{"id":13899,"date":"2012-05-15T06:18:57","date_gmt":"2012-05-15T10:18:57","guid":{"rendered":"http:\/\/www.rightwinggranny.com\/?p=13899"},"modified":"2012-05-15T06:18:57","modified_gmt":"2012-05-15T10:18:57","slug":"american-businesses-get-a-break","status":"publish","type":"post","link":"https:\/\/www.rightwinggranny.com\/?p=13899","title":{"rendered":"American Businesses Get A Break"},"content":{"rendered":"<p><a href=\"http:\/\/thehill.com\/business-a-lobbying\/227327-federal-court-strikes-down-nlrbs-union-election-rule\">The Hill<\/a>\u00a0reported yesterday that <a class=\"zem_slink\" title=\"United States federal judge\" href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_federal_judge\" rel=\"wikipedia\" target=\"_blank\">U.S. District Judge<\/a> James Boasberg has struck down the <a class=\"zem_slink\" title=\"National Labor Relations Board\" href=\"http:\/\/www.nlrb.gov\/\" rel=\"homepage\" target=\"_blank\">National Labor Relations Board<\/a> (NLRB) rule that would have shortened the time frame between a union approaching a company to unionize and\u00a0the vote of unionization. The lawsuit against the rule was supported by\u00a0the <a class=\"zem_slink\" title=\"United States Chamber of Commerce\" href=\"http:\/\/www.uschamber.com\/\" rel=\"homepage\" target=\"_blank\">U.S. Chamber of Commerce<\/a> and the Coalition for a Democratic Workplace.<\/p>\n<p>The judge struck down the rule based n the fact that the NLRB only had two members when it passed the rule&#8211;three are needed to form a quorum.<\/p>\n<p>The article reports:<\/p>\n<p style=\"padding-left: 30px;\"><strong>Trade associations praised the court ruling Monday.<\/strong><\/p>\n<p style=\"padding-left: 30px;\"><strong>\u201cIn their rush to conclude their rulemaking before the end of Board Member Becker\u2019s recess appointment, the board took shortcuts in the process, and the court rightly ruled that the rule is invalid because the board lacked the necessary quorum to conduct business,\u201d said David French, senior vice president for government relations for the <a class=\"zem_slink\" title=\"National Retail Federation\" href=\"http:\/\/en.wikipedia.org\/wiki\/National_Retail_Federation\" rel=\"wikipedia\" target=\"_blank\">National Retail Federation<\/a> (NRF), in a statement.<\/strong><\/p>\n<p>The problem with the law was that it did not give companies enough time to explain to employees what the downside of unionization would be. The other thing to note here is that the rule was struck down because of the way it was passed&#8211;not on the merits of the rule. That means that if the composition of the NLRB changes in the future so that it is entirely pro-union, this rule will probably go into effect.
