/p>\n<p>The article at Breitbart reports that the pushing back of this deadline is illegal.<\/p>\n<p>Breitbart reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>And the Employer Mandate is <em>mandatory<\/em>. The law Congress wrote explicitly commands that this provision takes effect in January 2014. The ACA (ObamaCare) does not permit the government to grant a reprieve or an extension.\u00a0\u00a0\u00a0<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>Yet in a blatantly illegal move, the Obama administration is presuming to rewrite the ACA by choosing not to enforce provisions that are causing visible problems. The <a class=\"zem_slink\" title=\"Internal Revenue Service\" href=\"http:\/\/www.irs.gov\" target=\"_blank\" rel=\"homepage\">IRS<\/a>\u2014which is tasked with enforcing the Employer Mandate\u2014will simply not enforce it until 2015. Every large employer in the country is under the mandate. If they don\u2019t comply, then they are breaking federal law.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>But the IRS not enforcing Section 1513 is like a policeman who patrols a stretch of road who says for the next year, he won\u2019t issue any speeding tickets. He has no authority to suspend the law, but if he chooses to violate his duty by failing to enforce the law, then to all the motorists on the road it\u2019s as if the law does not exist.<\/strong><\/p>\n<p>There are two main political motives for this move. First of all, the implementation of ObamaCare is not going smoothly, and it is to the political advantage of the party that passed the law (Democrats) to push off at least one major problem in implementation until after the 2014 mid-term elections. Secondly, because employers will not be forced to provide health insurance, employees will be faced with a choice&#8211;join the government run healthcare exchanges (sky-high premiums) or pay a fine (much lower). The government is hoping that if employers are not required to provide health insurance for employees, employees will be driven into the government-run healthcare exchanges.<\/p>\n<p>Breitbart reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>It\u2019s worth noting that the ACA (ObamaCare) only subsidizes insurance policies on an exchange run by a state. Yet 34 states have refused to join this government-run debacle, so in those states the U.S. Department of Health and Human Services (HHS) will set them up.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>This is why the IRS issued a regulation last year saying that these tax credits for state-run exchanges also extend to HHS-run exchanges. Several lawsuits are now underway challenging the IRS Rule, and they should quickly lead to federal courts striking down the regulation.<\/strong><\/p>\n<p>The bottom line here is simple&#8211;ObamaCare is a mess&#8211;politically and practically. Politically, the fact that the law was passed by a parliamentary technicality with only <a class=\"zem_slink\" title=\"Democratic Party (United States)\" href=\"http:\/\/www.democrats.org\/\" target=\"_blank\" rel=\"homepage\">Democrat<\/a> votes may come back to bite the Democrats as the problems with the law become evident. Practically, the law does not seem to be well thought out or well written.
