Things To Keep In Mind

Yesterday The Daily Signal posted an article about the impending impeachment trial. The article is a summation of things to keep in mind as the trial progresses. Please follow the link to read the entire article. I will try to hit some of the high points here.

The article reports:

1. Senate Majority Leader Mitch McConnell, R-Ky., announced that the trial itself will begin at 1 p.m. Tuesday.

The Clinton impeachment took five weeks, and Johnson’s lasted 11 weeks. The Senate’s impeachment trial rules, adopted in 1986, mandate that the trial should begin at noon and last until the Senate decides to adjourn, Monday through Saturday, “until final judgment shall be rendered.”

2. When the trial begins, the Senate will adopt a resolution establishing the specific timetable, including the time allotted for each side to present its case, senators to ask questions, and the Senate to consider motions.

At that point, if the Senate follows the general pattern of the Clinton trial, the Senate will vote on a motion to dismiss the impeachment and, if that motion fails, on whether additional witnesses or evidence should be considered.

During Johnson’s impeachment trial, the prosecution and defense called a total of 41 witnesses. During the Clinton trial, three witnesses provided videotaped testimony.

McConnell and several other Senate Republicans have indicated they think the Senate should rely on transcripts of the testimony of witnesses who appeared before the House, while Minority Leader Chuck Schumer, D-N.Y., and several other Democrats have demanded that witnesses be called to testify.

3. Clinton likewise did not appear before the Senate during his trial.

Trump previously indicated he would “strongly consider” testifying or providing a written statement to the House during its impeachment inquiry, but that didn’t happen. Odds are, Trump won’t be present at the Senate trial.

4. Similarly, the rules of evidence used in criminal trials do not apply in an impeachment trial. The Senate’s impeachment trial rules state that the Senate’s presiding officer has the authority to rule on questions of evidence.

Any senator, however, may ask that the full Senate vote on such matters. That reflects the Constitution’s assignment to the Senate of “the sole Power to try all Impeachments.”

5. There have already been calls for the House managers to move to disqualify senators whose impartiality is in question. There is no basis in the Constitution, Senate rules, or history for such an attempt.

The only qualification for participating in a Senate impeachment trial is to be a senator.

6. Removal from office is automatic upon conviction, and the Senate may vote separately whether to disqualify the defendant from serving in any other federal office.

The Constitution explicitly provides, however, that these consequences by the Senate do not, if the defendant’s conduct is also criminal, prevent “Indictment, Trial, Judgment and Punishment, according to Law.”

7. In theory, he likely could be retried in the future. Although neither the Constitution nor Senate rules address this issue, and no precedent exists for it, a few legal scholars, such as former Obama administration official Neal Katyal, have pointed out that the Fifth Amendment Double Jeopardy Clause does not apply to impeachment proceedings. 

8. Senate committees may hold hearings in the morning of each trial day, but doing any business such as sending bills, nominations, or other matters to the full Senate would require the consent of all senators.

The Senate impeachment rules provide that the chamber must suspend its legislative and executive business while the trial is under way.

One thing to consider in all of this is that the House of Representative’s evidence was generally hearsay evidence. Because impeachment does not follow the rules of evidence, it is possible that some of that evidence will be introduced. However, do Senators really want to go back to their districts to say that they voted for impeachment because a witness ‘felt’ that the President was thinking something that might have been against the law? Realistically, we also need to realize that there is an element of the Democrat party that will continue to do everything it can to destroy President Trump and his agenda regardless of what happens in the impeachment trial. At some point you have to wonder why successful economic and foreign policies are such a threat to the Democrat party.

Presenting A Deceptive Brief

Yesterday Byron York posted an editorial at The Washington Examiner about the impeachment brief Democratic House managers have compiled. The title of the article at The Washington Examiner is, “Two deceptions at the heart of Democrats’ impeachment brief.”

The editorial notes:

Democrats insist on Trump’s immediate removal because, they argue, he was the knowing beneficiary of Russian help in the 2016 election, and if he is not thrown out of office right now, he will do it again. But in making their argument, Democrats make two critical mischaracterizations about Trump, Republicans, and 2016. One is flat-out wrong, while the other is misleading.

The one that is flat wrong is the Democrats’ assertion that Trump wanted Ukraine to investigate “a debunked conspiracy theory that Russia did not interfere in the 2016 presidential election to aid President Trump, but instead that Ukraine interfered in that election to aid President Trump’s opponent, Hillary Clinton.”

The problem is, the theory does not hold that Russia “did not interfere” in the 2016 election. There is a mountain of evidence that Russia interfered, and that has been the conclusion of every investigation into the matter, beginning with the first congressional probe, by the House Intelligence Committee under then-chairman Devin Nunes. The theory is that in addition to Russian interference, some people in Ukraine, including some government officials, also tried to influence the U.S. election. It was not a government-run effort, and it was on a far smaller scale than the Russian project, but it happened.

I don’t know if any of the available information about Ukrainian interference will ever make it out to the mainstream media, but there have been criminal trials in Ukraine that confirm that the government was involved in 2016 in support of Hillary Clinton. The information is out there, but most of the mainstream media has successfully avoided reporting it.

The editorial reports the second deception:

The other mischaracterization in the Democratic brief is the assertion that, in 2016, Trump “welcomed Russia’s election interference.” The brief quotes special counsel Robert Mueller’s report that the Trump campaign welcomed Russian help because it “expected it would benefit electorally from information stolen and released through Russian efforts.”

That’s not wrong — Trump did, in fact, welcome Russia-based leaks — but grossly out of context. The context is this: Trump welcomed Russia-based leaks about the Clinton campaign because the media were enthusiastically embracing and repeating Russian-based leaks about the Clinton campaign. Print, internet, TV, everyone, was accepting, repeating, and amplifying the material released by WikiLeaks from the Russian hack of top Clinton campaign official John Podesta.

Perhaps people have forgotten how prominently media organizations featured the Russia-based material.

The editorial then lists a number of examples of media hysteria about Russian during the 2016 election.

The article concludes:

Of course, the Times was not the only media organization to trumpet the Russia-based leaks. They all trumpeted the Russia-based leaks. Everyone was complicit. And that is what makes the Democratic charge against Trump so misleading. He wasn’t welcoming something that everyone else was condemning. He was welcoming something that everyone else was welcoming, too. And now, in retrospect, that is a terrible offense, part of the foundation for removing the president from office?

Neither mischaracterization in the Democratic brief is a mistake; Democratic prosecutors know full well what actually happened. But the mischaracterizations are necessary to build the case against the president, to show that he had corrupt motives in the Ukraine matter. They are, of course, not the entire case, but they are important. And they are wrong.

Any Congressman who enables this farce of an impeachment to continue needs to be voted out of office as soon as possible.

An Insurance Policy Against Shenanigans

Breitbart posted an article today about one of the rules that will apply in the impeachment trial of President Trump in the Senate.

The article reports:

Senate Majority Leader Mitch McConnell is as of now including in the U.S. Senate impeachment trial rules a “kill switch” that effectively allows for the president’s legal team to seek an immediate verdict or dismissal of the case should Democrats engage in any shenanigans like they did in the House process.

The revelation comes after the House finally late last week formally sent the Articles of Impeachment it adopted before Christmas—after holding them for more than a month without transmission—to the U.S. Senate, thereby triggering the start of a Senate trial. The Senate will formally commence its trial procedures in votes this coming week, and while some Republicans want to outright dismiss the charges altogether from the outset, others believe a trial should take place.

The article explains:

In other words, the big picture here is that it seems as though the Senate will move forward with an actual trial—details on a number of fronts on that as of yet to be determined—but that there will be one thing that is clear: If Schiff or the Democrats try anything untoward like they did in the House, the president and the Senate have the option to shut the whole thing down and blow it all up on them. That means Republicans hold the upper hand, and should things get crazy—while there are not currently enough votes to dismiss the trial or outright off the bat acquit Trump—after Democrat partisan gamesmanship there likely would be enough votes to dismiss the whole thing. Bad behavior, in a partisan way, from people such as Schiff and Nadler and other Democrats could drive more Republicans toward the motion to dismiss—the kill switch—if that ever becomes necessary.

The article concludes:

A former White House official added that including this “kill switch” in the resolution gives Senate Republicans the tools they need to help McConnell keep the trial on the straight and narrow.

“McConnell has proven time and time again he is a more effective Leader than Pelosi is Speaker,” the former Trump White House official told Breitbart News. “This resolution ensures the President and his team has every tool at their disposal.”

The even bigger picture here is that when it comes to the Senate trial, GOP senators—in particular McConnell—are taking an active role in ensuring it will be fair. They are leading the way in framing this.

Vice President Mike Pence, in an exclusive interview with Breitbart News late last week, made it clear that “when it comes to the Senate trial, it’ll be for the senators to decide [on witnesses and process], but I think the fact that you hear people talking about witnesses in the Senate just proves how weak the case underpinning the Articles of Impeachment really is.”

“The fact that we’ve heard they had an open-and-shut case, that despite the fact the American people can read the transcript, see the fact the president did nothing wrong, no quid pro quo, the military aid was released,” Pence added. “The American people have the facts. We heard that Congress did what the facts demanded, and now suddenly we hear Democrats saying they need more facts and they need more witnesses. My view on this is the American people see through all of this—the sham investigation followed by a partisan impeachment. They’re saying ‘enough is enough.’”

Hopefully the Senators will act with more decorum than the members of the House of Representatives.

The History Behind The Totally Misleading Headline

Yesterday The Gateway Pundit posted an article explaining the back story behind the reporting of the latest unforgivable crime committed by President Trump.

The article notes:

Earlier today Speaker Pelosi announced that NEW EVIDENCE by the GAO found that President Trump broke the law by not handing over tax-payer dollars to the corrupt Ukrainian government fast enough.

Pelosi made the announcement on Thursday morning during her impeachment briefing.

The Government Accountability Office issued their opinion on Thursday which just happened to be the same day that Democrats would slow walk their sham articles of impeachment over to the US Senate.
What a coincidence!

For the record… The GAO also accused Barack Obama of breaking the law back in 2014 for swapping 5 Gitmo terrorists for Bowe Bergdahl — but there was no impeachment.

So I guess a temporary delay of aid is less serious that setting terrorists free.

The article includes some perspective from the Office of Management and Budget (OMB)’s Director Russ Vought:

Director Vought:  This GAO opinion comes from the same people who said we couldn’t keep National Parks open during the shutdown. Recently GAO flipped its position twice in the last few months. We wouldn’t be surprised if they reverse again. Regardless, the Admin complied with the law at every step.

It is becoming obvious that the Democrats are desperate to hang some sort of crime on President Trump. We have an election in less than ten months–let the American voters decide.

Really Tacky

Breitbart reported the following yesterday:

Speaker of the House Nancy Pelosi (D-CA) declared herself “sad” as she used more than a dozen commemorative pens to sign the two articles of impeachment against President Donald Trump on Wednesday evening.

The occasion was “so sad, so tragic for our country,” Pelosi told reporters, noting the “difficult time in our country’s history.” She then approached a table that had been prepared with the documents, and two dishes full of pens for her to use — about half a dozen pens in each.

Pelosi then sat and signed the articles, one for “abuse of power” and one for “obstruction of Congress.” She applied each pen, paused every few seconds, switched pens, and then continued.

The two dishes were swapped out and replaced with two new ones after the first article of impeachment had been signed — presumably, different pens for different articles.

Despite pronouncing herself “sad,” Pelosi smiled throughout the signing.

She then handed out the pens to leaders of the Democratic Party caucus in the House, including House Intelligence Committee Chairman Rep. Adam Schiff (D-CA), House Judiciary Committee Chairman Rep. Jerry Nadler (D-NY), House Foreign Affairs Committee Chairman Rep. Eliot Engel (D-NY), and others.

Can you imaging the uproar if the Republicans had done this during the Clinton impeachment?

If You Depend On The Mainstream Media For Your News…

There are a lot of Americans who depend on The New York Times for their news. Generally these are well-educated people who respect the tradition of the Times as the newspaper of record. They are either unaware or unconcerned about the amount of false reporting that the Times has done in recent years. Essentially, the Americans who depend on The New York Times for their news are uninformed about what is true and what is false. Recently a story appeared in the news that illustrates the problem. The Russians have hacked into the records of Burisma, the Ukrainian energy company the hired Hunter Biden. The New York Times has the story and PJ Media has the story. It’s not the same story.

The New York Times notes:

It is not yet clear what the hackers found, or precisely what they were searching for. But the experts say the timing and scale of the attacks suggest that the Russians could be searching for potentially embarrassing material on the Bidens — the same kind of information that Mr. Trump wanted from Ukraine when he pressed for an investigation of the Bidens and Burisma, setting off a chain of events that led to his impeachment.

The Russian tactics are strikingly similar to what American intelligence agencies say was Russia’s hacking of emails from Hillary Clinton’s campaign chairman and the Democratic National Committee during the 2016 presidential campaign. In that case, once they had the emails, the Russians used trolls to spread and spin the material, and built an echo chamber to widen its effect.

Note that the emphasis is on the election–the corruption that has already been proven is not mentioned–it’s all about embarrassment.

PJ Media notes:

GRU is responsible for other high-profile hacks of the DNC and John Podesta. Seven GRU officers were indicted in 2018 for conspiring to interfere with the 2016 election.

The hacking attempts against Burisma began in early November, as the Democrats’ impeachment efforts increased the profile of the company and Biden’s conflict of interests.

It is not yet known what the hackers found or what they were looking for. The New York Times says that “experts say the timing and scale of the attacks suggest that the Russians could be searching for potentially embarrassing material on the Bidens.”

The PJ Media article concludes:

So what does this mean? Scott Rosenburg of Axios believes that awareness of the hacks “cuts both ways politically.” There are huge negative implications for Joe Biden and his presidential campaign, since “it means document dumps could happen at any time, with accompanying media frenzy and potentially damaging revelations.” Many on the left still believe—despite all evidence to the contrary—that Trump colluded with Russia in 2016, so Russian involvement with the hacks “means that any such revelations will come pre-tainted with a Russian label,” according to Rosenburg.

Despite the Russian connection, should damaging information be revealed, Biden’s campaign has the most to lose, as his repeated denials of knowledge of his son’s business dealings could be undercut by documentary evidence. New details about how Hunter Biden’s position on the board gave Burisma access to the White House during the Obama years may also be brought to light.

The New York Times is still beating the dead horse of collusion with the Russians (no evidence found in Mueller Report or since).  Unfortunately Americans are being misinformed by what was formerly ‘the paper of record.’

Interesting Take

On Friday, The Daily Wire posted an article about Trey Gowdy’s recent comments concerning the purpose of impeaching President Trump. The article points out that there is very little hope that President Trump will be impeached in the Senate and that there is very little chance that President Trump will not be re-elected. So what is the goal?

The article notes:

Former Rep. Trey Gowdy (R-SC) told Fox News’s Sean Hannity on Thursday that Democrats are not trying to remove President Donald Trump with impeachment, but instead are focused on kneecapping his second term by flipping the Senate so he can’t get anything done.

“Let’s skip over the process,” Gowdy said. “The process, the three month long inquiry investigation was laughable. But they voted. That’s the House’s prerogative. They voted, not a single Republican went along with them. In fact, they didn’t even keep all the Democrats. But the House exercised its prerogative and they impeached the president.”

“There is no mathematical way he is ever going to be convicted and they know that,” Gowdy continued. “So their goal cannot be to remove Donald Trump from office, it is to neuter his second term. I think he is going to win in November. It’s to neuter that second term by targeting the Cory Gardners and the Martha McSallys and the Thom Tillises and the Susan Collins and Joni Ernst because if Trump wins and doesn’t have the Senate then he is not going to get any judicial vacancies filled and he’s not going to replace a Supreme Court Justice if he or she retires.”

One of the major accomplishments of the Trump administration is the reshaping of the judiciary. President Trump has appointed a record number of judges to serve in the federal appeal courts.

On December 19th, The National Review reported:

Let’s first put the confirmation results in some statistical perspective. From 1981 through last year, the Senate confirmed an average of 45 judges, or 5.5 percent of the judiciary, per year. This year’s total is more than twice the annual average and constitutes 11.9 percent of the judiciary. It’s the second-highest confirmation total in a single year in American history.

Those 102 confirmations include 20 to the U.S. Court of Appeals, the third-highest annual total in history. President Donald Trump has appointed 50 appeals court judges in his first three years, compared to 55 appointed by President Barack Obama — in eight years. And this is only the second time in American history that the Senate has confirmed double-digit appeals court nominations three years in a row. The only downside is that only one current appeals court vacancy exists anywhere in the country right now, the fewest in more than four decades.

The Democrats understand that the legacy of judges will be a lasting legacy. They desperately need to take the Senate in order to stop the continuing confirmations of judges. That strategy is much more logical than a futile effort to unseat a President who is popular with most Americans (although hated by the Washington establishment).

An Interesting Take On Impeachment

The American Thinker posted an article today about the next step in the impeachment process.

The article notes:

The latest reporting I’ve seen is that the Senate will take up President Trump’s impeachment trial this week.  What’s wrong with that, you ask?  I’ve already said what’s wrong: the Schiff-Nadler Star Chamber violated President Trump’s Fifth Amendment rights to procedural due process, rendering the resulting impeachment articles null and void as “poisoned fruit.”  The GOP leadership should do what the Founders would have done: challenge the legal legitimacy of the impeachment articles.  The logic blueprint I will present below — Mr. Jefferson knew logic — will help make the case in court.

As we know, protecting the rights of the accused is of fundamental importance in a just legal system and is a key motivation behind the Fifth Amendment to the Constitution, which asserts that “[no person shall] be deprived of life, liberty, or property without due process of law.”  The Supreme Court has interpreted due process broadly to include:

    • procedural due process rights,
    • substantive due process rights, and
    • prohibition against vague laws
    • as the vehicle for the incorporation of the Bill of Rights.

Of concern here are only procedural due process rights (PDPRs), which include:

    1. An unbiased tribunal.
    2. Notice of the proposed action and the grounds asserted for it.
    3. The opportunity to present reasons for the proposed action not to be taken.
    4. The right to present evidence, including the right to call witnesses.
    5. The right to know the opposing evidence.
    6. The right to cross-examine adverse witnesses.
    7. A decision based only on the evidence presented.
    8. Opportunity to be represented by counsel.
    9. A requirement that the tribunal prepare a record of the evidence presented.
    10. A requirement that the tribunal prepare written findings of fact and the reasons for its decision.

I can sum this up with one question, “If you were on trial would you be happy to have the same rights as a defendant that President Trump was given by the House of Representatives?”

If the God-given rights that are supposed to be guaranteed by our Constitution matter, the impeachment case put together by the House of Representatives needs to be thrown out for not respecting those rights.

Dear Democratic Colleague,

For weeks now, Senate Republican Leader Mitch McConnell has been engaged in tactics of delay in presenting transparency, disregard for the American people’s interest for a fair trial and dismissal of the facts.

Yesterday, he showed his true colors and made his intentions to stonewall a fair trial even clearer by signing on to a resolution that would dismiss the charges.  A dismissal is a cover-up and deprives the American people of the truth.  Leader McConnell’s tactics are a clear indication of the fear that he and President Trump have regarding the facts of the President’s violations for which he was impeached.

The American people have clearly expressed their view that we should have a fair trial with witnesses and documents, with more than 70 percent of the public stating that the President should allow his top aides to testify.  Clearly, Leader McConnell does not want to present witnesses and documents to Senators and the American people so they can make an independent judgment about the President’s actions. 

Honoring our Constitution, the House passed two articles of impeachment against the President – abuse of power and obstruction of Congress – to hold the President accountable for asking a foreign government to interfere in the 2020 elections for his own political and personal gain.  

While the House was able to obtain compelling evidence of impeachable conduct, which is enough for removal, new information has emerged, which includes: 

·         On December 20, new emails showed that 91 minutes after Trump’s phone call with Ukrainian President Zelensky, a top Office of Management and Budget (OMB) aide asked the Department of Defense to “hold off” on sending military aid to Ukraine.

·         On December 29, revelations emerged about OMB Director and Acting Chief of Staff Mick Mulvaney’s role in the delay of aid, the effort by lawyers at the OMB, the Department of Justice and the White House to justify the delay, and the alarm that the delay caused within the Administration.

·         On January 2, newly-unredacted Pentagon emails, which we had subpoenaed and the President had blocked, raised serious concerns by Trump Administration officials about the legality of the President’s hold on aid to Ukraine. 

·         And on January 6, just this week, former Trump National Security Advisor John Bolton announced he would comply with a subpoena compelling his testimony.  His lawyers have stated he has new relevant information.  

I am very proud of the courage and patriotism exhibited by our House Democratic Caucus as we support and defend the Constitution.  I have asked Judiciary Committee Chairman Jerry Nadler to be prepared to bring to the Floor next week a resolution to appoint managers and transmit articles of impeachment to the Senate.  I will be consulting with you at our Tuesday House Democratic Caucus meeting on how we proceed further.  

In an impeachment trial, every Senator takes an oath to “do impartial justice according to the Constitution and laws.”  Every Senator now faces a choice: to be loyal to the President or the Constitution.  

No one is above the law, not even the President.

A Proposed Resolution By Senator Josh Hawley

The Gateway Pundit reported yesterday that Senator Josh Hawley has introduced a Resolution in the Senate regarding the delay of the House of Representative’s delay in forwarding the articles of impeachment to the Senate.

The Resolution states:

Title: Amending the Rules of Procedure and Practice in the Senate When Sitting on Impeachment Trials.

Resolved, That rule I of the Rules of Procedure and Practice in the Senate When Sitting on Impeachment Trials is amended to read as follows:

“I. Whensoever the Senate shall receive notice from the House of Representatives that managers are appointed on their part to conduct an impeachment against any person and are directed to carry articles of impeachment to the Senate, the Secretary of the Senate shall immediately inform the House of Representatives that the Senate is ready to receive the managers for the purpose of exhibiting such articles of impeachment, agreeably to such notice.

If, following adoption of such articles, the House of Representatives does not so notify the Senate or otherwise provide for such articles to be exhibited to the Senate within 25 calendar days from the date of adoption of such articles, as recorded in the Journal of the House of Representatives, such articles shall be deemed exhibited before the Senate and it shall be in order for any Senator to offer a motion to dismiss such articles with prejudice for failure by the House of Representatives to prosecute such articles. Such motion shall be adopted by an affirmative vote of a majority of the Senators, duly chosen and sworn, without debate by the yeas and nays, which shall be entered on the record.”.

The article provides background for the Resolution:

The Senate has adopted a set of 26 rules that govern all impeachment proceedings, known as the “Rules of Procedure and Practice in the Senate When Sitting on Impeachment Trials.” Those Rules presume prompt delivery of the articles of impeachment to the Senate following their adoption by the House. Historically, the House delivered articles of impeachment to the Senate for action almost simultaneously with the vote to impeach. During the Clinton impeachment, for example, the articles were transmitted to the Senate the same day they were approved. Consequently, the current Senate rules have no mechanism to address Speaker Pelosi’s unprecedented attempt to prevent a Senate trial by withholding the articles after the President has been impeached.

Speaker Pelosi’s gambit raises grave constitutional concerns. Article 1, Section 3 gives the Senate the “sole” power to try impeachment cases. But if the Speaker refuses to transmit the articles after the President has been impeached, she could prevent the Senate from exercising its constitutional prerogative, perhaps indefinitely.

Senator Hawley’s resolution would amend the Senate’s impeachment rules to prevent this abuse of the Constitution and protect the Senate’s sole power to try impeachment. The resolution would allow the Senate to dismiss for lack of prosecution any articles of impeachment that the House of Representatives has delayed transmitting for 25 calendar days or more. Under this new rule, any Senator would be entitled to move to dismiss once the allotted time period had elapsed. Any motion to dismiss would be voted upon by the full Senate.

This should provide the impetus for Speaker Pelosi to forward the articles of impeachment and stop this endless delay.

The Real Game

As you no doubt are aware, Senator Schumer has ‘uncovered’ documents that show that the Democrats need to call witnesses in the Senate in addition to witnesses that testified in the House of Representatives. While this is much ado about nothing, The Conservative Treehouse posted an article today that explains the actual goal of all the drama. The article is very detailed (including the full arguments from the House of Representatives asking for more witnesses and the Department of Justice’s response). As we suspected, albeit against much criticism, House counsel Doug Letter has responded to the DC Appeals Court arguing the forced testimony of White House counsel Don McGahn is needed for evidence in impeachment trial. [Court pdf Avail Here]

This court filing today bolsters the unspoken background motive for delayed House Impeachment Managers.  The House Judiciary Committee is using impeachment as support for their ongoing effort to gain: Don McGahn deposition, and Mueller grand jury material (6e).  The goal is opposition research; impeachment is a tool to establish legal standing to obtain it.  Everything else is chaff and countermeasures.

The Democrats are looking for a legal basis to continue their fishing expedition to gather campaign fodder for 2020.

The article continues:

This court filing bolsters CTH analysis that rushed House articles are a means to an end. That is – a way for House lawyers to argue in court all of the constitutionally contended material is required as evidence for pending judicial proceedings, a trial in the Senate.

This would explain why all the prior evidence debated for inclusion and legal additions to “articles of impeachment” were dropped. Instead the House focused only on quickly framing two articles that can facilitate pending court cases.

…REMINDER: The House Judiciary Committee (HJC) led by Chairman Jerry Nadler has been seeking: (1) Mueller grand jury material; (2) a deposition by former White House counsel Don McGahn; and less importantly (3) Trump financial and tax records.  Each of these issues is currently being argued in appellate courts (6e and McGahn) and the supreme court (financials/taxes).

Looking at the legal maneuvers from that perspective means the grand jury material is the unspoken goal and impeachment is simply the enhanced means to obtain it.

The 6(e) material relates to evidence gathered by the Mueller team for grand jury proceedings in their two-year effort to construct a case against President Trump.

Remember, the Mueller evidence was gathered during a counterintelligence investigation, which means all things Trump -including his family and business interests- were subject to unbridled surveillance for two years; and a host of intelligence gathering going back in time indefinitely. A goldmine of political opposition research.

Obviously if Jerry Nadler could get his hands on this material it would quickly find its way into the DNC, and ultimately to the 2020 democrat candidate for president. This material would also be fuel for a year of leaks to DC media who could exploit rumor, supposition, and drops of information that Andrew Weissmann and team left to be discovered.

The article highlights some of the Department of Justice response:

[…] “Pursuing an interbranch suit in court while simultaneously pursuing impeachment, and then using that litigation as part of the impeachment proceedings, is “far from the model of the traditional common-law cause of action at the conceptual core of the case-or-controversy requirement.” Raines v. Byrd, 521 U.S. 811, 833 (1997) (Souter, J., concurring). But that is exactly what the Committee has done. The effect of that choice is
to “embroil the federal courts in a power contest nearly at the height of its political tension.” Id.

Indeed, if this Court now were to resolve the merits question in this case, it would appear to be weighing in on a contested issue in any impeachment trial. That would be of questionable propriety whether or not such a judicial resolution preceded or post-dated any impeachment trial. Cf. Nixon v. United States, 506 U.S. 224, 232, 235-36 (1993).

The now very real possibility of this Court appearing to weigh in on an article of impeachment at a time when political tensions are at their highest levels—before, during, or after a Senate trial regarding the removal of a President—puts in stark relief why this sort of interbranch dispute is not one that has “traditionally thought to be capable of resolution through the judicial process.” Raines, 521 U.S. at 819.

This Court should decline the Committee’s request that it enter the fray and instead should dismiss this fraught suit between the political branches for lack of jurisdiction.

President Pelosi?

Yesterday The Gateway Pundit reported some recent comments by Adam Schiff to Rachel Maddow.

The article quotes the comments:

Adam Schiff: Well, we have acquired a piece of evidence, classified by Jennifer Williams, something she alluded to in her open testimony. Then going back and looking through her records she found other information that was pertinent to that phone call that we asked her about and made that submission. There is nothing that is classified in the document but the vice president’s office has said they are going to classify… It is not proper to classify something because it would be embarrassing or incriminating. And that submission does shed light on the vice president’s knowledge. We think the American people should see it.

The article notes:

During their conversation Schiff announced he was going after Vice President Mike Pence next and may have “acquired evidence” that the Vice President is hiding information in the House Ukrainian investigation.

If this sounds totally ridiculous (which it is), I would like to remind you of a quote from Maxine Waters (reported by Hot Air in September 2018):

“They say, ‘Maxine, please don’t say impeachment anymore.’

“And when they say that, I say impeachment, impeachment, impeachment, impeachment, impeachment, impeachment, impeachment, impeachment,” she said to applause.

Waters told the crowd she won’t stop with Trump.

“I had a conversation here today with someone asked, ‘Well, what about Pence? If you are able to impeach, Pence will be worse,’” she recollected.

“Well, I said, ‘Look, one at a time.’

“You knock one down, one at a time,” she said.

“You knock one down, and we’ll be ready for Pence. We’ll get him, too,” she vowed.

Jennifer Williams testified before Congress in November and offered nothing. She worked for Vice President Mike Pence. So now Schiff has Democrats thinking Williams holds the key to Pence’s impeachment.

It is a scary thought that the ultimate result of what the Democrats are trying to do would be to install Nancy Pelosi as President. Hopefully, what Adam Schiff is trying to do is impossible, but his comments are a frightening window into his thoughts. I guess Representative Schiff really does not care that nearly 63 million Americans voted for President Trump.

The Democrats in Congress seem intent on rewriting the Constitution and rewriting precedent on how things are supposed to be done. The latest rewrite involves the comment by Speaker of the House Nancy Pelosi that she will delay forwarding articles of impeachment to the Senate until she is convinced that the Senate trial will be fair. That is an amazing statement given the total unfairness of the trial in the House of Representatives, but it also goes against precedent. I am not a lawyer, but one lawyer who graduated from Harvard Law School has weighed in on what may happen next.

Yesterday Breitbart posted an article written by Joel B. Pollak about the legal aspect of what Speaker Pelosi is doing.

The article reports:

Speaker of the House Nancy Pelosi (D-CA) appears to be considering an idea Democrats have floated for several days of holding back the articles of impeachment to exercise leverage over the Senate and the president.

She declined formally to transmit the articles to the Senate on Wednesday evening after the House voted to impeach President Donald Trump.

Unfortunately for them, the Senate can act, regardless — and would vote to acquit.

That’s because the Constitution is absolutely clear about the Senate’s authority. Article I, Section 3 says: “The Senate shall have the sole Power to try all Impeachments.”

That is all.

The Chief Justice presides over a trial involving the president, but the Senate makes the rules. And the Senate is controlled by Majority Leader Mitch McConnell (R-KY), who regards what the House has done with contempt.

You’re in Cocaine Mitch’s court, now.

Politico outlined Democrats’ new idea, citing constitutional lawyer Laurence Tribe (but, interestingly, not the Constitution itself). Pelosi hopes to pressure McConnell into holding a “fair trial” — this, after she and her party broke every relevant House rule and precedent, and several Amendments in the Bill of Rights, all in the name of their “sole Power of Impeachment.”

They forget that a “fair trial” applies to the accused, not the accuser, and has since 1215.

The article notes the contradiction between what Speaker Pelosi is doing now and previous statements by House of Representatives regarding impeachment.

The article concludes:

If Pelosi refuses to submit the articles of impeachment to the Senate, McConnell can convene the Senate anyway, summon the Chief Justice, and swear in the Senators as jurors. Democrats can boycott, but they can’t stop the trial.

McConnell can then propose to dismiss the charges or even hold a vote to acquit the president.

Pelosi can hide the articles of impeachment in Adam Schiff’s basement forever, and it won’t make a bit of difference.

Stay tuned. This entire process has turned the Constitution on its head–from the rights of the accused, to vague articles of impeachment, to ignoring precedents involved in impeachment.

The Deflection Involved In Impeachment

One of the things the media became expert at during the Obama administration was deflection. They were good at it before then, but they perfected it during the Obama years. The current impeachment trial is one example of deflection.

On December 16th, The Federalist posted an article that tells a story that the Democrats in Congress have fought to avoid telling.

The article reports:

Robert Powell, the husband of Rep. Debbie Mucarsel-Powell, D-Fla., reportedly took $700,000 from a Ukrainian oligarch named Igor Kolomoisky. Mucarsel-Powell sits on the House Judiciary Committee, the committee that drafted two articles of impeachment against President Donald Trump for his alleged abuse of power with regards to Ukraine.

In 2018, the Daily Beast reported that a number of businesses linked to Kolomoisky hired Powell as an attorney. One of those firms paid Powell at least $700,000 over two years, according to public records.

The Miami Herald reported Powell was working for companies tied to Kolomoisky for 10 years. Powell made most of his money in the two years leading up to his wife’s election in 2018.

Kolomoisky has been accused of contract killings and embezzlement in the past. Yet, in 2018 when Mucarsel-Powell was running for her seat, she did not see her husband’s work as relevant to her campaign.

“Debbie Mucrasel-Powell is running for Congress, not her husband. To imply that Debbie has anything to do with her indirect shareholder of a parent company that once employed her husband is an enormous stretch,” said Michael Hernandez, senior communications advisor for her campaign in 2018.

While Mucrasel-Powell may have convinced her constituents that her husband’s work is unrelated, it is a clear conflict in the current impeachment of Trump. Mucarsel-Powell voted to impeach Trump.

The article concludes:

And yet, no Democrats see a problem with one of their own committee members’ spouses doing business with a Ukrainian ogliarch. There has been no check on whether Mucrasel-Powell is benefitting from her husband’s work with a foreign power that interfered in the 2016 election.

There is a double standard in Mucrasel-Powell’s ability to impeach the President for his work in Ukraine, simultaneously, allowing her husband to earn money from Kolomoisky, a thug from the same foreign power.

The alternative media still includes a number of investigative reporters. It is quite likely that more of this sort of information will be uncovered in the near future. We may be about to discover how someone can enter Congress as a member of the Middle Class and emerge ten years later as a millionaire on a salary of $174,000 while supporting a home in their district and one in Washington, D.C.

The New Standard–Expect A January Surprise

Yesterday Byron York posted an article at The Washington Examiner that previews what will happen when the impeachment trial moves to the Senate. It’s not a particularly optimistic article in terms of antics by the Democrats, although I think the eventual outcome will be the acquittal of President Trump.

The article reports:

With a House impeachment vote a foregone conclusion, the battle to remove President Trump from office has moved to the Senate. Minority Leader Chuck Schumer grabbed control of the debate Monday with demands for what he called “fairness” in the president’s trial.

I think Senator Schumer’s definition of fairness is, “Heads I win; tails you lose.”

The article continues:

Schumer wants the Senate to allow testimony from four witnesses the House did not interview: former national security adviser John Bolton, acting White House chief of staff Mick Mulvaney, key Mulvaney aide Robert Blair, and Office of Management and Budget official Michael Duffey. House Democratic impeachers wanted the men to testify, but after the White House, claiming privilege, refused, House leaders chose not to try to force them to appear. Going to court to compel their testimony, Democrats said, would take too much time.

Now, Schumer wants the witnesses simply to forget about privilege questions and testify in the Senate trial.

“How, on such a weighty matter, could we avoid hearing this, could we go forward without hearing it?” Schumer asked at a news conference Monday. “I haven’t seen a single good argument about why these witnesses shouldn’t testify — unless the president has something to hide and his supporters want that information hidden.”

Republicans will respond that the Senate is not the place for fact-finding — that is, for senators to become investigators and do what the House declined to do. Some will also note that the House chose not to seek the appointment of an outside investigator, a special counsel, to establish what happened in the Trump-Ukraine matter, and the Senate is ill-equipped to play that role. Many will also argue that the facts of the case do not align with the Democratic accusation of bribery and more testimony will not change that. Others will argue that they don’t believe what the president did rises to the level of an impeachable offense.

The technique the Democrats will use is the one we saw in the Kavanaugh confirmation hearing. The Democrats needs four Republicans to sign on to the idea of calling new witnesses (a simple majority vote is needed). Then they can dig up all the imaginary dirt on the President they can manufacture and totally taint the hearing. The idea is to damage President Trump to the point where the Democrats win the Presidency in 2020 and none of their misdeeds like government abuses of surveillance or violations of citizen’s civil rights will ever be dealt with. I am not sure Americans are stupid enough to buy what they are selling.

On a final note, I would like to share my prediction that Hillary Clinton will be the Democrat’s candidate for President in 2020.

Accidental Honesty?

The Gateway Pundit posted an article today that included a very telling quote from Speaker of the House Nancy Pelosi.

The article notes:

Pelosi admitted that the Mueller investigation was also about impeachment.

“The biggest criticism in this process has been the speed at which the House Democrats are moving,” a moderator from Politico’s “Women Rule” summit said to the Speaker this week.

Speed?” Pelosi said. “It’s been going on for 22 months, okay? Two and a half years actually.”

Pelosi continued, “But we’re not moving with speed. It was two and a half years ago that they initiated the Mueller investigation.”

When you consider the problems with the way the Mueller investigation was initiated, this is a very troubling statement. If you read the Inspector General’s Report and listen to the comments of Attorney General William Barr, you realize that the Mueller investigation did not start on solid ground. The entire Russian fiasco was based on illegal surveillance and baseless accusations. What Speaker Pelosi admitted is that the Democrats had planned to impeach President Trump as soon as he got elected. The text messages between Lisa Page and Peter Strzok were further proof of that. That behavior is more appropriate in a banana republic than a representative republic.

Let’s back up a  minute and look at where we are. The House Judiciary Committee has approved two articles of impeachment against President Trump. Next week the full House will vote on impeachment. At that point, it goes to the Senate for trial. There are a few options–it can be dismissed because of the civil rights violations in the House investigation, it can be voted on immediately and defeated (it is unlikely any Republicans will vote for impeachment, and it needs a two-thirds majority to pass), or the Senate can hold a full trial with witnesses. The third option is where the swamp comes into play. There are very few politicians in Washington with clean hands. If you pull the loose yarn on a sweater, are you in danger of unraveling the entire sweater? Joe Biden is not the only Congressman with family ties to Ukraine and other foreign nations. The full trial with witnesses is what needs to happen, but my guess is that much of the corruption in Washington will continue to be protected by those in charge, and a quick vote will be the choice of those in power.

Creative Editing Totally Changes The Meaning Of What Was Said

A website called The BL posted an article on Saturday that illustrates how the media can edit or take out of context a quote in order to change its meaning. The statement in question is the one being cited by Democrats to support their charge of ‘abuse of power’ leveled against President Trump.

The article reports:

As Breitbart News points out, CNN legal analyst and former Attorney General Elie Honig cited the clip edited in two special broadcasts explaining the case of the impeachment inquiry against Trump, one broadcast on Thursday and the other on Friday, Dec. 6.

In addition, MSNBC presenter and political commentator Chris Mathews played a similar video of Trump’s words on Wednesday during the “Hardball “program. And MSNBC host Joe Scarboroug again quoted the clip edited on “Morning Joe” on Thursday.

The problem is that the quote was totally taken out of context.

The article reports the context:

In the original video, the president explains, “Look, Article II, I would be allowed to fire Robert Mueller. Assuming I did all of the things, I said I want to fire him. Number one, I didn’t. He wasn’t fired.”

“Number one, very importantly but more importantly, Article II allows me to do whatever I want. Article II would allow me to fire him. I wasn’t going to fire him. You know why—because I watched Richard Nixon firing everybody and that didn’t work out too well,” the president explains in the clip, as picked up by Breitbart News.

Context matters. How many Americans have heard the fractured quote and believed it without having any idea of what was actually referenced? The press is obviously not doing its job of keeping Americans informed. Instead they are spouting propaganda to fit their own agenda.

I Don’t Think This Is The Right Answer

Breitbart reported yesterday that Senator Lindsey Graham has stated that he would work to end a Senate impeachment trial of President Donald Trump as soon as possible. That is not the right way to handle this. The American people have been bombarded with ‘impeach President Trump’ for almost three years. They have heard lie after lie and accusation after accusation about what the President is or has done. An impeachment trial in the Senate is probably the only chance the President will get to present the evidence which disputes those lies. We need a Senate trial that calls as witnesses the Ukrainian prosecutor that was fired, Hunter Biden, former Vice-President Joe Biden, Adam Schiff, Andrew Weissmann, Lisa Page, Peter Strzok, Andrew McCabe, James Comey, etc. These people need to be forced to testify under oath about their actions from 2016 forward. FISA Warrants need to be looked at.

The article reports:

Graham said, “Here’s what I’m going to do with the trial: I’m going to try to get it over as quickly as possible, listen to the House case — let them present their case. If there’s nothing new and dramatic, I would be ready to vote, and we can do all this other stuff in congressional oversight.”

He added, “I am saying that I’m going to end this as quickly as I can for the good of the country. When 51 of us say we’ve heard enough, the trial is going to end. The president’s going to be acquitted. He may want to call Schiff. He may want to call Hunter Biden. He may want to call Joe Biden. But here’s my advice to the president: if the Senate is ready to vote and acquit you, you should celebrate that. We can look at this other stuff outside of impeachment. Impeachment is tearing the country apart. I don’t want to give it any more credibility than it deserves.”

I totally disagree. It is time for the whole truth to come out. If those responsible for the attempted coup are not held responsible, their actions will be a template for the future removal of duly-elected presidents.

A Law Professor With Principles

The Gateway Pundit posted a link to Professor Jonathan Turley’s opening remarks at the Nadler impeachment panel on Wednesday. Professor Turley’s entire remarks can be found here.

These are a few of his opening comments:

Jonathan Turley:  I would like to start, perhaps incongruously, with a statement of three irrelevant facts. First, I am not a supporter of President Trump. I voted against him in 2016 and I have previously voted for Presidents Clinton and Obama. Second, I have been highly critical of President Trump, his policies, and his rhetoric, in dozens of columns. Third, I have repeatedly criticized his raising of the investigation of the Hunter Biden matter with the Ukrainian president. These points are not meant to curry favor or approval. Rather they are meant to drive home a simple point: one can oppose President Trump’s policies or actions but still conclude that the current legal case for impeachment is not just woefully inadequate, but in some respects, dangerous, as the basis for the impeachment of an American president. To put it simply, I hold no brief for President Trump. My personal and political views of President Trump, however, are irrelevant to my impeachment testimony, as they should be to your impeachment vote. Today, my only concern is the integrity and coherence of the constitutional standard and process of impeachment. President Trump will not be our last president and what we leave in the wake of this scandal will shape our democracy for generations to come. I am concerned about lowering impeachment standards to fit a paucity of evidence and an abundance of anger. If the House proceeds solely on the Ukrainian allegations, this impeachment would stand out among modern impeachments as the shortest proceeding, with the thinnest evidentiary record, and the narrowest grounds ever used to impeach a president.7 That does not bode well for future presidents who are working in a country often sharply and, at times, bitterly divided.

Democrats take note. You will not be in power forever and someday the tables will be turned. Would you put up with this bogus impeachment?

An Expert Opinion

Regardless of how you may feel about him, Newt Gingrich is a brilliant political mind. He posted an article at Fox News today about the move to impeach President Trump. I recommend that you follow the link to read the entire article, but I will try to highlight it here.

The article reports:

House Speaker Nancy Pelosi and the Democrats’ tunnel-vision focus on impeaching President Trump puts all of us, as Americans, at risk.

This may sound extreme, but I lay it all out in this week’s episode of “Newt’s World.”

Since the day Trump was elected president, Democrats have been formulating and executing the plot we have been watching unfold. After Trump won a massive electoral majority, Democrats started digging.

They have been determined to find something – anything – they can use to attack him. The central focus of all of this is to describe and define Trump as a corrupt president so often that people begin to accept the narrative. It’s not only the elected Democrats. Much of the intelligence community has been equally determined to “uncover” something on President Trump from the beginning.

The article continues:

As this plot against Trump has continued, the American system has been bypassed, ignored, or misused to the point where it has been put it in jeopardy. Democrats, political operatives, American intelligence officials and the media have been forcing a manufactured narrative on the American people. Specifically, a group of these intelligence officials are breaking the law by leaking secrets to the media (whose members gladly overlook these crimes so long as it lets them accuse the president of something new).

We have seen this pattern with the so-called Trump Towers in Moscow scandal, the Robert Mueller investigation, and now the Pelosi-Adam Schiff impeachment effort.

Make no mistake: This is not politics as usual. It’s a concerted effort by one political party, the Washington bureaucracy, and the media to overrule the American people.

The continuing attack on President Trump is dangerous to our Republic. This is an attempt to overthrow the results of a legitimate election. If those responsible are not brought to justice, our government will constantly be in chaos because false charges can be filed against any elected official at any time in an effort to remove him from office.

How Much Privacy Is A President Entitled To?

Hot Air posted an article today about the ongoing court battle regarding the Congressional subpoena of former White House Counsel Don McGahn. Counsel McGahn was summoned by the House Judiciary Committee to answer questions about the time he worked for President Trump.

The article reports:

Whether or not he would appear was a bone of contention for a while until a federal judge issued a dramatic proclamation on Monday, stating that “Presidents are not kings” and ordering McGahn to appear.

Well, that lasted for all of three days. By Wednesday evening, that same judge had backed down, allowing a request from the Justice Department to delay the implementation of the ruling until the appeals process has played out. Of course, this doesn’t mean McGahn (and the President) are totally off the hook, but they’ve at least bought a bit of breathing room. (Daily Mail)

The article concludes:

That doesn’t mean that the final decision on McGahn won’t cast a long shadow, however. How this plays out will have consequences for the ongoing impeachment circus. At issue here is the question of whether or not aides to the President are shielded from revealing details of private conversations they’ve had with the boss or the counsel they offered. Also, whether or not that shielding lasts indefinitely even after they’ve left their positions with the White House.

That sort of privacy has long been assumed to be part of the President’s executive privilege. But does that extend to investigations of potential criminal conduct? That’s the question that will be answered when the dust settles on McGahn’s subpoena. If he’s ordered to show up and testify, that could open the gate for numerous other Trump aides to be called in to talk about all of the Ukraine events. And that’s likely not something President Trump will want to see after we’re in the thick of the final push to next year’s election.

I guess my question is whether or not the President has the same civil rights as ordinary citizens, If you are an ordinary citizen, your conversations with your lawyer are protected by law. We saw this Constitutional principle violated when Michael Cohen’s offices were raided. Now the question is whether or not we are going to continue to violate President Trump’s Constitutional rights. All of us need to remember–if the President does not have Constitutional rights, then none of us have Constitutional rights.

When You Forget To Dot All Of Your I’s And Cross All Of Your T’s

Yesterday The Gateway Pundit posted an article about a letter sent from a group of Republican Congressmen to Adam Schiff. It seems that when the Democrats put together their rules for impeachment, they forgot to cross out a portion of those rules that they did not plan to include.

In his letter Rep. McCarthy cites House Rule XI, Cause 2(j)(1) The Minority Rule on calling witnesses. This rule allows the Minority to call any witnesses they want on at least one day of a congressional hearing, upon notifying the Committee chairman, which the Republicans did this morning.

…According to the rule Democrats must allow Republicans at least one day to call any witnesses they want for at least one day of testimony.

…Pelosi and her Lawfare crew of condescending coup criminals overlooked the rule and didn’t change or strike it when they changed the other House rules for impeachment!

The Minority Witness Rule (Clause 2(j)(1) of Rule XI) – The Minority is entitled to one additional day of related hearings at which to call their own witnesses if a majority of the Minority Members make their demand before the committee�s hearing is gaveled closed.

Trying To Track All Of The Moving Parts

Yesterday The Conservative Treehouse posted an article about the timelines involved in the respective strategies of the Democrats and Republicans in the impeachment saga. It is a very complex article, and I suggest that you follow the link above to read the entire article. However, I will try to list a few highlights here.

Today we have some new background to help see the narrative race and legal race. Pelosi and Schiff are not only racing the impeachment vote against the IG report, they are also racing against the Judicial branch wiping out all prior “impeachment inquiry” validity.

Effective at the end of business today the House is now in recess for the Thanksgiving holiday.

The article explains the calendar:

On December 9th the IG report on FISA abuse and DOJ/FBI corruption will be released. On December 11th Michael Horowitz will testify before the Senate Judiciary Committee.

So there are two races.

♦ One race within the Trump impeachment is for the narrative: Trump Impeachment -vs- DOJ/FISA corruption against Trump. This is the race everyone is discussing.

♦ The second race within the Trump impeachment is legal: Pelosi, Schiff and ultimately Nadler -vs- the Judicial branch. This is the race few are watching, but actually could be far more consequential because it could invalidate the entire HPSCI process.

The aforementioned mid-December House Impeachment Vote is not a vote to impeach President Trump. It is a vote at the end of their “inquiry”; and a vote to authorize the House Judiciary Committee to begin their “official” impeachment hearings.

The mid-December vote will be to authorize the House Judiciary Committee to begin the “official” impeachment hearings. Nancy Pelosi and Adam Schiff need this vote fast; they need this vote before they lose any court case that could make the “impeachment inquiry” invalid.

Additionally, Nancy Pelosi and House Judiciary Committee Chairman Jerry Nadler need this full House authorization vote to gain the authority to penetrate the constitutional firewall that protects the separation of power in the “official” impeachment investigation. And they are hoping that any loss in the three pending cases will not undermine the validity of the prior impeachment inquiry…. that’s an issue.

That’s why Pelosi, Schiff and Nadler need to get that mid-December House vote before they lose any SCOTUS ruling. There are three cases, each of them appears heading to the Supreme Court; one is already there.

Breitbart posted an article today about the passing of the United States-Mexico-Canada (USMCA) trade agreement.

The article reports:

House Speaker Nancy Pelosi (D-CA) said during a press conference Thursday that she remains skeptical about the House passing the United States-Mexico-Canada (USMCA) trade agreement this year, as Congress’s lower chamber continues to focus on the impeachment inquiry into President Donald Trump.

Speaker Pelosi cast doubt during the presser that Congress has enough time to pass the USMCA in 2019.

“I’m not even sure if we came to an agreement today that it would be enough time to finish [this year], but just depends on how much agreement we come to,” Pelosi said.

Last week, she said that a deal on USMCA was “imminent.”

“I’m eager to get this done,” the California Democrat said.

The USMCA’s delayed passage through the House arises as Pelosi and House Intelligence Committee chairman Adam Schiff (D-CA) have launched an impeachment inquiry into President Trump.

Speaker Pelosi and House Ways and Means chairman Richard Neal (D-MA) will meet with U.S. Trade Rep. Robert Lighthizer to discuss the Democrats’ remaining concerns surrounding the USMCA.

Pelosi’s comments follow the bipartisan House Problem Solvers Caucus’s call for the speaker to hold a “timely vote” on the USMCA. The caucus represents 48 House Republicans and Democrats.

I am one of many people who believe that this delay is political–the trade agreement is a good thing for American workers, and Democrats are reluctant to give President Trump any sort of victory. It is a shame that the Democrats have chosen to put politics over the welfare of American workers.
