A Different Take On The Constitutionality Of ObamaCare

The Daily Caller posted an article today about changes made to ObamaCare by Congress. The article reminds us that in 2017, the Republican-majority Congress did not have the votes to repeal the ACA, but did set the individual mandate penalty at zero. They didn’t repeal it, but they took the teeth out of it.

The article then reminds of the Supreme Court’s decision on ObamaCare:

In 2012, the five conservative justices on the United States Supreme Court (including Chief justice John Roberts) held that key portions of the Affordable Care Act (ACA) exceeded Congress’s constitutional authority under the Commerce Clause. But, Chief Justice Roberts then joined the four liberal justices on the Court in upholding the ACA as a tax under Congress’s taxing power because it generated revenue for the federal government.

The question then becomes, “If ObamaCare is no longer generating revenue, is it still a tax?’ If it is no longer a tax, does it still fall under the Commerce Clause?”

The article states:

A recent op-ed at The Federalist claims that striking down the ACA would be “judicial activism.” The article doesn’t defend the ACA as constitutional, but argues that conservatives shouldn’t ask “unelected judges to do what elected members of Congress took great pains to avoid.”

Such a broad view of “judicial activism” would render virtually any judicial review out of bounds. More importantly, it is contrary to the very system of checks and balances set up by the Founders in the Constitution. There is no Constitutional duty to persuade a majority of Congress to stop violating the Constitution—that’s what makes it a written constitution in the first place.

The article concludes:

And there is the rub. Judicial activism, rightly understood, is when a court tries to exercise the legislative function — i.e., when a court writes laws instead of saying what the law is. But asking courts to carve out the unconstitutional provisions from laws is exactly that. Advocating for severability asks the judicial branch to judge the law Congress should have written, not the one it did. A more restrained approach would be to strike down the whole law and let Congress decide whether it wants to pass the law again without the unconstitutional provisions included.

An old saying goes something like: “When you mix a cup of sewage in a barrel of wine, you end up with a barrel of sewage and have to throw the whole thing out.” To extend the metaphor, courts shouldn’t be in the business of sifting through a law to pick the sewage out of the wine, they should throw the whole thing out. Striking down unconstitutional laws is not judicial activism, and it is well within the role of the judiciary to strike the entire ACA as such.

It is definitely time to get rid of the barrel of sewage!

Not Really A Surprise

The American Spectator posted an article today that tells us everything we already knew about ObamaCare. The Centers for Disease Control (CDC) has just released a report about uninsured Americans.

The article reports:

Anyone with the intestinal fortitude to subject themselves to the legacy media will have seen countless “news” stories about the devastation wrought by President Trump’s “sabotage” of Obamacare. A typical headline appeared a couple of weeks ago in the Washington Post: “Americans are starting to suffer from Trump’s health-care sabotage.” This work of fiction claimed that the number of working-ageAmericans without health insurance had risen to 15.5 percent, a 3 point increase since 2016. But a report just released by the Centers for Disease Control (CDC), says the real number is 12.8 percent — exactly what it was in 2015.

…NBC recently reported that the total number of uninsured Americans rose by a preposterous 3.2 million in 2017. According to the CDC, however, “There was no significant change from the 2016 uninsured rate.” The percentage is, like the working age statistic, precisely what it was in 2015. NBC, parroting the Post, based its uninsured propaganda on an unreliable source.

There are a few things to keep in mind when evaluating ObamaCare. The first is that is was never about health insurance–it was about giving government control of a major sector of the American economy and a major sector of people’s lives. We have seeen how well socialized medicine works in Britain when a child isn’t even given a chance to leave the country to receive alternative medical care that could possibly save his life. ObamaCare was a planned failure that would lead to socialized medicine in America during the presidency of Hillary Clinton. We have dodged that bullet (at least temporarily).

The major change that occurred to ObamaCare this year was the end of government subsidies to insurance companies and changing rules for insurance pools to make it easier for people to get health insurance in various groups. The real answer to health insurance is the free market–let companies compete without being over-regulated and let people know how much they are actually paying for healthcare services. It would also help to end ObamaCare completely. In order to end ObamaCare completely, the Republicans would have to learn how to get their message out over the din of the mainstream media. They would also have to develop a spine.

The article concludes:

A multi-year study dubbed the “Oregon Health Experiment,” whose results were published in the New England Journal of Medicine in May of 2014, has demonstrated that health outcomes for Medicaid patients are no better than those enjoyed by the uninsured. Scott Gottlieb, the current Commissioner of the Food and Drug Administration, summarized various Medicaid studies in the Wall Street Journal and also concluded that being covered by Medicaid is demonstrably worse for your health than having no coverage at all.

The CDC report doesn’t weigh in on this issue, of course. It just attempts to show us where the uninsured rate was and where it is now. But that is damning enough. It not only shows that the projections originally touted for Obamacare were wildly off the mark — it was supposed to have brought the non-elderly uninsured rate down to 7.6 percent by 2016 — it demonstrates that the Democrats and their media co-conspirators have been lying about what the real uninsured numbers are as well as President Trump’s role in their mythical increase. Not that this is new. The Democrats and the media have been lying about Obamacare from day one.

As more Americans realize that the media has been lying to them from the beginning, we may have a chance to get rid of ObamaCare. Until then, we are stuck with it.

Beware Of The Small Print In ObamaCare

Yesterday the Seattle Times posted an article about a provision of ObamaCare that has come as a surprise to some of the elderly people who are subscribing to the program.  The story deals with Sofia Prins and Gary Balhorn, both 62, who after reading the fine print in Medicaid that has changed as a result of ObamaCare, decided to get married.

The article explains the problem:

Medicaid, in keeping with federal policy, has long tapped into estates. But because most low-income adults without disabilities could not qualify for typical medical coverage through Medicaid, recovery primarily involved expenses for nursing homes and other long-term care.

The federal Affordable Care Act (ACA) changed that. Now many more low-income residents will qualify for Medicaid, called Apple Health in Washington state.

But if they qualify for Medicaid, they’re not eligible for tax credits to subsidize a private health plan under the ACA, which requires all adults to have health insurance by March 31.

Prins, an artist, and Balhorn, a retired fisherman-turned-tango instructor, separately qualified for health insurance through Medicaid based on their sole incomes.

But if they were married, they calculated, they could “just squeak by” with enough income to qualify for a subsidized health plan — and avoid any encumbrance on the home they hope to leave to Prins’ two sons.

The article further reports:

Late Friday, Gov. Jay Inslee’s office and the state Medicaid office said they plan to draft an emergency rule to limit estate recovery to long-term care and related medical expenses.

They hope to be able to change the rules before coverage begins Jan. 1.

Fixing the problem will cost the state about $3 million a year, said Dr. Bob Crittenden, Inslee’s senior health-policy adviser, but it’s the right thing to do.

“There was no intent on the part of the ACA to do estate recovery on people going into Medicaid (for health insurance),” Crittenden said. “The idea was to expand coverage.”

One of the problems with ObamaCare is that it will move many people who previously had basic health insurance into Medicaid. Unfortunately, Medicaid cannot support this increase–it is already going broke. The increase in Medicaid enrollment will put a severe financial burden on states, and create budget problems for the states that have formed healthcare exchanges.

The article explains the risk of the fine print in ObamaCare:

For health coverage through Medicaid, income is now the only financial requirement.

At first, Prins was pleased at the prospect of free coverage.

But the more she thought about the fine print, the more upset she got. Why was this provision only for people age 55 and older? Why should those insured by Medicaid have to pay back health expenses from their estates when people with just a bit more income who get federal subsidies don’t? Why didn’t she and Balhorn know about this before getting to the application stage?

As Prins began searching for answers, she found that even those trained to help people sign up for insurance under the ACA weren’t aware of this provision, nor were some government officials.

Around the country, the issue has sizzled away in blogs and commentaries from both right and left. The National Women’s Law Center noted the ACA and its regulations prohibit age discrimination in programs such as Medicare and Medicaid.

Dr. Jane Orient, executive director of the politically conservative Association of American Physicians and Surgeons, writing in the The Washington Times, called the recovery provision “a cash cow for states to milk the poor and the middle class.”

“People will think this is wonderful, this is free insurance,” Orient said in an interview. “They don’t realize it’s really a loan, and is secured by any property they have.”

Even states that are now limiting estate recovery, she warned, can change the rules again if budget problems become more intense.

When you think about it, taking money from the estates of the middle class is simply another way to redistribute wealth, one of the major results of the implementation of ObamaCare. It is becoming very obvious that ObamaCare is a nightmare for the states, the insurance companies, and the insured. It needs to be repealed and replaced.
