{"id":18839,"date":"2013-05-18T07:14:06","date_gmt":"2013-05-18T11:14:06","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=18839"},"modified":"2013-05-18T07:14:06","modified_gmt":"2013-05-18T11:14:06","slug":"why-we-need-to-drastically-shrink-the-internal-revenue-service-not-expand-it","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=18839","title":{"rendered":"Why We Need To Drastically Shrink The Internal Revenue Service&#8211;Not Expand It"},"content":{"rendered":"<p>Yesterday the <a href=\"http:\/\/www.washingtontimes.com\/news\/2013\/may\/17\/irs-sued-seizing-60-million-medical-records\/\">Washington Times<\/a> reported that someone is actually suing the <a class=\"zem_slink\" title=\"Internal Revenue Service\" href=\"http:\/\/www.irs.gov\" target=\"_blank\" rel=\"homepage\">Internal Revenue Service (IRS)<\/a>. Turn about is fair play! So what did the IRS do that resulted in a lawsuit.<\/p>\n<p>The lawsuit charges that the IRS violated the <a class=\"zem_slink\" title=\"Fourth Amendment to the United States Constitution\" href=\"http:\/\/en.wikipedia.org\/wiki\/Fourth_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"wikipedia\">Fourth Amendment<\/a>. The Fourth Amendment states:<\/p>\n<p style=\"padding-left: 30px;\"><strong>The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by <a class=\"zem_slink\" title=\"Affirmation in law\" href=\"http:\/\/en.wikipedia.org\/wiki\/Affirmation_in_law\" target=\"_blank\" rel=\"wikipedia\">Oath or affirmation<\/a>, and particularly describing the place to be searched, and the persons or things to be seized.<\/strong><\/p>\n<p>The article explains:<\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8230;(IRS) agents executed a <a class=\"zem_slink\" title=\"Search warrant\" href=\"http:\/\/en.wikipedia.org\/wiki\/Search_warrant\" target=\"_blank\" rel=\"wikipedia\">search warrant<\/a> for financial data on one employee \u2013 and that led to the seizure of information on 10 million, including state judges.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The search warrant did not specify that the <a href=\"http:\/\/www.washingtontimes.com\/topics\/internal-revenue-service\/\">IRS<\/a> could take medical information, <a href=\"http:\/\/www.washingtontimes.com\/topics\/united-press-international\/\">UPI<\/a> said. And information technology officials warned the <a href=\"http:\/\/www.washingtontimes.com\/topics\/internal-revenue-service\/\">IRS<\/a> about the potential to violate medical privacy laws before agents executed the warrant, the complaint said, as reported by <a href=\"http:\/\/www.washingtontimes.com\/topics\/united-press-international\/\">UPI<\/a>.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cDespite knowing that these medical records were not within the scope of the warrant, defendants threatened to \u2018rip\u2019 the servers containing the medical data out of the building if IT personnel would not voluntarily hand them over,\u201d the complaint states, <a href=\"http:\/\/www.washingtontimes.com\/topics\/united-press-international\/\">UPI<\/a> reported.<\/strong><\/p>\n<p>The article reports that the records taken could impact up to one in 25 Americans.<\/p>\n<p>Meanwhile, <a href=\"http:\/\/www.forbes.com\/sites\/theapothecary\/2013\/05\/17\/two-obamacare-mandates-that-dramatically-expand-the-internal-revenue-services-power\/\">Forbes Magazine<\/a> posted an article on Friday noting:<\/p>\n<p style=\"padding-left: 30px;\"><strong>&#8230;Obamacare dramatically expands the authority and the scope of the Internal Revenue Service. Two provisions in particular will require thousands of new IRS agents, and billions in funding, to enforce: the law\u2019s individual mandate, forcing most Americans to buy government-approved health insurance; and its employer mandate, forcing most employers to take money out of workers\u2019 paychecks to purchase costly health insurance on their behalf.<\/strong><\/p>\n<p>The IRS will be enforcing the individual mandate. We knew that. What you may not be aware of is that there are a number of exceptions to the individual mandate, and the IRS has to have a good deal of information about you to see if you are eligible for one of those exceptions&#8211;they are only collecting all of this personal information for your own good!<\/p>\n<p>The law is also written in a way that forces employers with 50 or more \u201cfull-time employees\u201d offer \u201cminimum essential coverage\u201d in an \u201caffordable\u201d manner. There are all sorts of rules and regulations surrounding this that also require the IRS to collect more information on all of us.<\/p>\n<p>The article in Forbes suggests a solution:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Others are suggesting that the duty to enforce the individual and employer mandates be taken out of IRS\u2019 hands and moved into another agency. But, to me, this doesn\u2019t make much sense. Do we really want <em>another<\/em> government agency to have sensitive information about our incomes and our insurance policies?<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>The only viable solution to this problem is to repeal the employer mandate altogether, and to replace the individual mandate with something else, like a <a href=\"http:\/\/www.forbes.com\/sites\/aroy\/2012\/03\/31\/whats-democrats-plan-b-if-the-individual-mandate-goes-down\/\">limited open enrollment period<\/a>, that does not require expanding the power and the authority of the IRS.<\/strong><\/p>\n<p><a class=\"zem_slink\" title=\"Patient Protection and Affordable Care Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Patient_Protection_and_Affordable_Care_Act\" target=\"_blank\" rel=\"wikipedia\">ObamaCare<\/a> will not be repealed unless it becomes an obstacle for Democrats running for office. Until the <a class=\"zem_slink\" title=\"United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">American<\/a> people make it clear that they will not vote for anyone who does not support the repeal of ObamaCare, we will be stuck with it. Even then, it may take a little time for politicians to get the message. The thing to remember is that there will be a point of no return&#8211;a place where ObamaCare has so totally impacted health care in America that it cannot be repealed.
