Justice Sonia Sotomayor rejected an emergency request for an <a class=\"zem_slink\" title=\"Injunction\" href=\"http:\/\/en.wikipedia.org\/wiki\/Injunction\" target=\"_blank\" rel=\"wikipedia\">injunction<\/a> to prevent HHS from enforcing the <a class=\"zem_slink\" title=\"Contraception\" href=\"http:\/\/en.wikipedia.org\/wiki\/Contraception\" target=\"_blank\" rel=\"wikipedia\">contraception<\/a> mandate on Hobby Lobby\u2019s Catholic owners.<\/p>\n<p>The article reports <a class=\"zem_slink\" title=\"Sonia Sotomayor\" href=\"http:\/\/en.wikipedia.org\/wiki\/Sonia_Sotomayor\" target=\"_blank\" rel=\"wikipedia\">Justice Sotomayor<\/a>&#8216;s justification for her decision:<\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cWhile the applicants allege they will face <a class=\"zem_slink\" title=\"Irreparable damage or injury\" href=\"http:\/\/en.wikipedia.org\/wiki\/Irreparable_damage_or_injury\" target=\"_blank\" rel=\"wikipedia\">irreparable harm<\/a> if they are forced to choose between complying with the contraception-coverage requirement and paying significant fines, they cannot show that an injunction is necessary or appropriate to aid our jurisdiction,\u201d Sotomayor wrote in a short opinion rejecting Hobby Lobby\u2019s request.<\/strong><\/p>\n<p>Because Hobby Lobby will not comply with the mandate, they are facing fines of $1.3 million a day beginning on January 1st. HHS cannot collect the money immediately, but Hobby Lobby is required to set the money aside. I can&#8217;t imagine a company not being harmed by taking $1.3 a day away from their operating cash.<\/p>\n<p>The article concludes:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Expect Hobby Lobby to keep pursuing the case, and keep an eye out for emergency requests from other appellate circuits.\u00a0 If one lands on the desk of <a class=\"zem_slink\" title=\"Antonin Scalia\" href=\"http:\/\/en.wikipedia.org\/wiki\/Antonin_Scalia\" target=\"_blank\" rel=\"wikipedia\">Antonin Scalia<\/a> or <a class=\"zem_slink\" title=\"Samuel Alito\" href=\"http:\/\/en.wikipedia.org\/wiki\/Samuel_Alito\" target=\"_blank\" rel=\"wikipedia\">Sam Alito<\/a>, the outcome could be quite different \u2014 and we may get an expedited <a class=\"zem_slink\" title=\"Supreme Court of the United States\" href=\"http:\/\/maps.google.com\/maps?ll=38.8907083333,-77.0043444444&amp;spn=0.01,0.01&amp;q=38.8907083333,-77.0043444444 (Supreme%20Court%20of%20the%20United%20States)&amp;t=h\" target=\"_blank\" rel=\"geolocation\">Supreme Court<\/a> argument out of it, even if it would still be preliminary.<\/strong><\/p>\n<p>The HHS mandate requiring companies to provide free contraception is government overreach at its worst.
