Stopping The Invasion

I support the Republican effort to investigate Joe Biden for influence peddling.  However, they also need to impeach him for failure to enforce the immigration laws that he swore to uphold. Not only has he failed to enforce the law, but he has intentionally encouraged what amounts to an invasion of this country. It is realistic to assume that our country may ultimately be destroyed if this invasion is allowed to continue. No country can survive when it is over-run by unvetted people many of whom do not share its values and beliefs. Rome was not destroyed by a stronger military force but by the invasion of so-called barbarians who disrupted their system of government. We are facing the same threat.   

The Washington Examiner estimates that over 10 million illegals have flooded this country since Biden took office. This is more people than the total population of 40 states.  This amounts to about 7,000 per day, and since Biden has about 400 days left to his term of office we can expect a minimum of another 2.8 million. The Heritage Foundation reported that 60% of these illegals are receiving some form of social services support further burdening the taxpayers. The immigration policy used to be that an immigrant would not be admitted unless they could prove they had a means of their own support. We are actually paying them to invade.   Unbelievable! It should also be remembered that most come seeking so-called asylum and if admitted are then able to bring in members of their families. 

The Biden regime has encouraged the abuse of the asylum law. Essentially, the asylum law allows anyone to be admitted to this country who claims that they are being persecuted (or fear persecution) in their home country as a result of their race, religion, nationality, or membership in a particular group. According to recent data, only 14% of these asylum claims that make it to a hearing are declared to be valid. Most of those admitted never show up for their asylum hearing–currently there is an 8 to 9 year backlog.  It should be noted that the asylum law wording follows almost exactly the wording of a United Nations Declaration that encourages the elimination of national borders.   

Here are some reasonable solutions to this crisis: 

  1. Place a cap on the total number of asylum cases per year.
  2. Remove the category of “ …membership in a particular social group” from the asylum law. It is too vague and limitless in scope. 
  3. Remove the so-called “anchor baby” rule that makes the children of illegals citizens if they are born in this country.
  4. Reinstate President Trump’s policy of remaining in country of origin or intervening country when applying for asylum. Crossing the border illegally should preclude any asylum claim. 
  5. Stop any and all illegals from receiving any form of social services. 
  6. Identify and deport anyone here illegally. 

Of course Biden will never voluntarily agree to any of the above. This is where the rubber hits the road. The House of Representatives should identify key spending budget line items important to Biden and cease/cut funding them until the above items are agreed to. Start with green energy incentives, electric car incentives and funding for aspects the federal Department of Education, the FBI and Department of Justice.  

The House has the so-called “power of the purse”.  Now let’s see if they have the courage to use it.    

Common Sense In Immigration Policy

On Monday CNBC posted an article about a Supreme Court decision regarding President Trump’s immigration policy.

The article reports:

The Supreme Court said Monday that it will allow the Trump administration’s “public charge” rule to take effect after the immigration policy had been blocked by lower courts.

The 5-4 vote was divided along partisan lines, with the court’s four Democratic appointees indicating that they would not have allowed the policy to be enforced.

The court’s five conservatives, including Chief Justice John Roberts, formed the majority siding with the administration. The decision came as Roberts was presiding over President Donald Trump’s impeachment trial in the Senate.

The rule, which was proposed in August, will make it more difficult for immigrants to obtain permanent residency, or green cards, if they have used or are likely to use public benefits like food stamps and Medicaid.

Under previous federal rules, a more narrow universe of public benefits, such as cash assistance and long-term hospitalization, were considered in determining whether an immigrant was likely to become a “public charge.”

The following statistics are from the Center for Immigration Studies:

  • No single program explains non-citizens’ higher overall welfare use. For example, not counting school lunch and breakfast, welfare use is still 61 percent for non-citizen households compared to 33 percent for natives. Not counting Medicaid, welfare use is 55 percent for immigrants compared to 30 percent for natives.
  • Welfare use tends to be high for both newer arrivals and long-time residents. Of households headed by non-citizens in the United States for fewer than 10 years, 50 percent use one or more welfare programs; for those here more than 10 years, the rate is 70 percent.
  • Welfare receipt by working households is very common. Of non-citizen households receiving welfare, 93 percent have at least one worker, as do 76 percent of native households receiving welfare. In fact, non-citizen households are more likely overall to have a worker than are native households.1
  • The primary reason welfare use is so high among non-citizens is that a much larger share of non-citizens have modest levels of education and, as a result, they often earn low wages and qualify for welfare at higher rates than natives.
  • Of all non-citizen households, 58 percent are headed by immigrants who have no more than a high school education, compared to 36 percent of native households.
  • Of households headed by non-citizens with no more than a high school education, 81 percent access one or more welfare programs. In contrast, 28 percent of non-citizen households headed by a college graduate use one or more welfare programs.
  • Like non-citizens, welfare use also varies significantly for natives by educational attainment, with the least educated having much higher welfare use than the most educated.
  • Using education levels and likely future income to determine the probability of welfare use among new green card applicants — and denying permanent residency to those likely to utilize such programs — would almost certainly reduce welfare use among future permanent residents.
  • Of households headed by naturalized immigrants (U.S. citizens), 50 percent used one or more welfare programs. Naturalized-citizen households tend to have lower welfare use than non-citizen households for most types of programs, but higher use rates than native households for virtually every major program.
  • Welfare use is significantly higher for non-citizens than for natives in all four top immigrant-receiving states. In California, 72 percent of non-citizen-headed households use one or more welfare programs, compared to 35 percent for native-headed households. In Texas, the figures are 69 percent vs. 35 percent; in New York they are 53 percent vs. 38 percent; and in Florida, 56 percent of non-citizen-headed households use at least welfare program, compared to 35 percent of native households.

At this point I need to say that I am not against helping people in need, but we do need to get our priorities in order. Our Veterans’ Administration health system is horrible. It is underfunded and does not have the facilities necessary to meet the needs of our returning veterans. We have been at war for eighteen years, and we have broken faith with those who have fought those wars. Shouldn’t taking care of those veterans be a higher priority than taking care of people who are not American citizens? Look at the budget deficits we are running–we can’t afford to do both.

I applaud the Supreme Court for upholding a common-sense approach to immigration.

Six Major Challenges In 2019

On December 28th, Investor’s Business Daily posted an editorial listing what their editors considered would be the top six issues of 2019. The title of the editorial is, “Will 2019 Be Happy? It Depends On How Washington Handles These 6 Challenges.” I suspect that is true.

The editorial lists the six items:

1. The Federal Reserve

2. Trade

3. Immigration

4. The Coming Budget Battle

5. Slaying The Regulatory Dragon

6. Fixing Health Care ‘Reform’

Here are some of the observations from the editorial on each item:

The Fed has raised its benchmark funds rate eight times over two years in pursuit of a “neutral” rate. Its most recent rate hike, coming about a week before Christmas, was followed by a steep decline in stocks and growing concerns that the economy might fall into recession next year if the central bank follows through on its plan to raise rates at least twice more.

It’s of more than academic interest that all 11 of the U.S. recessions since World War II were preceded by a sharp run up in Fed rates. Every one of them. It’s not a record of which to be proud.

…Despite bitter criticisms, President Trump successfully concluded a “new Nafta” deal with both Canada and Mexico covering $1.3 trillion in trade. The deal closes a number of holes in the old Nafta, increasing U.S. access to Canadian dairy markets, for instance, while also making cars tariff-free if 75% of their parts are made in the U.S., Canada or Mexico. All three countries signed off on the deal. The only question is, will it ever go into effect?

With Democrats controlling Congress and just six months for the trade deal to go into effect, some worry that major changes will be requested. President Trump has asked that either the new U.S.-Mexico-Canada Agreement be approved outright, or revert to the pre-Nafta trading rules. Congressional Democrats may even challenge Trump’s right to make a deal, putting the so-called USMCA in limbo. Stay tuned.

…With Americans eager to control immigration, as polls repeatedly show, Democrats may decide that negotiation rather than confrontation is a better tactic. That could mean a deal for a pathway to citizenship for the millennial illegal immigrant “dreamers,” many of whom have lived in the U.S. for most of their lives despite not having citizenship. With an estimated 22 million illegals in the U.S., many states are eager to gain some stability in our immigration policy.

…This year’s budget battle over funding the wall will likely pale in comparison to next year’s. The continued growth in entitlements, compounded by the sharp rise in interest payments, thanks to the Fed’s rate hikes, will balloon the deficit. The Congressional Budget Office’s last official projection pegged the deficit for 2019 at $981 billion. It will likely end up topping $1 trillion.

…But as we’ve pointed out many times, the problem isn’t tax cuts, it’s the unwillingness of anyone in Washington — including Trump — to deal with entitlement programs that have swamped the federal budget. Trump and the GOP will have to stand firm on taxes next year, while grappling with a rising tide of debt that will soon surpass $21 trillion.

…ObamaCare limped along for another year, with premiums for 2019 falling, overall, after years of massive double-digit increases. Trump took several steps to improve ObamaCare. The most important fix was to breathe life back into the short-term insurance market that President Obama tried to snuff out to protect the ObamaCare exchanges. Unfortunately, since Republicans blew their chance at repeal, the best we can hope for is that Trump will continue to tweak the law where he can. But he shouldn’t shy away from fighting for more free-market reforms. Should Democrats resist, or start pushing for socialized “Medicare for all,” it will create an opportunity for Trump to paint Democrats as big-government extremists.

The article concludes:

The coming year will be eventful, with many of Trump’s main initiatives set for action by Congress — a Congress, as we noted, that won’t be as friendly to Trump as the last one. Whether Trump and the Democrats can, as the bumper sticker says, coexist, or whether the Trump agenda founders on a never-ending stream of congressional investigations and hearings on the White House, remains to be seen. We guarantee it won’t be boring.

We Really Did Handle Immigration Better At Ellis Island

LifeZette posted an article today about the migrant caravan attempting to get into America from Mexico.

The article reports:

Migrants who came with the caravan are suffering from respiratory infections, tuberculosis, chickenpox and other serious health issues, Tijuana’s Health Department warned on Thursday morning.

The spokesman told Fox News that out of 6,000 migrants currently residing in the city, over a third of them (2,267) are being treated for health-related issues.

There are three confirmed cases of tuberculosis, four cases of HIV/AIDS and four separate cases of chickenpox, the spokesman said.

At least 101 migrants have lice and multiple instances of skin infections, the department’s data shows.

There’s also a threat of Hepatitis outbreak due to unsanitary conditions, the spokesman said.

At Ellis Island, immigrants who were not healthy or had no marketable skills were returned to their home countries.

The biggest change to America’s immigration policies occurred in 1965 and was promoted by Senator Ted Kennedy.

So what did The Immigration and Nationality Act of 1965 (H.R. 2580) do? Here are the basics:

The Hart–Celler Act abolished the quota system based on national origins that had been American immigration policy since the 1920s. The 1965 Act marked a change from past U.S. policy which had discriminated against non-northern Europeans. In removing racial and national barriers the Act would significantly alter the demographic mix in the U.S.

The new law maintained the per-country limits, but also created preference visa categories that focused on immigrants’ skills and family relationships with citizens or U.S. residents. The bill set numerical restrictions on visas at 170,000 per year, with a per-country-of-origin quota. However, immediate relatives of U.S. citizens and “special immigrants” had no restrictions.

On September 2, 2009, Numbers USA posted the following about that change:

Ted Kennedy’s immigration policies have destroyed the ability of the United States to be an environmentally sustainable nation in any decade soon because of the gigantic U.S. population growth that he has forced.

And Ted Kennedy’s immigration policies have knocked hundreds of thousands of Americans out of the middle class as their occupations have collapsed and wages declined because of inundation with Kennedy’s favored foreign workers, or because they have directly lost their jobs to foreign competitors.

We need to consider the consequences of the Hart-Celler Act as we decide how to deal with the migrant caravans that are attempting to breach our southern border.

Donald Trump’s Immigration Plan

I will repeat–I am not endorsing Donald Trump, but a friend emailed this to me and I think it is interesting. Also, I am told that anything with Donald Trump’s name in it will get multiple clicks, and I am not above pandering. At any rate, this is Donald Trump’s plan:

IMMIGRATION REFORM THAT WILL MAKE AMERICA GREAT AGAIN

The three core principles of Donald J. Trump‘s immigration plan

When politicians talk about “immigration reform” they mean: amnesty, cheap labor and open borders. The Schumer-Rubio immigration bill was nothing more than a giveaway to the corporate patrons who run both parties.

Real immigration reform puts the needs of working people first – not wealthy globetrotting donors. We are the only country in the world whose immigration system puts the needs of other nations ahead of our own. That must change. Here are the three core principles of real immigration reform:

1. A nation without borders is not a nation. There must be a wall across the southern border.

2. A nation without laws is not a nation. Laws passed in accordance with our Constitutional system of government must be enforced.

3. A nation that does not serve its own citizens is not a nation. Any immigration plan must improve jobs, wages and security for all Americans.

Make Mexico Pay For The Wall

For many years, Mexico’s leaders have been taking advantage of the United States by using illegal immigration to export the crime and poverty in their own country (as well as in other Latin American countries). They have even published pamphlets on how to illegally immigrate to the United States. The costs for the United States have been extraordinary: U.S. taxpayers have been asked to pick up hundreds of billions in healthcare costs, housing costs, education costs, welfare costs, etc. Indeed, the annual cost of free tax credits alone paid to illegal immigrants quadrupled to $4.2 billion in 2011. The effects on jobseekers have also been disastrous, and black Americans have been particularly harmed.

The impact in terms of crime has been tragic. In recent weeks, the headlines have been covered with cases of criminals who crossed our border illegally only to go on to commit horrific crimes against Americans. Most recently, an illegal immigrant from Mexico, with a long arrest record, is charged with breaking into a 64 year-old women’s home, crushing her skull and eye sockets with a hammer, raping her, and murdering her. The Police Chief in Santa Maria says the “blood trail” leads straight to Washington.

In 2011, the Government Accountability Office found that there were a shocking 3 million arrests attached to the incarcerated alien population, including tens of thousands of violent beatings, rapes and murders.

Meanwhile, Mexico continues to make billions on not only our bad trade deals but also relies heavily on the billions of dollars in remittances sent from illegal immigrants in the United States back to Mexico ($22 billion in 2013 alone).

In short, the Mexican government has taken the United States to the cleaners. They are responsible for this problem, and they must help pay to clean it up.

The cost of building a permanent border wall pales mightily in comparison to what American taxpayers spend every single year on dealing with the fallout of illegal immigration on their communities, schools and unemployment offices.

Mexico must pay for the wall and, until they do, the United States will, among other things: impound all remittance payments derived from illegal wages; increase fees on all temporary visas issued to Mexican CEOs and diplomats (and if necessary cancel them); increase fees on all border crossing cards – of which we issue about 1 million to Mexican nationals each year (a major source of visa overstays); increase fees on all NAFTA worker visas from Mexico (another major source of overstays); and increase fees at ports of entry to the United States from Mexico [Tariffs and foreign aid cuts are also options].  We will not be taken advantage of anymore.

Defend The Laws And Constitution Of The United States

America will only be great as long as America remains a nation of laws that lives according to the Constitution. No one is above the law. The following steps will return to the American people the safety of their laws, which politicians have stolen from them:

Triple the number of ICE officers. As the President of the ICE Officers’ Council explained in Congressional testimony: “Only approximately 5,000 officers and agents within ICE perform the lion’s share of ICE’s immigration mission…Compare that to the Los Angeles Police Department at approximately 10,000 officers. Approximately 5,000 officers in ICE cover 50 states, Puerto Rico and Guam, and are attempting to enforce immigration law against 11 million illegal aliens already in the interior of the United States. Since 9-11, the U.S. Border Patrol has tripled in size, while ICE’s immigration enforcement arm, Enforcement and Removal Operations (ERO), has remained at relatively the same size.” This will be funded by accepting the recommendation of the Inspector General for Tax Administration and eliminating tax credit payments to illegal immigrants.

Nationwide e-verify. This simple measure will protect jobs for unemployed Americans.

Mandatory return of all criminal aliens. The Obama Administration has released 76,000 aliens from its custody with criminal convictions since 2013 alone. All criminal aliens must be returned to their home countries, a process which can be aided by canceling any visas to foreign countries which will not accept their own criminals, and making it a separate and additional crime to commit an offense while here illegally.

Detention—not catch-and-release. Illegal aliens apprehended crossing the border must be detained until they are sent home, no more catch-and-release.

Defund sanctuary cities. Cut-off federal grants to any city which refuses to cooperate with federal law enforcement.

Enhanced penalties for overstaying a visa. Millions of people come to the United States on temporary visas but refuse to leave, without consequence. This is a threat to national security. Individuals who refuse to leave at the time their visa expires should be subject to criminal penalties; this will also help give local jurisdictions the power to hold visa overstays until federal authorities arrive. Completion of a visa tracking system – required by law but blocked by lobbyists – will be necessary as well.

Cooperate with local gang task forces. ICE officers should accompany local police departments conducting raids of violent street gangs like MS-13 and the 18th street gang, which have terrorized the country. All illegal aliens in gangs should be apprehended and deported. Again, quoting Chris Crane: “ICE Officers and Agents are forced to apply the Deferred Action for Childhood Arrivals (DACA) Directive, not to children in schools, but to adult inmates in jails. If an illegal-alien inmate simply claims eligibility, ICE is forced to release the alien back into the community. This includes serious criminals who have committed felonies, who have assaulted officers, and who prey on children…ICE officers should be required to place detainers on every illegal alien they encounter in jails and prisons, since these aliens not only violated immigration laws, but then went on to engage in activities that led to their arrest by police; ICE officers should be required to issue Notices to Appear to all illegal aliens with criminal convictions, DUI convictions, or a gang affiliation; ICE should be working with any state or local drug or gang task force that asks for such assistance.”

End birthright citizenship. This remains the biggest magnet for illegal immigration. By a 2:1 margin, voters say it’s the wrong policy, including Harry Reid who said “no sane country” would give automatic citizenship to the children of illegal immigrants.

Put American Workers First

Decades of disastrous trade deals and immigration policies have destroyed our middle class. Today, nearly 40% of black teenagers are unemployed. Nearly 30% of Hispanic teenagers are unemployed. For black Americans without high school diplomas, the bottom has fallen out: more than 70% were employed in 1960, compared to less than 40% in 2000. Across the economy, the percentage of adults in the labor force has collapsed to a level not experienced in generations. As CBS news wrote in a piece entitled “America’s incredible shrinking middle class”: “If the middle-class is the economic backbone of America, then the country is developing osteoporosis.”

The influx of foreign workers holds down salaries, keeps unemployment high, and makes it difficult for poor and working class Americans – including immigrants themselves and their children – to earn a middle class wage. Nearly half of all immigrants and their US-born children currently live in or near poverty, including more than 60 percent of Hispanic immigrants. Every year, we voluntarily admit another 2 million new immigrants, guest workers, refugees, and dependents, growing our existing all-time historic record population of 42 million immigrants. We need to control the admission of new low-earning workers in order to: help wages grow, get teenagers back to work, aid minorities’ rise into the middle class, help schools and communities falling behind, and to ensure our immigrant members of the national family become part of the American dream.

Additionally, we need to stop giving legal immigrant visas to people bent on causing us harm. From the 9/11 hijackers, to the Boston Bombers, and many others, our immigration system is being used to attack us. The President of the immigration caseworkers union declared in a statement on ISIS: “We’ve become the visa clearinghouse for the world.”

Here are some additional specific policy proposals for long-term reform:

Increase prevailing wage for H-1Bs. We graduate two times more Americans with STEM degrees each year than find STEM jobs, yet as much as two-thirds of entry-level hiring for IT jobs is accomplished through the H-1B program. More than half of H-1B visas are issued for the program’s lowest allowable wage level, and more than eighty percent for its bottom two. Raising the prevailing wage paid to H-1Bs will force companies to give these coveted entry-level jobs to the existing domestic pool of unemployed native and immigrant workers in the U.S., instead of flying in cheaper workers from overseas. This will improve the number of black, Hispanic and female workers in Silicon Valley who have been passed over in favor of the H-1B program. Mark Zuckerberg’s personal Senator, Marco Rubio, has a bill to triple H-1Bs that would decimate women and minorities.

Requirement to hire American workers first. Too many visas, like the H-1B, have no such requirement. In the year 2015, with 92 million Americans outside the workforce and incomes collapsing, we need to companies to hire from the domestic pool of unemployed. Petitions for workers should be mailed to the unemployment office, not USCIS.

End welfare abuse. Applicants for entry to the United States should be required to certify that they can pay for their own housing, healthcare and other needs before coming to the U.S.

Jobs program for inner city youth. The J-1 visa jobs program for foreign youth will be terminated and replaced with a resume bank for inner city youth provided to all corporate subscribers to the J-1 visa program.

Refugee program for American children. Increase standards for the admission of refugees and asylum-seekers to crack down on abuses. Use the monies saved on expensive refugee programs to help place American children without parents in safer homes and communities, and to improve community safety in high crime neighborhoods in the United States.

Immigration moderation. Before any new green cards are issued to foreign workers abroad, there will be a pause where employers will have to hire from the domestic pool of unemployed immigrant and native workers.

I don’t agree with everything listed, but I think it is time to have a discussion that includes compassion for refugees who want to come here and some protection for unemployed Americans.The ideas above might be a place to start the discussion.

One Consequence Of Changes In Immigration Law

Yesterday the Miami Herald reported on the case of Kesler Dufrene, an illegal immigrant from Haiti who was a twice-convicted felon serving a five-year jail term. When Mr. Dufrene’s sentence was up, he was released from prison rather than deported to his native Haiti because the Obama Administration ordered an indefinite halt of deportations to Haiti after the nation’s devastating earthquake. U.S. authorities could not legally detain Dufrene indefinitely. The story does not have a happy ending.

The article reports:

Instead, when Dufrene’s state prison term was up, Miami immigration authorities in October 2010 released him from custody. Two months later, North Miami police say, he slaughtered three people, including a 15-year-old girl in a murder case that remains as baffling today as it did the afternoon the bodies were discovered.
DNA on a rifle found inside the house and cellphone tracking technology later linked Dufrene to the Jan. 2, 2011, slayings.

Eighteen days after the murders, Mr. Dufrene shot and killed himself when he was cornered by Manatee County sheriff’s deputies in Bradenton after an unrelated break-in and shooting there.

It seems to me that a mistake was made somewhere along the line that resulted in the unnecessary death of three people. We need sanity in our immigration policy. If you are here illegally and you commit a crime, you should be sent home–regardless of where home is.
